1. MEETING CALL:
The Regular Meeting of the Board of Trustees was called to order by President
Bushy in the Samuel E. Dean Board Room of the Village Commons at 7:32
p.m. Pledge of Allegiance was given.
The Clerk called the roil with the following persons
PRESENT: President Bushy, Trustees Kenny, Payovich and Shumate.
Trustee McInerney arrived at 7:37 p.m.
ABSENT: Trustees Bartecki and Savino.
IN ATTENDANCE: Stephen B. Veitch, Village Manager; Michael A. Crotty,

President Bushy recognized the June 14 observance of Flag Day, noting the
effort being made by a flag organization to have all Americans recite the
Pledge to the flag on that date.
Trustee Kenny reported that a fatal car accident occurred at 4:00 p.m. this
afternoon at the intersection of 31 st Street and Midwest Road. This resulted in
the closure of 31 st Street for approximately two hours. Chief of Police Klatzco
and Fire Chief Nielsen were still at the scene and not in attendance at the Board
Meeting
Mario Vescovi, President of the Fullersburg Woods Area Association,
withdrew the request of the Village to close Spring Road during the
construction and closure of York Road for the bridge repair.
Mr. Vescovi suggested using traffic counters to monitor the amount of tragic
in the area. President Bushy felt the traffic counters could be expensive, and
the Village could accomplish the desired results via traffic enforcement.

Discussed at the Regular meeting of April 23, 1996. Slight
modificatiors have been made to the draft. The principal changes are:
(1) to add language covering license applications by limited liability
companies; and (2) to add to Section 3 -73, which deals with the
responsibility premises owners or occupants for possession of
alcoholic liquor by minors, language to clarify the meaning of
"possess" and to create a rebuttable presumption that refusal to submit
to testing constitutes possession. The second change was
recommended by the Villages special prosecutions counsel.
It was noted that although the proposed ordinance does not signal a
shift in the Village's philosophy with respect to the regulation of
alcoholic liquor, it does express the existing policy in clearer, more
complete and more enforceable terms.
Motion by Trustee McInerney, seconded by Trustee Kenny, to pass
Ordinance 96 -AL -R R -EX 1 -G -570, "An Ordinance Adopting a
Comprehensive Amendment to Chapter 3 Entitled. "Alcoholic
Liquor ", of the Code of Ordinances of the Village of Oak Brook,

The proposed ordinance a1 ithorizes the issuance of a Sports Core
Refunding Note in the amount of $78,919.52 with Oak Brook Bank.
The original borrowing of $522,000 commenced in 1989 and
provided for the purchase of equipment and the maintenance facility
at the Sports Core. The financing has been accomplished by means of
a series of 1 -year notes due on May 12 each year, with the remaining
principal balance being refinanced for an additional one year term.
The interest rate on the note is 6.8% and the monthly payment on this
obligation is $6,802, the same terms as those in effect when the note
was originally issued. This is the last note to be refinanced since this
debt will be fully repaid on May 12, 1997. The monthly payments
have been budgeted for in the Golf Course Maintenance Program
(8304).

The Local Agency Agreement for Federal Participation is a standard
part of the jurisdictional transfer of York Road within the limits of
this project and depicts the cost sharing arrangement between the
Federal Government, the Illinois Department of Transportation
(IDO'T) and the Village. The Village's estimated share of
construction cost is $321,400. The 1996 Budget contains $393,400
for this project ($230,000 for construction, $163,400 for land
acquisition). The major reason for the $91,400 construction cost
difference is a requirement by IDOT for transition lighting along, York
Road on either side of 22nd Street in the amount of appeoximutely
$80,000. This is a new IDOT requirement which was not within the
design report its approved by IDOT. The Village can corer part of the

overrun with unexpensed land acquisition funds. Additional Village
funds can be budgeted in 1997 to cover any remaining amount (this
project will carry into next year).
Concerning the jurisdictional transfer of York Road, this agreement
states that the Village will assume jurisdiction and maintenance of
York Road within the limits of this project (north of Golf Drive
northerly to the first Tollway Bridge). This distance does not include
the entire section of York Road which staff had been discussing with
IDOT. That concept basically included a swap of right -of -way with
the Village taking York Road from the northerly limit of this project
to the north Village limits Oust north of Harger Road) in exchange for
the State taking, over 22nd Street. That swap has been committed to
by IDOT in the McDonald's commitment letter, but is = part of this
agreement

The Public Works Department is in the midst of a multi -year program
for the replacement of water meters. The current residential and
commercial meters are gradually being replaced (a mix of over 500
meers per year) in order to improve the accuracy of older meters, to
switch to a meter head and outside sensing device (Touch -Pad) which
will permit a more accurate means of collecting the meter reading
data, and to eliminate the outside reading mechanism which often
does not match the actual usage as indicated on the inside Meter

