The Regular Meeting of the Board of Trustees was called to order by President
Bushy in the Samuel E. Dean Board Room of the Village Commons at 7:39
p.m. Pledge of Allegiance was given.
The Clerk called the roll with the following persons

President Bushv mentioned her ribbon cutting ceremony today of a new
company in Oak Brook, USN Communications. a telecommunication
company. They have installed their main switch on Commerce Drive and are
ranked thirty -t%vo of the one hundred companies in the United States. They
chose Oak Brook due to our excellent ISO rating, public safety force and the
high standards of building code requirements.
Trustee Bartecki noted the Crain's newspaper article of large tax base
communities such as Oak Brook and Schaumburg sharing their revenue with
other communnities. He commented that $55 million in revenue goes to
Springfield annually- from our shopping center. President Bushy stated they
are targeting the super regional mall communities and explained that the
property tax from the mall goes outside of our school districts in Oak Brook.
Our community was designed to be 50% equalized assessed valuation of
commercial and residential. Other communities have chosen otherwise, while

Department of Labor has released statistics relative to such prevailing
wage rates for DuPage and Cook Counties. The ordinance adopts
these unfunded mandated wage rates. Board members spoke of their
opposition to such unfunded mandates required by the State of
Illinois.

ME SALE OF CEKIAIN PERSONAL PRQPERIY OWNED SALE OF CERTAIN
The ordinance requests surplus status for Library furniture (three (3)
study carrels and one (1) card catalog) and a microwave oven. The
card catalog is no longer used by the Library. since patrons now
access information through a computer. The study carrels are no
longer used due to rearranged activities in the Library, thus leaving
no room for these items. The microwave oven was formerly used in
the Village Hall employee lounge (approximately 15 years) and prior
to that at the Bath and Tennis kitchen. The timer mechanism is
broken, and it heats slowly. Staff determined it would be
uneconomical to have it repaired. but the Village may receive bids on
it for use as parts.

On Friday, June 13, 1997. the Illinois Department of Transportation
(IDOT) opened bids in Springfield for the 22" Street/York. Road
project. Of the twelve (I!-) bidders who received bidding documents,
seven (7) submitted bids. Mazhar Khan from IDOT informed the
Village that the lowest responsible bidder is Ganna Construction
Company in the amount of $4,598,473.57. The highest bid was
$5,954,257.43.
The revised approved Engineer's Estimate was $4,312,946, which
makes the lowest bid 6.62% over the estimate. Mr. Khan stated they
will not receive a bid summary for approximately two weeks, so they
were unable to determine why the bid was over the estimate and in
what particular items of work.
The Joint Agreement between the Village and IDOT (approved by the
Village Board at the Regular meeting of May 14, 1996) assumed the
total cost to be $3,867,000 with the Village's shar° being $321,400.
Mr. Khan is checking whether a new agreement is needed to cover
the extra cost. Assuming a similar ratio, the Village's cost would be
approximately $382,000 (the Village's actual cost is based on certain
bid line items). The project cast increased several times as IDOT
rep iewed the plans and added items with each review. Mr. Khan also
stated that some of the cost increase is due to price escalation within
the industry.

Mr. Khan has requested a letter from the Village concurring with
IDOT's award of contract to Ganna in the bid amount. If the Village
Board concurs. the Village Engineer %N ill send such a letter.

All of the insurance policies relating to the Village's employee
benefit program are scheduled to expire on June 30, 1997. To
summarize the way in w : _ 'i third party administration and the
placement of stop loss and life insurance is accomplished, the Village
utilizes Health Plan Management for third party claims
administration, and plan administration/consulting services are
performed by the Kennedy Consulting Group on retainer. By
utilizing an independent consultant rather than an insurance broker,
the placement of stop loss and life insurance is accomplished on a
net -of- commission basis.
The existing contracts for reinsurance, group life insurance and third
party administration services were awarded based on a competitive
request for proposals process coordinated by Kenny jy Consulting
Group last year. It is not advisable to conduct a formal request for
proposals process each year due to adverse market reaction and cost.
In order to secure contracts for the 1997/98 plan year, the Village's
third party administrator sought quotes from various reinsurance
carriers, and these quotes were reviewed by staff and the plan
consultant.
Because the Village's claims experience during the 1996/97 plan year
has been high compared to the last few years ($707,000, compared to
$506,000 in 1995/96, $382,000 in 1994/95 and $446,000 in 1993/94),
the quotes for reinsurance were not as favorable as last year. In fact,
out of nine reinsurers contacted by Health Plan Management, seven
were unwilling to quote. Kennedy Consulting Group also contacted a
number of reinsurers, and all indicated that they would not be willing
to provide reinsurance based on the claims experience. As a result,
the recommended equivalent premiums to be effective July 1, 1997
represent about a 28% increase over the current equivalent premiums.
Health Insurance
The Village became self - insured for employee health insurance on
July 1, 1993. While the Village is responsible for funding health
claims, there are also fixed costs associated with being self insured,
most of which are now up for renewal. The following are the major
components factored into the calculation of the equivalent premium:

