MINUTES OF THE JULY 22, 2003, SPECIAL MEETING
OF THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK APPROVED AS
WRITTEN ON AUGUST 12, 2003.
CALL TO ORDER:
The Special Meeting of the Village Board of Trustees was called to order by
President Quinlan in the Samuel E. Dean Board Room of the Village Commons
at 7:05 p.m.
ROLL CALL:
Village Clerk Linda Gonnella called the roll with the following persons
PRESENT: President Kevin M. Quinlan, Trustees Stelios Aktipis, George T.
Caleel, John W. Craig, Susan Chase Korin and Elaine Miologos.
ABSENT: Trustee Asif Yusuf.
ADJOURN TO CLOSED MEETING:
1) To discuss minutes of meetings lawfully closed under the Open
Meetings Act, whether for the purpose of approval by the body of the
minutes, or for semi - annual review of the minutes as required by the
Open Meetings Act.
2) To consider the appointment, employment, compensation, discipline,
performance, or dismissal of specific employees of the public body.
Motion by Trustee Korin, seconded by Trustee Aktipis, to adjourn to
closed meeting to discuss minutes of meetings lawfully closed under the

CALL TO ORDER:
The Regular Meeting of the Village Board of Trustees was called to order by
President Quinlan in the Samuel E. Dean Board Room of the Butler
Government Center at 7:39 p.m. The Pledge of Allegiance was given.

ANNOUNCEMENTS AND OPEN FORUM:
Lars Okmark, 416 Canterberry Lane, discussed the narrowness of this street and
the difficulty residents experience as a result of the Village Code restriction
prohibiting parking on both sides of their street. He asked if the Village could
change the restriction to allow no parking on one side of the street whenever
they have functions but allow parking on the opposite side of the street. He
stated Village Manager Boehm had offered to send a notice from the Village
explaining the situation. Manager Boehm explained that the Engineering
Department indicated that the street is only 18' to 20' in width. He
recommended staff draft an ordinance for Village Board approval to amend the
Village Code to allow for parking on one side of the street.
Trustee Caleel inquired when the berm would be corrected on Spring Road and
31" Street since the completion of the 31s' Street road widening project.
Manager Boehm explained that some sight line and utility issues need to be
addressed before any work may be performed.
Trustee Caleel also inquired about water charges with the Hinsdale Sanitary
District. The District has given this request to the Hinsdale Sanitary District

ANNOUNCE
3. The District has been asked from a number of municipalities not to charge the
sanitary charge for water sprinkling purposes. The District is investigating the
feasibility of a deduct meter installation for this purpose. A resident would be
charged a $100 permit fee and an annual inspection would occur at the
beginning of the year. A resident would be required to have the meter installed
at their own expense. The Hinsdale Sanitary District's telephone number is
630- 323 -3299 for further information regarding this.
Trustee Craig inquired if the Village would pass the charge of the new meter
system recently installed to our residents. The District indicated that any new
increase in meter reading charge would be passed along to the residents. He
asked staff to review this further. President Quinlan asked Manager Boehm to
have staff investigate how other municipalities are handling this.
Trustee Caleel asked for a report of the cell telephone usage by name, usage
and by department as the former report was unacceptable.
4. APPROVAL OF MINUTES: MINUTES - REG BD

Trustee Aktipis requested that the Minutes of July 8, 2003 be amended under
Agenda Item 3, Announcements and Open Forum, page 3, to read: "Motion by
Trustee Aktipis, seconded by Trustee Caleel, to direct staff to prepare a letter
asking DuPage County to maintain the current R -3 zoning of the 4.59 acre site
located east of Old York Road, just north of the Oak Brook Village limits and
prepare an impact study, which fully analyzes all relevant traffic and land use
impacts."
Motion by Trustee Caleel, seconded by Trustee Aktipis, to approve the Minutes
of the Regular Board of Trustees Meeting of July 8, 2003 as amended and
waive the full reading thereof. VOICE VOTE: Motion carried.

