The Regular Meeting of the Village Board of Trustees was called to order by
President Bushy in the Samuel E. Dean Board Room of the Village Commons
at 7:32 p.m. Pledge of Allegiance was given.

3. ANNOUNCEMENTS AND OPEN FORUM: .ANNOUNCE
Trustee Butler announced that the Bath & Tennis Club pool was closed due to
a pipe rupture. The Club has negotiated a reciprocal agreement with the Oak
Brook Park District Aquatics Center that includes their swim meets. Village
Manager Veitch explained that staff has proposed, for Board approval, a refund
to the members of the Bath & Tennis Club during the loss of swimming at the
pool until the pipe leakage is repaired. For each swim day lost a family
membership would receive a credit of $7.00 per day, an individual adult
membership would receive a credit of $5.00 per day, a senior membership
would receive a credit of $4.00 per day and a junior membership would receive
a credit of $3.00 per day. This would amount to approximately $1,500.00 per
day based upon membership of last week, as two days have already been lost at
this time. Club members will be notified by the end of the week of this
situation and the refund policy if approved.
Trustee Savino agreed with the recommendation and also suggested
consideration of a free barbecue for the inconvenience of the members.

3. Motion by Trustee Butler, seconded by Trustee Savino, that the Village Board
authorize a rebate as recommended to the swim members of the Bath & Tennis
Club and a complimentary barbecue due to the inconvenience of the pool

Motion by Trustee Butler, seconded by Trustee Korin, to approve the minutes
of the June 5, 2001, Special Committee of the Whole Meeting as amended on
page 9, G. 1. last sentence of first paragraph to read "Municipalities and fire
districts including Oak Brook have objected to this standard being mandated."
and the next paragraph to read "Fire Chief Jarvis responded that our
firefighters continue to support three on the engine and two on the truck goal

The Village Attorney has drafted Resolution 2001 -SD- CON -R -781,
"A Resolution Approving Final Plat of Consolidation DuPage
Mayors & Managers Conference Subdivision (Lot 82 of Forest Gate
Subdivision & 1220 Oak Brook Road, Oak Brook, IL 60523) ",
approving the Final Plat of Consolidation, consolidating the existing
1220 Oak Brook Road parcel with Lot 82 of the Forest Gate
Subdivision.
Trustee Savino explained that he had voted against this contract
when it was before the previous Village Board but that the Village
is obligated to fulfill the contract which is binding and legal.
Trustee Butler concurred with Trustee Savino as he was absent
when this contract was approved by the previous Village Board but
it is his general position to try and maintain Village owned property
and assets whether open space or a building that could be used for
an income stream. Trustee Korin agreed with the principal of
honoring the contract but hoped in the future that staff endeavor to
give as much information as possible to the Village Board for them
to make the most informed decision.
President Bushy stated that, so the record is clear, much information
was given to the Village Board before their decision was made
regarding this issue including Village Manager memorandums of
August 4, 2000, October 27, 2000, November 3, 2000 with
attachments and lengthy explanations. Also included were agenda
materials, public hearings of the Zoning Board of Appeals, Plan
Commission and Village Board.

Once the review of a chapter is complete, ZORC forwards that
chapter to the Village Board requesting referral to the Plan
Commission and Zoning Board of Appeals. The Plan Commission
reviews the proposed amendments and makes its recommendation.
The Zoning Board of Appeals conducts the official public hearing
on the amendments and considers the recommendation of the Plan
Commission as well as the input provided by the general public and
Village Staff. The Zoning Board then makes a final
recommendation, which is then forwarded to the Village Board for
consideration. The Village Board has the option to approve the
recommendation, accept a portion of the recommendation, reject the
recommendation in its entirety or send the matter back to the
reviewing bodies for further review.
The amendments recommended for Chapter 3 can be divided into
two categories: those that are more general in nature and which
clarify conflicting and/or vague terminology; and changes
recommended to address specific issues or concerns. Some minor
editing has been done to improve readability. In some instances,
sections of the Chapter have been moved to more appropriate
locations or have been deleted if repetitive. It should be noted that
the recommended language for sections 13- 3 -1 -A -2 and 13 -3 -17
has been modified since this matter was before you in February.
All of the substantive amendments remain as presented at the
Village Board meeting of February 28, 2001:
1. 13- 3- 1 -A -2. Allowances. Originally, language pertaining to
this concept was recommended for inclusion in this chapter.
However, after further legal review, it is the recommendation
that this subject be addressed in Chapter 14, Administration and
Enforcement, where the standards applicable to special use are
found.
2. 13- 3 -1 -B. Reference. Adds a reference to the first zoning
ordinance of the Village.
3. 13- 3 -3 -B. Conformance. Requires that all new lots conform to
the Village Subdivision Regulations — Title 14 of the Village
Code.