(resulting in unbillable water). The water meters used in the Village
are manufactured by the Sensus Corporation. WaterPro has the
exclusive franchise in Illinois.
Current plans are to place one or more large orders (each order greater
than 500 meters), for a mixv.:re of various meter sizes (WaterPro will
honor the >500 unit price for a mix of sizes). Since Village forces
will be replacing the meters, our total quantity ordered for 1996 will
be dependent on available time to c3mplete the change -outs.
Funds in the amount of $80,000 are contained in the Water Operations
Program (08 -3501) to cover this purchase.
Motion by Trustee Payovich, seconded by Trustee Kenny, to waive
bidding due to sole source, and authorize the issuance of a Purchase
Order to WaterPro Supplies Corporation, Carol Stream, fc,r water
meters and accessories, based on negotiated unit prices for an
estimated not -to- exceed amount of $80,000 for the 1996 year. ROLL

Bid packages were sent to sixteen (16) firms. Competitive sealed bids
were received on May 1, 1996 from six (6) companies.
Chicago. Communications' bid for the Spectra A -9 radio, although
lower, did not meet specifications which requires the bid to include all
necessary items to make the radios operable. An adapter for the head
set was left ou, their bid, but was included in the next lowest bid of
Illinois Communications.
Departmental budget amounts are shown on the bid tabulation, with a
total budget of $28,800 for all specified radios. The low bids are
approximately $7.430 tinder budgeted amounts. Delivery of all radios
will be from 14 to 30 days as indicated in the bids and on the
tabulation.

contracts to the following three companies, subject to staff review, the
lowest responsive bidders, for each type of radio, as indicated on the
bid tabulation:

The Illinois Saint Andrew Society is requesting use of Sports Core
fields 2 and 3 for a fee of $5,000.00 on Saturday, June 15, 1996, to
hold the Highland Games and Scottish Festival. Use of the fields will
be subject to submission of all pertinent permits and documents as
stated in the Village of Oak Brook Code of Ordinances.
The Illinois Saint Andrew Highland Games is the find raising
division of The Illinois Saint Andrew Society. The main charitable
recipient of The Illinois Saint Andrew Society is the Scottish biome
(nursing and elderly home) in North Riverside, Illinois.
Motion by Trustee McInerney, seconded by Trustee Kenny, to
authorize staff to enter into an "Agreement Between_ The Village Of
Oak Brook, DuPage County, Illinois, A Municipal Corporation, And
The Illinois Saint Andrew Society, An Illinois Not- For - Profit
Corporation, For Use of Polo Fields 2 And 3 On Saturday, June 15,
1996" and authorize the Village President and Clerk to affix their

DuPage County has awarded a contract for the York Road/Salt Creek
bridge reconstruction project. The County recently informed the
Village that additional right -of -way and temporary easements are
necessary before they can proceed with the work. Some of the parcels
are on land owned jointly by the Forest Preserve District of DuPage
County, the Village of Hinsdale, and the Village of Oa k Brook. Thus,
the County has provided an Agreement concerning the concept of
transferring land and granting easements.

Specifically, the Agreement contains the following (concerning Oak
Brook):
I. Oak Brook will convey to the County its interests in a portion of
the two jointly owned parcels adjacent to York Road.
2. Oak Brook will grant a temporary easement for the construction of
compensatory storage on the northerly jointly owned parcel.
3. The County will dedicate and Oak Brook will accept right -of -way
and assume jurisdiction and maintenance of the relocated Spring
Road. (Spring Road will be realigned to intersect with York Road
at a right angle, opposite the existing Forest Preserve parking lot.
and a traffic signal with pedestrian access will be installed.)
4. All of the construction will be paid by the County.
Exhibit A to the Agreement stated that Oak Brook will receive
$17,164.57 as compensation made up of land value for the rights -of-
way and temporary easement and damages for tree removal.
Motion by Trustee Payovich, seconded by Trustee McInerney, to
approve "Agreement - County Highway 8 - York Road Bridge" and
authorize the Village President and Clerk to affix their signatures

shopping center on 22nd Street next to Andy's is proceeding slowly.

Village President: President Bushy - Distributed copies of her Activity Report
to the Trustees indicating her activities from November 15, 1995 to May 14,
1996. She noted that the new windows will be installed at the Bath and Tennis
Clubhouse within the next two weeks. S'he also reported that the 1 percent
room rate for the Oak Brook Hotel, Convention and Visitors Committee which
goes back to the Committee seems to be paying off in increased business for all
of the hotels in Oak Brook.

Several residents in attendance spoke in opposition to the closing of
Spring Road.
Vi Rogulic, 5 Robin Hood Ranch, opposes closure.
Stella Glodek, 3702 Frederick Drive, pointed out the community must
accept wider roads in order to be a progressive village.
Tim Trager, 3500 Spring Road, asked about the rebuilding of Spring
Road and the lowering of speed limits on Spring Road and Madison
Street. Village Manager Veitch stated that major work on Spring
Road is programmed for 1998 or 1999, but that interim repairs will be
done in 1996. A recommendation to reduce the speed limit on Spring
Road is forthcoming shortly.
It was a consensus of the Board of Trustees to wait and take no action
at this time.