Zoning Board of Appeals Recommendation - Variation - The Zoning
Board of Appeals by a vote of 7 to 0, have recommended approval of the
request from Zamir and Sureya Siddiqi, the owners of the property at 1715
York Road for a variation to Sections 13- 6C- 3 -F(1) and 13- 6C- 3 -F(2) of the
Zoning Ordinance to permit the construction of a new home on the property.
The existing home was destroyed by fire earlier in 2003 and cannot be
repaired because of its nonconforming status.
To address concerns raised by the neighboring property owners, the
applicant has agreed to modify his request to locate the new home an
additional ten feet to the west, thus increasing the rear setback from 15 to 25
feet, and providing sufficient room to keep the existing large trees on the
property. With this modification, the front yard would be reduced to 20.92
feet.
Specific conditions attached to the Zoning Board recommendation include:
The construction of the new home and preservation of the existing trees
on the property shall be in substantial conformance with the revised
plans as submitted.
In making this recommendation, the Zoning Board found that the applicant
had satisfactorily addressed the factors as required by the Zoning Ordinance
(including hardship) for approval of a variation. In particular, it was found
that the existing conditions of the property (i.e., lot size and configuration)
combined with the fact that the existing home was destroyed by fire, results
in the property having little or no value as a residential lot without approval
of the requested variations.
Motion by Trustee Aktipis, seconded by Trustee Caleel, to concur with the
recommendation of the Zoning Board of Appeals and authorize the Village
Attorney to draft the necessary ordinance for consideration at the August 12,
2003 meeting. VOICE VOTE: Motion carried.

Zoning Board of Appeals Recommendation - Variation - The Zoning Board
of Appeals by a vote of 7 to 0, have recommended approval of the request
from the property owner, Peter and Judith Barath for a variation to Section
13- 6C- 3 -F(1) of the Zoning Ordinance to permit the construction of a
second floor addition to their home which encroaches approximately two (2)
feet into the required 40 -foot front yard setback. The existing encroachment
has existed since the home was built 35 years ago.
In making this recommendation, the Zoning Board of Appeals found that
the petitioner has satisfactorily addressed the applicable factors for approval
of the variation. In particular it was found that the original placement of the
home created the hardship for the current property owner. Also, without the
variation, the planned addition would be out of character with the
neighborhood.
Motion by Trustee Aktipis, seconded by Trustee Caleel, to concur with the
recommendation of the Zoning Board of Appeals and authorize the Village
Attorney to draft the necessary ordinance for consideration at the August 12,

Amendments — The Plan Commission at its meeting on March 17, 2003
voted 5 to 0, and the Zoning Board of Appeals at its meeting on July 1,
2003, voted 7 to 0 to recommend approval of the request from the Village of
Oak Brook for text amendments to Section 13 -3 -6B of the Zoning
Ordinance regarding chain -link fences.

The Zoning Board of Appeals concurred with the findings of the Plan
Commission to recommend approval of the proposed text amendments
subject to the following refinements:
1. Clarify the term "sports courts /field" to include courts for tennis,
basketball and hockey, and fields for baseball.
2. Any use of chain -link fencing that is in conflict with these provisions
will require approval of a variation.
3. The proposed amendments would affect the placement of new chain -
link fences. Existing chain -link fences would be grandfathered and
could be maintained but not expanded.
In making this recommendation, the Plan Commission and Zoning Board
found that the petitioner has adequately addressed the applicable factors for
approval of a text amendment to the Zoning Ordinance.
Trustee Yusuf asked that present fences completely enclosing a yard should
be deemed grandfathered before these changes take place. President
Quinlan also recommended that a variation should be granted for changes of
styles of fences.
President Quinlan asked if the variation cost and time of processing the
permit is too difficult for our residents. Trustee Yusuf commented it is
difficult. President Quinlan asked if the ordinance could incorporate
wording that if a chain link fence exists and a leg of a chain link fence is
removed then the property owner should have the right to install a fence.

Motion by Trustee Aktipis, seconded by Trustee Caleel, to concur with the
recommendations of the Plan Commission and Zoning Board of Appeals as
amended and authorize the Village Attorney to draft the necessary
ordinance for final consideration at the August 12, 2003 meeting.
Attorney Martens indicated he would draft language that if a yard was
enclosed with a chain link fence and the property owner was left with no
fence on one side because his neighbor removed it, the property owner
would have a right to replace the fence by constructing a new fence on the
owner's property.
Trustee Aktipis asked to include landscaping on both sides of the fence
except only on the outside of the dog kennel fence.
Motion by Trustee Aktipis, seconded by Trustee Caleel, to amend the
motion to include the above language and concur with the recommendations
of the Plan Commission and Zoning Board of Appeals and authorize the
Village Attorney to draft the necessary ordinance for final consideration at
the August 12, 2003 meeting. VOICE VOTE: Motion carried.
D. FOREST PRESERVE DISTRICT OF DUPAGE COUNTY — 1717 OAK

