MEETING CALL: MEETING CALL The Regular Meeting of the Board of Trustees was called to order by President Bushy in the Samuel E. Dean Board Room of the Village Commons at 7:34 p.m. Pledge of Allegiance was given. 2. Trustee Shumate noted a Sports Core appreciation reception will be held on Thursday, May 27, 1993 at the Bath and Tennis Club for the Bath & Tennis Coam►ittee, Golf Committee and Staff assisting in the opening of the Sports Core. New staff members will be introduced, rehabilitation of the Sports Core and maintenance areas that need itimprov%ment will be shown to all those attending. President Bushy commended Bruce Kapff on behalf o-� the Board and residents as Acting Village Manager for his dedication of managing the Village the past year while the Board searched for a new manager. Vince Long and staff members were also commended for their assistance. President Bushy noted Bruce Kapff, by his own choice, was not a candidate for the Village Manager's position. 4. SYSTEM V -411age Attorney Martens informed the Board of the six -month negotiation process with Metropolitan Fiber Systems for contracting a fiber optic system through the Village of Oak Brook. He noted Trustees Bartecki and Payovich were instrumental in the negotiation process. The question of the authority of municipalities imposing a franchise fee was approved, but the case is up for a rehearing. Trustee Shumate noted the franchise agreements with Continental Cablevision and the telephone company allows theme to install the fiber optic cable. Continental Cablevision has increased their fee` and never came before the Board for an approval. If it is not regulated, the companies can do what they want and now a third company wants to do this. VILT -AGE OF OAK BROOK Minutes 4 May 25, 1993 B - eOT-- M i 0 5-",493 Larry Berent, representing Metropolitan Fiber Systems, stated his company is regulated by the Circe Commission and not allowed by law to change fees. Trustee Shumate inquired if his company Merged, sold or was transferred; Mr. Berenit stated this language is in the contract that his company has to come before the Village Board for their approval. Trustee Skinner moved to pass Ordinance No. S -755 as presented and waive the full reading thereof. Seconded by Trustee Payovich. DEPARTMENTAL REPORTS - SPECIALTY AREAS: No Business. 10. UNFINISHED BUSINESS. A. RECOMMATION - OAK BROOK ZONIM ORDINANCE TEXT AMENDMENTS. Six (6) different changes have been proposed to the Zoning Ordinance which are routine in nature and basic housekeeping function. The Plan rAmanission, at their meeting of March 15, 1993, reviewed these proposed ndments. The Zoning Board of Appeals, at their meeting of April 6, 19930, held the required public hearing. There was no public testimony in opposition to any of the proposed amendments. Both bodies have recommended approval of the following changes to the Zoning Ordinance by a margin of 6 to 0. 1. Trustee Skinner moved to revise Section V(B) and Section XIV(B)(86) as written and waive the full reading thereof and authorize the Village Attorney to draft the necessary ordinance. Seconded by Trustee Payovich. VOICE VOTE: Motion carried. Trustee Shumate noted a conflict of statement in "A Lot of Record ". Attorney martens suggested tabling this section for further review by staff. Trustee Skinner moved to table Section V(B)(5) and Section XIV (B) (86) for review by staff to clarify "A Lot of Record". Seconded by Trustee Bartecki. VOICE MOTE: Motion carried. 2. Entryway Canopies For Certain Comercial Buildings - The u or.r� r�ai�o �.o .. amendment allows for a maxim i; encroachment of 600 square feet into a front or corner side yard with a minimum depth of 100 feet and a gross areas typically in excess of 25,000 square feet. TEXT A�fENDMEiVTS Trustee Skinner moved to add a new Section V(S) as written and waive the full reading thereof and authorize the Village Attorney to draft the necessary ordinance. Seconded! by Trustee Kenny. VOICE VOTE: Motion carried. 3. Te Eorary Residential Real Estate Signs - This proposal was actively supported by local area realtors and the DuPage Association of Realtors. If you approve a trial period, staff will log any complaints and problems and also seek the inpu*- of the homeowners associations. The results will be reported to the Villaga Board at the end of the trial period. Trustee Shumate voiced his concern for corner lot homeowners, as they could have the possibil: -:y of four signs on their property during a weekend when residents perform lacer maintenance. President Bushy noted her concern and proposed the property owner have the right to refuse. Trustee Skinner moved to revise Section VII(B)(2)(d) by adding subparagraph (3) as written and waive the full reading thereof and authorize the Village attorney to draft the necessary ordinance. Seconded by Trustee Kenny. VOICE VOTE: Motion carried. Trustee Skinner am -nded his motion to include Item H to subparagraph (3) of Section VII(B)(2)(d), "no sign can by placed adjacent to private property without the consent of the property owner ". Seconded by Trustee Konny. VOICE VOTE: Motion carried. 