Police Chief Flemiug noted the increase in seizure of weapons .
President Rushy voiced a concern for our officers and the use of bullet
proof vests. Chief Fleming will bring this to the attention of our police
officers of the increase of DUMEG arrests and the confiscation of
weapons.

Trustee Payovich stated. the Village Manager has placed. the policy of
water service to area.3 outside the Village of Oak Brook on the next
Board meeting agenda, and information will be given to the Trustees
prior to the meeting.
Motion by Trustee Payovich, seconded by Trustee Bartecki, to
approve the Water Service Agreement between Recreational Equipment,
Inc. and the Village of Oak Brook. ROLL CALL VOTE:

B. AWARD OF CONTRACT - 1994 DRAINAGE PROJECT:
Village Enginee- Durfey explained the ponding of water that occurs at
the Illinois Rou .e 83 Underpass Bicycle Trail is due to a berm
constructed that blocks proper drainage. Engineer Durfey stated the
berm was installed by someone without the approval of the Village .
The present manager, LaSalle Partners, of the Crossings at Oak
Brook, has requested the Village abandon their present design
concept and return to the previous concept to correct the drainage
problem.
Angie M. Rendina, LaSalle Partners, suggested the Village bury the
piping underground so as to avoid any ley overflow of water onto the
parking lot during the printer.
Village Engineer Durfey stated staff recommends mends the developer pay for
the $6, 000 cost to bury the drahuW pipes. Village Manager ,Veitch
recommended the Village and property owners divide the cost of
burying the piping, and the property owner grant the easement at no
cost to the 1111age.
Village Engineer Durfey recommended awarding the contract this
evening, and staff will resolve the reimbursement of the cost of the
project with said property owner before the dccumaentation is
completed.
Motion by Trustee Payovich, seconded by Trustee Skinner, to accept
the bid of and award a contract to Swallow Construction Company,
Inc. , in the amount of $65, 521.00 for the 1994 Drainage Project
(Project No. 94 -1302, IL Route 83 Underpass Bicycle 'frail, Bike Trail
at 2221/2215 Oak Brook Road, Bare Trail Opposite 2505 35th Street,
Bike Trail Opposite 2405 35th Street, Bike Trail at Loot 102 ( 376 Trinity
Lane), Lot 18 (18 Palisades) , Washington St. /Wood Road Intersection) .
ROLL CALL VOTE:
Ayes: a - Trustees Barteeki, McInerney, Payovich, Shumate and
Skinner.
Nays: 0 - None.
Absent: 1 - Trustee Kenny. Motion carried.
Trustee Skinner moved to recess the meeting, seconded by Trustee Payovich, at
8:37 p.m. for an official photograph of the Village Board of Trustees. VOICE
VOTE: Motion carried.
President Bushy noted Maggie Pourers, former Village Manager, was in attendance
for the official photograph of the Board as prior Manager.

Brook, as a member of the Oak Brook Motel, Convention and Visitors
Committee to fill the unexpired term of Joseph Kruvi, with his term
expiring February 29, 1995. VOICE VOTE: Motion carried.
Motion by Trustee Skinner, seconded by Trustee Bartec:ki, to appoint
Thomas Stanfa to fill the expired term of Johan Meyers, term expiring
June, 1997. VOICE VOTE: Motion dried.

Trustee Shumate stated the Park District is open to anyone, and the
facility is available to them. Trustee Shumate requested the time frame
be limited in the requested variance to a particular time for I4ttle
IAmgue and soccer use only.
Village Attorney Martens stated any possible restriction of the
variation has to be in accordance with the standards of the ordinance
and not included for convenience. These stances include that the
property cannot yield a reasonable return, that the situation arises
due to the unique circumstances and that the essexydal character of the
locality wdil not be altered by the variation.
President. Bushy stated her concern for the safety of children at 10:00
p.m., as some may bicycle to the baseball fields.

Trustee Skinner remm* ded the Trustees that the Park District could
put in lights, but they are requesting a height variation from 45 feet
to 65 feet.
Motion by Trustee Saner, va=nded by Trustee McInerney, to direct
the Village Attorney to draft the necessary ordinance for an accessary
structure height variation to allow 64 foot tall lighting poles for the
Illumination of baseball fields 2 and 3 on the -Oak Brook Park District
property subject to the following conditions:
1. The lights are to be turned of at 10:00 p.m.
2. usage of the lights is hmiited to the period from April 1 to October
31 of each year. In the event that usW in October causes
verifiable detrimental impacts on neighbors. the usage period will
be from April 1 to September 30 in subsequent years.
VOICE VOTE: Motion carried.

Village Engineer Durfey stated this was at the request of cDonald's .
He wished to thank l cDo 's for this grant of easement at their
expense.
Motion by Trustee Pagoeich, seconded by Trustee Bartecki, to accept
the Easement Grant from dIs Corporation for a Public Bicycle
and Pedestrian. Path along Spring Road just south of Commence Drive .

E. ILLINOIS MUNICIIPAL LEAGUE - MEMBERSHIP RENEWAL:

Motion by Trustee Bartecki, seconded by Trustee Kenny, to approve
renewal of the Village's membersbip in the Illinois Munich Lague
and authorize payment of the membership, dues for the year ending
July 31, 1995 in the amount of $577.50. ROIL CALL VOTE:

Shumate and Skinner.

Trustee Skinner noted his concern in spiking with Village Engineer
Durfey of a possibility of a drams problem. If a problem with
drainage occurs, then the current petitioner be required to correct
the problem at his expense.

Trustee Bartecki stated he was not interested in setting a precedent.
if the ordinance states that maximUn height from actual grade level is
thirty ( 30') feet, then it should be 30 feet.
The petitioner, Michael l eissner, chwffled to the board he is not
requesting any relief of building height, as it is proposed to be 29'10" ,
but there is an existing water concern on the site. He is requesting a
natural ground level designation of 674.01 as opposed to the existing
668.51. Village Engineer Durfey slates that a top -of- foundation
elevation at 671.0' would provide better drainage characteristics .
Anthony McNamara, project civil engineer, stated the rise of grade
level would permit better slopes for stormwater management. Village
Engineer Durfey stated the petitioner is also buiildinr an aesthetic lake

Trustee Skinner moved to amend the notion to require, in addition,
that if any problem with drainage occurs as a result of this change,
the current petitioner be required to correct the grading at his
expense. The amendment was acceptable to the motioner. ROLL CALL

Nays: 6 - Trustees Bartecki, Kenny, McInerney, Payovich,
Shumate and Skinner.
Absent: 0 - None. Motion failed.
OTHER BUSINESS PERTAINING TO VILLAGE OPERATIONS:
President Bushy announced the resignation of Trustee Skinner and
commended his outstanding dedication to the Village as a Trustee. She
stated he exceeded the duties as a Trustee, and he will be greatly missed.
His name will be hold in esteem for many years to come as to what it means
to be a Trustee of the Village of Oak Brook and his dedicated service to the
Village. The August 9, 1994 Board meeting will be his last meeting.
