Minutes - 06/28/1977 - Board of Trusteesr VILLAGE OF OAK BROOK MINUTES OF JUNE 1977 I. CALL MEETING TO ORDER A. Roll call The regular meeting was called to order at 7:30 P.M. by President Howell. All trustees were present. II. READING OF MINUTES Trustee Philip moved - seconded by Trustee Rush... That the reading of the revised minutes of the special meeting of May 31, 1977 be suspended and that they be approved as corrected to add the comments of Trustees, Brown, Cerne and Glaves. Voice vote - all in favor So ordered. Trustee Philip moved - seconded by Trustee Rush... That the reading of the revised minutes of the regular meeting of June 14, 1977 be suspended and that they be approved as submitted. Voice vote - all in favor So ordered. III. ORDINANCES, RESOLUTIONS, VARIATIONS, PLATS, ETC. A. Ordinance S -377 —CANVASSING THE RESULTS OF A SPECIAL ELECTION HELD IN AND FOR THE VILLAGE OF OAK BROOK, DuPAGE AND COOK COUNTIES, ILLINOIS, ON TUESDAY, THE 21st DAY OF JUNE, 1977. An ordinance Declaring the Official Results of the Special Election. The Board conducted a canvass of the returns in connection with the Sports Core Referendum. Whereupon, all things in order, the proposed ordinance was presented and read by title which declared the following votes cast on the proposition, which was submitted to the voters of the Village of Oak Brook at said Special Election: Total Ballots Cast 12945 "YES" Votes 12113 "NO" Votes 820 Blank, Spoiled, and 12 Defective Ballots Precinct No. Yes No 1 13,113 820 Total 1 1,113 820 Trustee Cerne moved - seconded by Trustee Philip... To adopt Ordinance S -377 as presented. Blank, Spoiled, and Defective Ballots 12 12 Trustee Brown commented on the conduct of the election as it related to the method of voting by affidavit as being inadequate in the absence of a voter registration list to check against. Village Clerk Lakosil responded that the procedure is in keeping with previous general elections, with the exception of not having an updated County registration list due to the fact that registrations were not cut off twenty -eight days prior to the election. Attorney Bianucci confirmed that voting by affidavit is in accordance with state statutes. Resolution 226 -JOINT RESOLUTION OF AGREEMENT TO PARTICIPATE IN THE DuPAGE COUNTY CRIMINAL JUSTICE COORDINATING COUNCIL The current organization as a local planning unit is being extended to coordinate services and eliminate duplication of efforts within DuPage County. Saddle Brook Chase (Unit VII) Final Plat Plan Commission recommended approval on June 20, 1977 waiving the requirements for sidewalks and street lights except at the 35th Street entrances. Trustee Reynolds requested the developer to install the bicycle path and Robert Finke of Saddle Brook Development Company opposed this because future lot owners object and hinders the saleability. Trustee Brown moved - seconded by Trustee Cerne... To approve the Final Plat of Saddle Brook Chase and waive the requirement for sidewalks and street lights except at the 35th Street entryway. Plan Commission recommended approval on June 20, 1977 and also recommended that request of the Sames' to receive a building permit'for a new residence while continuing to reside in the existing residence conditioned upon the demolition of the existing home within six months of occupancy of the new home be approved. Trustee Brown moved - seconded by Trustee Reynolds... To approve the Final Plat of Sames Resubdivision incorporating the recommendations of the village engineer for a twenty -five foot sewer and water easement and submitting an affadavit that this parcel contains the entire contiguous undeveloped land in which the applicant has any interest; and that a building permit be conditioned to demolition of the existing building within six months of occupancy of the new residence, with a bond or similar security to be established. Kubiak's 2nd Subdivision - Final Plat ukr On June 20, 1977 the Plan Commission recommended that after reviewing all factors involved, that this Plat to establish a lot of approximately .69 acres and a lot width of 131 feet be denied. Mr. Kubiak submitted a k: letter on June 23, 1977 appealing to the board to consider his request for reasons of hardship and the fact that he receives a separate tax bill on {' this