4. Handicap Parking Space Design - This amendment was requested r�.o.w.rrsa by the Police Department in order to assist them in their enforcement efforts as required by the State statutes. Trustee Skinner moved to revise Section XI(E) with the addition of subsection 14 as written subject to Village Engineer Durfey's review and waive the full reading thereof and authorize the Village Attorney to draft the necessary ordinance. Seconded by Trustee Kenny. VOCE VOTE: Motion carried. 5. Accesses ructuzes - The current text was intended to limit accessory structures which are only permitted in rear yards from being placed within the buildable area in front of the principal structure. However, the current text appears to limit all accessory structures, even those that are necessarily permitted. The proposed revision will clarify this situation. Lct Area Definition - This revision will make it dear within the Zoning Ordinance that the area of private access rights -of -way (private streets) shall not be included in the Zoning Ordinance minimum lot areas requirements. DISCUSSION REGARDING 'STATER SPRIMING P'ROB IN RIGIT-OF -NAY AND SFRINKT.ING RESTRICTIONS - WATER SXST K OPERATIONS Superintendent of public Works Neranda gage a slide presentation of the Village's water flew distribution system. Village Engineer Durfey then addressed the construction concerns of the Village's paving projects. Superintendent of public Works Heranda noted Janes E. Shuster, Extension Educator - Horticulture with the University of Illinois Cooperative Extension Service in Wheaton,, recommended the best time for watering is from 6:00 a.m. to Noon. Trustee Payovich moved to (1) reduce the number of days for lawn sprinkling from three (3) days to two (2) days per week; (2) revise the times of day that lawn sprinkling can be accomplished; (3) utilize Alternate 2 on an odd /even address system: Odd- numbered street addresses: Thursday and SaturdaY, 6:00 a.m. -Noon 6:00 p.m.- Midnight Even - numbered street addresses: Friday and Sunday, 6:00 a.m. -Noon 6:00 p.m.- Midnight; (3a) Direct staff to investigate alternate days of lawn sprinkling other than those depicted in alternate 2. (4) allow the Village tc prohibit all lawn sprinkling during the times of construction of a Village or village- sponsored project in compliance with notification; (5) review the worst case scenarios concerning a procedure to be VUZ AGE OF OAK BROOK Minutes 7 May 25, 1993 16 SPRIIRMING RESTRICTION.c, i i utilized for offending properties that do not couply with the Village's request to temporarily suspend sprinkling operations and select one which seems most appropriate; (6) direct the Village Attorney to prepare the necessary documents; (7) allow the use of a hand -held sprinkling or watering devices seven (7) days a week, 24 hours z day; (8) Village assistance for those residents interested in getting a well permit; and (9) village issuance of two (2) warnings and then cited a $250.00 fine for lawn sprinkling violations. Seconded by Trustee Skinner. VOICE VOTE: Motion carried with Trustee Shumate voting nay. Village Attorney Martens stated a plaintiff could settle a complaint and avoid going to court by paying a $250.00 fine. Police and staff would monitor the lawn sprinkling ban for better enforcement. Trustee Payovich recommended Superintendent of Public Works Meranda, Village Engineer Our €ey and she meet with the homeowner associations and gated communities for discussion of the water sprinkling proposal and offer paanphlets on lawn sprinkling. The Board recommended a pamphlet and cover letter explaining the restrictions and reasoning be sent to all residents and that well users and residents who draft frce ponds and lakes follow the same lawn sprinkling procedures for times of construction of a Village - owned or Village- sponsored project. President Bushy commended Superintendent of Public Works Meranda for his recommendations to the Village Board. C. ANVAN PHASE IV WATER SERVICE REQUEST: Trustee Skinner s:.ated he would vote no on said proposal since the Board denied other residential areas in this non - certificated area. Trustee Shumate stated he would also vote no, as this water service request would require more work from staff to police proper drafting f -om their pond. Trustee Payovich stated she had voted no on the water service petition ]before the Village Board from the City of Oakbrook Terrace, due to their not having any method of funding the infrastructure. She noted the following: Anvan will fund the looping of the