After last year's competitive proposal process, the Village Board
renewed a contract with Health Plan Management for administrative
services for a period of two years. July 1, 1997 represents the
beginning of the second year of that contract, and pursuant to the
agreement, Health Plan Management will not be raising its per
participant per month rate of $8.50, or its annual renewal fee of $900.
Health Plan Management has met the two other stated conditions of
renewal - namely, implementation of direct claim submittal and
annual loading of claim form data for each participant.
Plaa administration represents the cost of plan consulting services
provided by Kennedy Consulting Group, and Health Plan
Management's annual renewal fee listed above. For the 1996/97 plan
year, plan administration fees translated to $10.81 per participant per
month, which included the costs related to the coordination of the
request for proposals process. Because a new RFP process is not
contemplated, the proposed 1997/98 rate for plan administration is
significantly lower at $3.23.
Specific and aggregate stop -loss insurance is used to reduce the risk
associated with being self - insured by capping the amount of claims
for which the Village is responsible, both for an individual (specific),
or for the entire group (aggregate). The Village's current specific
stop -loss "deductible" is set at $25.000. The aggregate "deductible"
is determined by the insurance carrier based on 125% of anticipated
claims. Health Plan Management sought'stop loss quotes on a net -of-
commission basis from nine reinsurers, two of whom were willing to
provide quotes. The two included the Village's current provider, SLI,
a brokerage firm in Indianapolis underwritten by Peoples Security
Life, and AIG. the Village's current group life insurance provider.

Because the Village would be continuing with its current carrier, all

cases which have reached, or potentially could reach, the $25,000
deductible will be covered.

Two other components needed to set equivalent premiums are the
PPO access premium and utilization review fee. utilization review is
necessary to pre- certify hospital stays and treatments, and currently
Health Plan Management subcontracts pre - certification to Medical
Cost Management. Health Plan Management includes its PPO access
premium in its utilization review fee, and currently that fee is $4.50.
Medical Cost Management has indicated that it will increase the fee
to 54.60 effective January 1. 1998 "Therefore. the Village will use the
average of $4.55 for purposes of setting the equivalent premium.
This is a provision in the Village's plan which allows former
employees to elect to convert to an individual policy with the selected
vendor after their rights under COBRA have expired. This provides
the participant with the ability fbr continued coverage. This option is
provided by Ceti: Life Insurance at the rate of $.60 per participant
per month, and is unchanged from the previous plan year.

The recommended equivalent premiums represent an increase of
approximately 28 %. The increase should be interpreted in light of the
fact that the 1996197 premiums were exceptionally low due to the
accumulation of excess reserves resulting from several favorable
claim years, as well as a refund received from IPBC, our prior carrier.
Most of the excess was used in the past year to cover higher than

anticipated claims, and thus excess reserves are no longer available.
Most of the increase is needed to cover a significantly higher
projected claims amount for the 1997198 year. It should be noted,
however, that these rates are still very low in comparison to other
plans.
Dental Insurance
The Village is 100% self- insured for its dental insurance coverage.
with Health Plan Management again providing administrative
services. Per the agreement entered into last year, the current
premium of $1.70 will not change. In order to cover both expected
claims and administration for the upcoming year, staff recommends
monthly premiums of $ 16.32/single and $50.39 /family.
Life Insurance
The Village provides $50,000 of group term life insurance and AD &
lD coverage to all full -time employees. Competitive quotes were
sought in conjunction with last year's request for proposal process,
and based on the quotes, the Village Board renewed the contract with
Lhe current carrier, American International Group (AIG), at the rate of
$0.216 per $1,000 per month. Because AIG has not proposed an
increase, staff again recommends renewing the contract for another
year.
Vision Insurance
The Village utilizes Vision Service Plan (VSP) as its vision insurance
provider. Employee coverage is paid for by the Village, with
dependent coverage being optional and fully paid for by the
employee. Based on current year experience. VSP had originally
proposed an increase in premium of approximately 27 %.
Subsequently. Kennedy Consulting Group sought competitive quotes
from two other providers, one of whom declined due to the size of
our group. Although the Village did receive a quote from another
provider. it was predicated on offering a plan with a lower benefit
than our current plan. Because any change in benefit would need to
be negotiated with our represented employees. the Village would be
unable to implement the change at this stage. Nevertheless, due to
the competitive market, VSP has adjusted their renewal increase to
approximately 12.5 %. Therefore. staff recommends that the Village
renew with VSP for an additional year at the monthly rates of $7.69
for each employee and $15.07 for dependent coverage.