The Village Board, at its June 24 and July 8, 2003 meetings, continued the
request from the Forest Preserve District of DuPage County for approval of
a special use amendment for the Peabody Mansion (1717 Oak Brook Road)
to the July 22, 2003 meeting.
Plan Commission and Zoning Board of Appeals Recommendations:
Special Use - The Plan Commission, by a vote of 7 to 0 and the Zoning
Board of Appeals, by a vote of 6 to 0, have recommended approval of a
special use amendment to permit an expansion of the special use area from
3.34 to 46.42 acres to accommodate: a new 181 space parking lot; a new
entry drive with separate left -turn lane; a secondary access for emergency
vehicles; a gazebo and formal garden; and a new main stage and ticket
booth for outdoor performances. In addition, the Forest Preserve District is
seeking an amendment to permit the installation of a production kitchen in

the Retreat Wing. All other provisions of the existing special use will
continue. Specific conditions attached to the recommendations of the Plan
Commission and Zoning Board include:
• The development shall be in substantial conformance with the plans as
submitted.
• The new stormwater management plan for the site will be designed so
that it is not detrimental to the existing water features located on the
Mayslake property.
• The new production kitchen will be designed to limit the emission of
cooking odor as well as meet all requirements of the DuPage County
Health Department.
• All lighting to be located within the new parking lot and along the new
entrance drive shall be properly shielded in accordance to Village Code.
• Final engineering approval.
• All other provisions of Ordinances S -1015, S -986 and S -841 are
maintained in full force and effect.
In making these recommendations, both the Plan Commission and Zoning
Board of Appeals found that the petitioner has satisfactorily addressed the
applicable factors for approval of an amendment to a special use.
Trustee Aktipis explained that this process must be reviewed and approved
by the Illinois Historic Preservation Society before the Village Board could
address this request.
Motion by Trustee Aktipis, seconded by Trustee Caleel, to continue this to a
further date in time. VOICE VOTE: Motion carried.

Staff has recommended an increase in fees for a commercial solicitor
and peddler permit from $50.00 to $125.00 and a change in the length of

days to ninety (90) days. Previously, the permit was for thirty (30) days
with a renewal up to six (6) months. Staff has recommended these
changes due to the amount of time involved processing each application
as the commercial solicitation permit could be renewed at no cost. Each
time a renewal permit is issued identification badges have to be printed
and the Police Department processes a background check.
Trustee Caleel voiced his opposition to commercial solicitors within the
Village. Clerk Gonnella explained that any resident who does not wish
to have solicitors may request a "No Solicitors" sign from the Village
and that our ordinance reads that if a solicitor does not heed the sign,
they are in violation of Village Code.
Motion by Trustee Aktipis, seconded by Trustee Craig, to approve
Ordinance 2003- LC -SOL -G -723, "An Ordinance Amending Title 4
( "Solicitors and Peddlers ") of the Village Code of the Village of Oak

Effective January 1, 1982 ILSC 120/2.306 required that all public bodies

reviewed by Attorney Martens and items still pending and requiring
continued confidentiality have been redacted.

The DuPage County Board recently approved certain revisions to the
DuPage County Countywide Stormwater Flood Plain Ordinance. As a
full - waiver community, Oak Brook enforces the minimum County
standards and Title 9 of the Village Code mirrors the County Ordinance
except in those areas where the Village is more restrictive. Therefore, it
is appropriate to incorporate the recent DuPage County revisions into
the Village's Code.
The revisions are part clarification of existing Ordinance standards and
part relaxation of certain stormwater detention standards as they apply to
the installation of recreational trails, recreational playing fields,
construction of flood control facilities and wetland banks, water quality
best management practices and the reconstruction of existing parking
lots.
Motion by Trustee Miologos, seconded by Trustee Aktipis, to approve
Ordinance 2003 - SWM -RR -G -726, "An Ordinance Amending Section 9-
5-1 ( "General Information ") of Title 9 ( "Storm Water, Floodplain and
Sedimentation and Erosion Control Regulations ") of the Village Code of
the Village of Oak Brook." ROLL CALL VOTE:

President Quinlan announced that Village Attorney Martens will pursue other
opportunities at the end of this year and he commended him for his many years
of service at the Village of Oak Brook. Attorney Martens thanked the residents
and Board for having the privilege of serving this community for fifteen years.
Trustee Aktipis also commended Attorney Martens and wished him well in his
future endeavors.

The Quarterly Reports were accepted as presented.
Trustee Korin asked that since the widening of Midwest Road the
landscaping on the east side of the roadway along the Brook Forest
subdivision has not been replaced. She asked that this be reviewed by staff
with a follow -up to DuPage County to see when this work would be done.
Trustee Craig asked that a thank you be sent from the Village to Ty Warner
for the excellent fireworks display July 3rd. President Quinlan stated that
the Village had already sent a thank you.