system; will do the actual construction of the project; staff will not be required to VILLAGE OF OAK BROOK Minutes 8 May 25, 1993 ANVAN PHASE I WATER SERVICE AGREEMENT continue flushing the hydrants and Anvan will draft from their pond for landscape sprinkling. Staff will inspect the project and the funds will go into the general Mater Fund for the Capital Improvement and Replacement Fund. Trustee Payovich moved to enter into a Phase IV Mater Service Agreement with Anvan subject to individual meters for each individual residence within the Anvan Phase II Development. HERITAGE OAKS UNIT 2 SUBDIVISION - DEFAULT ON COMPLETION OF WORK TIME EXTENSION: At the meeting of November 10, 1992, a time extension was granted for the completion of all outstanding subdivision items until June 1, 1993. Staff formally notified the developer in writing on November 11, 1992 w d sent a reminder on April 9, 1993. As of this date, the following issues remain uncompleted and outstanding: 1. Paving surface course needed. (completed) 2. Detention basin is currently under construction but not completed. 3. Mater service for Lot 25. (not done) 4. General grading work/restoration entire site. (not completed) 5. Parkway trees to be installed. (wait until fall) 6. Need as -built plans. 7. Deed Engineer Certification. 8. Cleanup. Trustee Skinner moved to grant an one -month extension to the developer for Full compliance of the subdivision with the except.toa of planting the parkway trees by October 1, 1993. Seconded by Trustee Bartecki. Trustee Skinner amended the motion to include the subdivision security be extended one year beyond the planting of the trees. Seconded by Trustee Bartecki. VILLAGE OF OAK BROOK Minutes 14 May 25, 1993 HERITAGE OAKS NIT 2 SUB. E. YORK ROAD BIKE PATH - PRELIMINARY ENGINEERING_ STUDY: YORK ROAD BIKE PATH This project is part of a STP -TCM Federal /IDOT Grant for both engineering design and construction. The cast sharing is 75% federal /25% Village. As such, the Village would be liable for $14,429.50 of this Phase I Engineering cost. Trustee Payovich moved to approve the Preliminary Engineering Services .Agreement for Federal Participation with Civiltech Engineering, Inc., for the York Road Bicycle /Pedestrian Trail Project in the not -to- exceed amount of $57,718.00. OAK BROOK HOTEL CONVENTION AND VISITORS COMITTEEE 1993 SUMMER OBHCVC - ADVERTISING PROGRAM: 1993 SUMMER ADVERTISING Trustee Shumate inquired if an audit has been done of their PROGRAM expenditures and asked who received the audit. The Assistant to Village Manager will investigate this. Trustee Bartecki moved to approve an expenditure in the amount of $50,000 for the Oak Brook Hotel, Convention and Visitors Committee's 1993 Summer Leisure Advertising Campaign. RENTAL OF RIVER HOUSES (904 & 912 Oak Brook Road: RENTAL OF RIVER HOUSES The Village President and Board of Trustees, at their meeting of April 13, 1993, approved adjusting the rental of the River Houses at 904 and 912 Oak Brook Road to $725 and $875 respectively,. Under this new lease arrangement, the Village would be responsible for major repairs and maintenance to the River Houses, and the lessees would be responsible for routine repairs and maintenance. Superintendent of Public Worke Neranda requested the well be abandoned and installation of a water main connection for DuPage Water Commission water service. Trustee Shumate moved to approve the rental fees of the River Houses at 904 and 912 Oak Brook Road to $725 and $875 respectively for a one -year lease with the Village being responsible for major repairs and maintenance to the River Houses. Trustee Shumate withdrew his motion. VILLAGE OF OAK BROOK Minutes 10 May 25, 1993 P-ASeftq3 Trustee McInerney recommended a' $1100 a month rental fee for each house with all improvements and water main connection provided by the Village. Trustee Kenny moved to raise the rental fee to an adjusted level to cover the estimated cost of the necessary repairs and if the tenants decline the rent, terminate the lease and vacate the homes. Seconded by Trustee McInerney. Trustee Kenny amended the motion to include the rental of $1100 a month for a one -year lease. Seconded by Trustee McInerney. RECOMMENDATION - STRAHAN REAR YARD VARIATION { `7 Robin Hood STRAHAN - Ranch : REAR YARI D VAR. (27 Robin This property was developed under County zoning in 1952 and later Hood Ranch) annexed into Oak Brook. The County R -2 zoning which required 12,000 square foot lots wera met at this time, but when annexed into Oak Brook, it was put into a R -2 Zoning District which it did not fit, both for lot size (square feet) but also width and depth. This again will affect the setback and side and rear yards. Prior to this request, we bave seen fit to grant lb other variations to allow the modification of other homes in the subdivision.