parcel. `I Trustee'Brown moved - seconded by Trustee Reynolds. Water Fund One federally secured certificate of deposit to mature in the Great America Federal Savings and Loan of Oak Brook in the amount of $139,000.00 to mature on October 14, 1977 at the rate of 5.75 %. This investment is drwvm on the Depreciation, Improvement, and Extension Account. To Authorize the Bond Consultant, Paul D. Speer & Associates and Corporate Counsel to prepare the necessary documents for bidding and authorize the bidding of the bonds for either August 23 or September 13, 1977. James Neal, Amendment to Variation - 803 Merry Lane This matter had been tabled at the regular meeting of June 14, 1977. Mr. Neal made a presentation relative to the controversy over the retaining wall located partially in a utility and drainage easement and more than the fifteen feet from the rear of the building as permitted by Ordinance G -166, which he felt allowed him some latitude and was approved by the village engineer on the permit plans. Trustee Cerne stated it is the villages intent that variation ordinances be followed uniformally. Trustee Brown moved - seconded by Trustee Reynolds... To remove from the table the variation request of James Neal. Voice vote - all in favor Trustee Brown moved - seconded by Trustee Reynolds... So ordered. Public Safety - Trustee Glaves Police Chief Ceren received a certificate of completion from the FBI National Academy for an eleven week course.. So ordered. Chief Ehle initiated the mailing of information on smoke detectors and Lt. C. Templin completed a course at the Public Safety and Research Institute. Public Works - Trustee Rush Reported on status of Wells 3, 5, 6 and 7. Well 6 at Meyers Road and Oak Brook Road will be completed about August 1, 1977. York Road Water Main scheduled for completion with water distribution to begin approximately August 1, 1977. Road stripping will begin in mid July. _Traffic - Trustee Reynolds reported on DuPage County Mayors and Managers to be coordinator of funding and phasing of Route 83 Corridor. Report of Activities (continued) Zoning and Planning- Trustee Brown Meeting scheduled for June 30, 1977 on proposed Flood Plain Ordinance with some members of the Plan Comrnission, Zoning Board of Appeals and Board of Trustees. Comprehensive Plan will be reviewed July 28, 1977. VI. NEW BUSINESS A. Request-- Fourth of July Fireworks Display - Ginger Creek Request received from the Ginger Creek Community Association to display fireworks from Island Number One which is in the east end of Ginger Creek. If any expenses occur, this will be billed to the Association. Trustee Glaves moved - seconded by Trustee Rush... To approve the request as presented. Bid Recommendation - Reservoir "A" York Road Eightbids were received on June 15, 1977 for Reservoir "A: and the low bid exceeds the budgeted amount by $59,000.00. The trustees commented on the funds available and the expenditures remaining as of June 15, 1977, and the necessity of this reservoir. Trustee Rush moved - seconded by Trustee Glaves... Benefit Baseball Game - West Suburban School for Retarded Children Request from the Fraternal Order of Police, Oak Brook Lodge 42, for the Fire Department to participate in the 3rd annual baseball game held be- tween the Fraternal Order of Police and the Oak Brook Rotary Club, utilizing a fire truck for children to ride upon and proceeds to be turned over to the West Suburban School for Retarded Children. Two volunteers are needed for Unit 913 from 1 to 4 P.M. on July 16, 1977 at a cost for their salaries of approximately $35.00. Trustee Glaves moved - seconded by Trustee Cerne... To approve request cost of $35.00 for this event. Voice vote - all in favor So ordered. D. Request- Fourth of July Committee Request from the fourth of July Committee for Fire Department participation in this event by spreading foam on the baseball field. The cost is approximately $60.00 to be billed to the Park District. Volunteers crould be utilized to man the miniature fire truck in the parade at a cost of approximately $35.00. Trustee Cerne moved - seconded by Trustee Brown, To approve both participations in the Fourth of July events, and that the cost of $60.00 for foam and the cost of volunteer services of $35.00 be absorbed by the Village of Oak Brook.