the Village Manager to enter into agreements for specific and
aggregate stop -loss insurance for the Village of Oak Brook Health
and Dental Plan; group term life insurance; and group vision
insurance, all for the period beginning July 1, 1997 and ending June

In 1995, based on direction from the Village Board, staff began
pursuing a number of changes to the Village of Oak Brook Health
and DeWA Plan. The changes included the addition of several new
features and the introduction of employee contributions to premiums.
In order to maintain consistency, it was decided that every effort
should be made to implement any changes simultaneously for both
represented and unrepresented employees.
The Village and Teamsters Local #714 - Law Enforcement Division
re- opened the health insurance issue in the final year of the Village's
initial labor agreement_ The parties went to arbitration on a number
of issues relevant to the new contract, including health insurance.
After that arbitration hearing, the parties met and again reached a new
agreement on health insurance. That agreement will be a part of the
arbitrator's award. Further, the parties agreed that the amendments
could be implemented prior to the issuance of the arbitrator's award.
The following Plan amendments are proposed for implementation as
of September 1. 1997:
1. Add well baby care coverage prior to discharge at 100 %.
2. Add annual mammograms for women over 40; every two years
for women-3 5 to 39; and one prior to age 35. This would be
applicable for an employee and eligible dependent if the
employee has single plus one or family coverage.
3. Provide up to $300 for a routine physical once every two years
(employees only).

4. Increase the maximum lifetime orthodontia from $1,000 to
$2,000 per covered person.
5. Provide a prescription drug card with an employee co -pay of
$10 for brand name and $5 for generic prescriptions,
supplemented by pharmacy by mail with an employee co -pay of
$15 for brand name and $7 for generic prescriptions for a 90-
day supply- of maintenance drugs.
b. Implement a Section 125 flexible savings plan that will enable
employees to tax shelter contributions to premiums, qualified
unreimbursed medical expenses and qualified child
care /dependent care expenses.
7. Increase the annual deductible for employees with single
coverage from $150 to $250. The deductible for single plus one
and family- coverage will remain the same.
8. Employees with single plus one coverage will contribute 5% of
the difference between the single plus one and single premiums.
Employees with family coverage will likewise contribute 5% of
the difference between the family and single premiums. The
Village will continue to pay 1004/0 of the premium for single
coverage. These contributions will apply to both health and
dental premiums_
Implementation of the Section 125 flexible savings plan is
accomplished under a separate plan document that can be adopted by
resolution. Because the drafting of this plan document is in progress,
staff will bring the resolution and Section 125 plan document to the
Board in July. It should be noted that the changes will not be
effective for the Firefighter and Fire Lieutenant bargaining unit unless
and until the insurance issue is settled during the current round of
negotiations. This means that while those employees will not begin
making premium contributions on September 1, they will also not be
eligible for the additional benefits.

the Village of Oak Brook Health and Dental Plan and authorize the
Village Manager to sign a restated Plan Document incorporating all
the amendments stated in Assistant to Village Manager Crotty's

The Health Insurance Portability and Accountability Act (HIPAA),
enacted on August 21, 1996, establishes federal requirements to
improve the availability and portability of health coverage. The
primary intent of the legislation is to limit the application of
preexisting condition exclusions by specifying a maximum duration,
and reducing that duration by the length of an individual's aggregate
period of prior "creditable coverage ". The legislation is effective July
1, 1 997, and imposes the following requirements:
• limitation on the application of any preexisting condition exclusion to
12 months, including the applicable waiting period for enrollment
• prohibition against the application of a preexisting condition
exclusion to pregnancy or certain newly added dependent children
• reduction of any preexisting condition exclusion by the length of an
individual's aggregate period of prior continuous coverage under
another group or individual health pla&--i
• provision of a special emol'zen: period for eligible employees and
their dependents who lose other group health plan coverage, and for
any person becoming a dependent of a covered employee through
marriage, birth or adoption
• certification of coverage for participants who cease to be covered
under the plan
• prohibition against excluding an employee from coverage due to
health status - related factors
Two additional requirements become effective for plan years
beginning after January 1, 1995. The first requires the plan to allow
for a 48 hour hospital stay due to childbirth (% hour stay for cesarean
section). The second wires parity between physical and -rental
health benefits, but final rules have not yet been released on this
issue. Currently, the Village's health plan has a 12 month preexisting
condition period effective after its 90-day waiting period for
enrollment. In order to comply with HIPAA, the Village Code must
be changed in order to reduce the preexisting condition exclusion
period to 12 months inclusive of the waiting period.

