Dean Board Room of the Village Commons at 7:33 p.m. Pleage of Allegiance was given. President Bushy gave an update of the Midwest Road widening project. The Village Board had unanimously passed a resolution, at their last Board meeting, to request DuPage County Board Chairman Franzen to include the pathway and turn bays for this project and to notify our residents, via the Village newsletter, of the deletion of these two segments of this project and request their response with an enclosed post card. Chairman Franzen had requested the Village show support for including the pathway and turn bays for this project. To date, 132 responses have been received with six in favor of deletion of these two segments. Four of those are property owner; affected by the project in Brook Forest, one resident is from Fullersburg and one from Brook Forest. IHE SALE BY PUBLIC AUCTIM QE PERS AL ERQPERIY SALE OF PERSONAL OWNED BY 1HE VILLAGE QE QAK BROOK: PROPERTY BY PUBLIC AUCTION The Village Board, at its meeting of July 23, 1996, passed an ordinance declaring twelve former squads and administrative vehicles surplus, allowing their sale by auction by the DuPage Mayors and Managers Conference. This ordinance does the same for one additional vehicle, a 1984 Chevy Van, which was originally used by the Building Maintenance Division of the Public Works Department. The auction is scheduled for Saturday, September 7, 1996 at the College of DuPage, with bidding beginning at 10:00 a.m. In order for the Village to participate, the Village Board needs to approve this ordinance which declares the listed vehicle as surplus and authorizes the Mayors and Managers Conference to sell such vehicle at public auction. ORDINANCE 96 -LY -EX 1 -.5 -856 AN ORDINANCE ADOPTING ORD . 96- LY -EXI- A REVISION OF THE GENERAL POLICY FOR THE OAK S -856 BROOK FREE PUBLIC LIBR.A.RY: GENERAL POLICY FOR OAK BROOK The General Policy for the Oak Brook Library was adopted in August, FREE PUBLIC 1994. The policy provides for biennial review and, if necessary, LIBRARY revision. Any revisions must be adopted by the Board of Trustees. At its July meeting, the Library Commission concurred with the proposed changes. Also, Village Manager Veitch and Village Attorney Martens have reviewed the policy. Effective August 1, 1996, Serving Our Public became the benchmarking tool for Illinois public libraries. It replaces Avenues to Excellence H. The preface and introduction to Serving Our Public were circulated with the redlined copy for the Village Board's convenience. The entire booklet is available at the Library. The revisions reflect staff efforts to identify inconsistencies or inequities in provision of service and to correct them. IL AI THE QENERAL ELECTION QN N, ! ; NOV. 5, 1996 5,1996: • It is necessary that the Board approve the ballot question for the Library Referendum during August in order that it be filed with the election authorities before the September 3 deadline. For the question to appear on the ballot at the November 5, 1996 General Election, the Village Board must approve an ordinance by September 3, 1996 which initiates this advisory referendum question. The Village Board must decide which of the two ballot questions should be asked in the referendum. One question of public policy concerning construction of a new library includes the cost and architectural fees totalling approximately $3,500,000, while the other public question does not include the cost of the project. Trustee Savino agrees that the cost should be included in the public question but disagrees with the location of the facility. He does not feel he could support this motion as other sites are available, nor that the Village has done their due diligence on a location. He has not seen a formal letter from the Oak Brook Park District stating their position of locating a library on their property. President Bushy acknowledged she had spoken with Oak Brook Park District President O'Brien the evening of their Board meeting, and he indicated they would be discussing this issue at their meeting and a letter would be sent to the Village stating their position of whether a feasible location for the Village Library on Park District property is viable. Trustee Savino stated he had spoken Mth a Park District Board member who had indicated they would be amicable in discussing a site on their properly. Trustee Shumate stated that he had spoken with Park District President O'Brien who also indicated this. Trustee Shumate stated this is an opportune time to create a community center in Oak Brook. An intergovernmental agreement would be required for the Village to build on their property. If it would cost more to build at their site, maybe the residents would pay a fee for their library. Trustee McInerney indicated his conversations with Park District President O'Brien have been totally different. Other Commissioners had indicated they would expect to be reimbursed monetarily for the use of any site on their property for a library. He asked if two alternative