4. 13 -3 -5. Front yard setback. Approves a change to front yard
along that portion of York Road, south of 31St Street from 100
feet from the property line to 100 feet from centerline of the
road.
5. 13- 3 -6 -B. Courts. Deletes the reference to courts in regard to
permitted encroachments.
6. 13- 3 -6 -B. Fences. Permits the construction of solid six -foot
high fences in residential districts where residential uses abut
non - residential zoning districts or the corporate limits of the
Village. On April 20, 2001, the Village Manager sent a letter to
the presidents of all homeowner associations that would be
affected by this change. Responses have been received from
Forest Glen and Timber Trails Subdivisions as well as an
individual homeowner in Saddle Brook who support these
changes. Timber Trails also requested a further modification to
permit the taller solid fences in areas, which abut a State of
Illinois right -of -way, which inturn abuts or contains the
corporate limits of the Village.
7. 13- 3 -7 -D. Timeframe. Clarifies the timeframe to three
consecutive days for habitable vehicles located in a residential
district.
8. 13 -3 -8. Reference. Adds a reference to the Village's Public
Works Construction Standards.
9. 13 -3 -8. Height Limitations. Delete smokestacks, silos and
storage hoppers from exceptions to the height limitations.
10. 13 -3 -9. Reference. Deletes the reference to special uses.
11. 13 -3 -9. Microcells. Creates the following definition for
"Microcells — a wireless communication facility consisting of an
antenna that is either a) four (4) feet in height and with an area
of not more than five hundred eighty (580) square inches, or b)
in a tubular antenna no more that four (4) inches in diameter and
no more that six (6) feet in length in the associated equipment
cabinet that is six (6) feet or less in height and no more that
forty -eight (48) square feet in floor area."

12.13 -3 -11. Rooftop Mechanicals. Clarifies the screening
requirements.
13. 13 -3 -14. Driveway Gates. Decreases the minimum parcel size
from two acres to one acre. Additional conditions include:
driveway gates can be within 20 feet from the edge of pavement
on local residential streets and within 30 feet from the edge of
pavement on all other streets including all thoroughfares and
collectors. (Reference the Oak Brook Transportation Plan
Phase II Report dated January 1971).
14.13 -3 -17. Telecommunication Tower. Originally, it was
proposed that telecommunications equipment be permitted on
several Village owned properties including Village Commons,
Fire Station 2 at 22nd and Enterprise, Well House 5 at Windsor
Drive and I -88, and the Water Storage Tank on Tower Drive.
However, after further legal review, it is our recommendation to
delete any reference to this matter from this chapter. In light of
recent court decisions, we suggest that this matter be further
studied by the ZORC and reheard.
Trustee Savino suggested regarding fences that the homeowner
associations be responsible for installing a fence in a whole area
that could eliminate any problems with different types of fence
installations. President Bushy offered that there isn't a legal
homeowner association in some of our neighborhoods,
particularly those which were annexed into Oak Brook "as
built" such as Fullersburg Woods, Timber Trails and Yorkshire
Woods, which could present a problem because those areas
have no covenants which require association participation.
Trustee Savino also recommended the banning of chain link
fences in the Village.
Trustee Craig asked if anything could be done by Mr. Callahan
to beautify the chain link fence around the Forest Gate
subdivision to improve its esthetics. President Bushy indicated
that the fence meets our Village Code and it is the same type of
fence around the Midwest Club.