Section 5-21(n) of the Code of Ordinances requires certain additional
procedures before a building permit can be issued if a development
utilizes the incremental increases for structure height or FAR
specified in that Code section. One of those procedures includes a
traffic report describing the impact on the neighboring street system
and recommending whatever traffic infrastructure may be required to
accommodate traffic generation specifically and uniquely attributable
to the proposed development.
Such a report has been submitted by Metro Transportation Group,
Inc., that concludes:
I The existing Main Access Drive (this is the driveway on the north
side of this property that provides access to the vacant building
previously occupied by Chicago Bridge & Iron and the building
currently occupied by Praxair) should be widened to allow two
existing lanes and one entering lane.
2. That traffic signals are warranted at the Jorie Boulevard/Main
Access Drive.
Jaynes J. Benes and Associates, Inc. reviewed the technical aspects
and recommended the following:
I . The Main Access Drive should be widened as suggested.
2. A new traffic signal is ` -v-arranted at Jorie Boulevard/Main Access
Drive based on anticipated traffic from the three buildings.
I It appears that it is possible to achieve acceptable traffic
progressions along Jorie Boulevard between the Main Access
Drive and 22`d Street without adverse traffic impacts (they are
about 500 feet apart which is a very close distance for traffic
signals). Traffic signal plans and a detailed traffic progression
scheme would be needed in conjunction with the building permit.
4. This one site does not have any other significant traffic impacts on
the surrounding area.

Trustee Bartecki inquired how the Village mitigates any traffic
congestion caused by the installation of the signal. Village Engineer
Durfey suggested the Village will own and operate the signal. The
timing control will be adjusted appropriately.
Motion by Trustee Bartecki, seconded by Trustee Savino, that in
connection with issuance of a building permit for property located at
820 Jorie Boulevard:
1. The proposed development requires the installation of a widened
main access drive and a traffic signal interconnected and
coordinated with the existing traffic signal at Jorie Boulevardl22 "a
Street in order to accommodate traffic generation specifically and
uniquely attributable to the applicant's proposal and that such
traffic infrastructure must be constructed at the time of building
construction; and
2. That the construction of such traffic infrastructure should be a
condition precedent to issuing a building permit which seeks to
utilize the increase in height provided by the "ORA -I height text
amendment "; and
3. That such traffic infrastructure be in place prior to occupancy of
the proposed 820 Jorie Boulevard building. ROIL CALL VOTE:

The problem for this property was developed by actions of the Illinois
State Toll Highway Authority during the 1950's and the 1993 text
amendment to the Zoning Ordinance which precluded inclusion of
private access rights- of-way in lot area determinations. Another
property- affected by Toll Highway acquisition in the area of Oak
Brook Road and the Tollway was the property now known as the
Celozzi Subdivision for which a lot area variation was granted in
1988. This request is not for a lot area reduction, but rather to allow
inclusion in the lot area the fifteen foot private right -of -way easement
along the east lot line of the property. It does not appear that the
circumstances surrounding this situation are at all common to other

properties and approval of the variation should not be precedent
setting to any great extent.
There was no public testimony in opposition to or in support of this
proposal. The Zoning Board of Appeals, by a vote of b to 0, approved
a motion recommending approval of the requested variation to allow
inclusion of the land area used for private access rights -of -way in the
determination of zoning lot areas for the purpose of the potential
subdivision of the property. This motion was based on findings that
approval of this request is consistent with the standards specified in
the Zoning Ordinance for variations.
Village Attorney Martens explained that of every variation before the
Village, the applicant has to address our standards. If they meet the
standards, presumably they are entitled to relief. David Gooder,
representing the petitioner, explained that the Illinois State Toll
Highway Authority took the Harris property before the incorporation
of the Village of Oak Brook. Director of Community Development
Hawk noted he tried to identify a similar affect and could not find one
in Oak Brook with the same type of variance, as they received no
benefit from the taking. President Bushy requested, due to the
uniqueness of this situation. a motion to grant the kind of relief the
petitioner is requesting.
Motion by Trustee McInerney, seconded by Trustee Caleel, to direct
the Village Attorney to draft the necessary ordinance for review by
the Village Board at the Regular meeting of July 8, 1997. VOICE
VOTE: Motion carried_
Trustee Shumate requested consideration of certain hours for turn-in and out of
the Shops at Oak Brook Place. Village Manager Veitch explained with the
reconstruction of the Midwest Road bridge and being a DuPage County road,
the Village would have to receive approval from the County.