Village Manager Veitch explained that the number of ivy plants
at the base of the retaining wall on Jorie Boulevard along the
Forest Gate subdivision has increased and the blue spruces has
doubled there also. The arborvitae is to grow through the fence
around the subdivision.
Trustee Korin asked if we could require very specific fences,
including the materials they are made of and require an
applicant to meet those requirements before issuance of a
permit. Trustee Butler agreed with Trustee Korin and suggested
the feasibility of a uniform ordinance regulating fences.
Village Attorney Martens explained that prior Village Boards
have reviewed this difficult issue. The Village ordinance
explains open and solid fences but doesn't distinguish between
wrought iron fences and chain link fences that are typically
open. Staff would need to determine if there are any safety or
hazards posed by particular types of fences. If esthetics is the
issue, then there is difficulty in legislating esthetics as discussed
before.
President Bushy suggested, with the Village Board concurrence,
that 13 -3 -6 -B be held in abeyance for further discussion by the
Village Board and request staff to review this to determine what
legally may be done. Trustee Savino suggested referring this to
the Plan Commission for their recommendation.
Director of Community Development Kallien explained that 13-
3-5 will allow many of the property owners on York Road,
south of 31s` Street, will pick up an additional 50 feet of
buildable area.

DUPAGE AND COOK COUNTIES ILLINOIS
Pursuant to the provisions of the Prevailing Wage Act, the State
requires that each June the Village passes an ordinance ascertaining
the prevailing rate of wages for various trades employed in
performing construction on public works within the Village. The
Illinois Department of Labor has released statistics relative to such
prevailing wage rates for DuPage and Cook Counties. Ordinance
#2001- PW -WPA -EXI -S -996, "An Ordinance Ascertaining the
Prevailing Rate of Wages for Laborers, Workers and Mechanics
Employed in Public Works in the Village of Oak Brook, DuPage
and Cook Counties, Illinois adopts these mandated wage rates.

President Bushy announced that she just returned from a Detroit trip of
the U.S. Conference of Mayors summer meeting. She will report to the
Village Board at their next meeting.
She attended a Department of Justice seminar on weapons of mass
destruction and exercises of emergency management. A major exercise
is planned for August, 2002 with Christ Church of Oak Brook.
She spoke with a Department of Justice representative who oversees
major disaster drills across the country and there is an opportunity for
the Department of Justice to assist the Village in planning this event
and receiving funds for our exercise. Village Manager Veitch and she
will speak with him to determine what is necessary from the Village for
them to assist in our event.

10. UNFINISHED AND NEW BUSINESS (Final Action Not Anticipated):
A. RECOMMENDATION — KOSOWSKI- (909 MERRY LANE)
VARIATION — FRONT YARD SETBACK
The Zoning Board of Appeals, by a vote of 6 to 0, has recommended
approval of the request from Mr. John Kosowski for a variation to the
front yard setback along Merry Lane to permit the planned renovation
of the existing home on the property.
This property is currently improved with a single - family home that is
built at the 40' front yard setback line. The requested variation would
reduce the required 40' setback approximately 2' to accommodate a
new front fagade of the home and an expansion of the floor area of the
second floor by approximately 13 square feet.
In recommending approval of this request, the Zoning Board of
Appeals found that the petitioner has satisfactorily addressed the factors
required for approval of a variation. In particular, it was found that the
property owners' hardship was due to the unique circumstance of the
home being built in error at its current location. Further, the Board
found that the variation would not alter the essential character of the
neighborhood.

10. B. RECOMMENDATION — CHRIST CHURCH OF OAK BROOK REC CHRIST
(501 OAK BROOK ROAD) — AMENDMENT TO SPECIAL USE CHRCH AMND.
(PHASE B) To SPEC use
The Plan Commission, by a vote of 6 to 0, and the Zoning Board of
Appeals, by a vote of 6 to 0, have recommended approval of the Christ
Church of Oak Brook request for an amendment to an existing special
use (Phase B) for the property located at 501 Oak Brook Road. The
applicant is requesting this amendment to accommodate further
expansion of the Church facilities by creating a new parking lot and
right- out -only access onto York Road (as measured from the centerline)
that is part of the recommended amendments to Chapter 3 General
Zoning Provisions of the Zoning Ordinance, on which action by the
Village Board is pending.
In evaluating the new parking lot and access to York Road, it was the
opinion of both the Plan Commission and Zoning Board of Appeals
that the proposed improvements were reasonable, were safe and would
benefit the public and Church members.
The following conditions were attached to the recommendation for
approval of a special use amendment to permit construction of Phase B:
1. The new parking lot and York Road access shall be constructed in
substantial conformance with the site plan dated June 4, 2001.
2. Submittal of a detailed landscape plan for Staff review and
approval, which incorporates berming along the east side of the
parking lot.
3. Address the items contained in Village Engineer Durfey's
memorandums dated May 31, 2001 and April 12, 2001 including
final engineering approval.
4. If safety problems appear to develop, the church will use its best
efforts to resolve them.

In making this recommendation, the Plan Commission and the Zoning
Board of Appeals found that the petitioner satisfactorily addressed the
factors as required by the Zoning Ordinance for approval of an
amendment to a special use.
In particular, it was found that the special as requested would benefit
the public, would be operated so that the public health, safety and
welfare will be protected, and that there will be no substantial injury to
other property in the neighborhood.
President Bushy noted that she and Trustee Craig are members of
Christ Church of Oak Brook but have no authority or policymaking
authority as members.
Raymond Scott, representing Christ Church of Oak Brook, addressed
the Village Board concerning their landscape plan. He stated the
Church is willing to adjust their landscape plan if the Village Board
wishes more of a year round screening of evergreens. He explained the
concerns of resident Mark Fleishman and the Church's solution of how
their members would not enter his driveway when exiting the Church
parking lot. He proposed that the thirty -six parking spaces would be
restricted in the new parking area so the lot flows well. They will have
a monitor in the beginning to educate their members of the new
reserved parking area.
President Bushy suggested that if the Village Board approves this, that
on the northerly exit driveway a sign be considered to use extreme
caution to merge. Mr. Scott commented that signage would be used as
recommended by Metro Transportation.
Trustee Savino asked to consider adding a condition that if traffic
problems arise from the exit or entrance to the south that the Village
Manager or Police Department instructs the Church that additional
personnel need to direct the traffic. Mr. Scott stated the Church would
add personnel if there were a problem.
Community Development Director Kallien stated that if Metro
Transportation has made recommendations that they could be attached
as a condition for certain types of signage. He stated that DuPage
County will approve the final design of the 31St Street and York Road
intersection and they may also require specific signage.

Village Manager Veitch explained that more specific language could be
included if the Village Board requests.
Motion by Trustee Savino, seconded by Trustee Craig, that the Village
Board concur with the recommendations of the Plan Commission and
Zoning Board of Appeals and authorize the Village Attorney to draft
the necessary ordinance for final consideration at the Village Board
Meeting of July 10, 2001 incorporating the conditions as listed 1, 2 and
3 and drafting a more definite 4 and 5 adding signs if appropriate by
Metro Transportation and DuPage County.
Village Attorney Martens asked if the Church was going to indicate any
reserved parking on Sunday for handicapped persons. He stated the
Church could proceed without this as Mr. Scott indicated they have the
required handicap parking spaces presently. They could have permit
parking if requested by the Village. Trustee Savino requested that a
sixth condition be added to the original motion to have staff develop
language that the Village Board could review.
Motion by Trustee Savino, seconded by Trustee Craig, to amend the
motion that the Village Board concur with the recommendations of the
Plan Commission and Zoning Board of Appeals and authorize the
Village Attorney to draft the necessary ordinance for final
consideration at the Village Board Meeting of July 10, 2001
incorporating the conditions as listed 1, 2 and 3 and drafting a more
definite 4, and 5 adding signs if appropriate as recommended by Metro
Transportation and DuPage County and include a 6th condition of
permit parking. VOICE VOTE: Motion carried.