sites could be placed on the referendum pending a resolution by the Park District. President Bushy read Park District Director Cripe's letter, dated May 30, 1996, stating a proposed library north of their family recreation center would cause elimination of 55 trees, would require a special water detention area and he noted a general concern of loss of open space within Central Park. They would like to be a partner in bringing a new libray to Oak Brook, but it appears that dedicating a space in Central Park as a use would be a remote possibility. President Bushy indicated more people use the Sports Core property on a year -to -year basis than the Park District property. The Sports Core property belongs to the residents, and it would not require a fee for this site. Trustee Shumate responded that he wants to see the library built but is concerned that it would not pass, as many residents want to use the Sports Core property for an extra nine holes of golf. President Bushy indicated the Village has been working on this project for months, and it would not be possible to change this two weeks before the final date of submission of the question to DuPage County. Trustee Bartecki concurred with President Bushy on this issue but asked if the wording could be changed. Village Attorney Martens commented that if the Sports Core is the location proposed for the new library, the location should be stated in the pill � 1lic question referendum. Trustee Savino stated he had discussed this at the last Village Board meeting and indicated no official decision has been received from the Park Board, only the Park District Director. President Bushy indicated she had sent a letter to Park District Board President 0* Brien requesting a formal decision on this issue, and Village Manager Veitch indicated that he had also requested Director Cripe to have their Board respond. Trustee Savino again indicated an official response should be received on this issue. Trustee McInerney noted that Trustee Shumate had previously requested an auditorium be built as part of this facility, and he explained that the Park District site could not be expanded to include this. President Bushy explained that a one -story library would be expandable, but that a two -story facility could not be altered on any site. Library Director Martin stated that we cannot envision what a library may be like 30 to 50 years from now, but that books will always be a part of a library with electronic media and required space -ould be needed. Joe Fullan, library associate, commented that he attended the Park District Board meeting last evening and stated that there isn't anything in the Park District Board's response that will satisfy the questions or concerns of Trustees Savino and Shumate. Trustee Bartecki requested de loping a central core area on the Park District property o. ' z Sp. its Care property. The Village needs to receive a decisive rc ponse from # _e Park District on this issue. He requested a special meeting within the next two weeks with the Park District Board to discuss this issue. President Bushy acknowledged the Village has been working on this project for more than a year, and it was to be placed on the November referendum as new trustees will be elected at the April election. Phil Mayer, 177 Briarwood Loop, as a former Village Trustee, stated to the Village Board that this is an advisory referendum and the final responsibility is the Village Board. Whatever the wording of the public question cannot define a statement to the voters that abdicates the responsibility of the Village Board building a library. The residents do not care on the site location only whether to build a library. William Lindeman, 11 Pembroke Lane, stated he agreed with Trustees Savino, Shumate and Bartecki and requested a definitive answer from the Oak Brook Park Board and the concept of a two -story building. He noted Sasaki Associates, Inc., Senior Associate, Tony Mallows' presentation to the Village Board at the Committee -of -the -Whole meeting of March 13, 1995 of a library and town center. He had referred to a location in Fairfax County, Virginia that had a library next to a fitness center. They complemented each other in a year- round facility. He recommended working with the Park District on a site. Trustee Shumate voiced his concern if the advisory referendum passes to build on the Sports Core property, can the Village Board be shed? His concern is how the Sports Core property can be used. Village Attorney Martens indicated while this isn't a binding referendum on how to use the Sports Core p: operty, the best direction is to submit the question to the voters. Motion by Trustee Payovich, seconded by Trustee Bartecki, to table this item to the next Regular meeting. VOICE VOTE: Motion carried with Trustee McInerney voting nay. . V N • FAU'UtOMWILGIMP21611 :_ft: The proposed 1996 Ethnic Fest budget was unanimously approved by the Ethnic Fest Committee at their scheduled meeting of June ;3), 1996. Letters of financial commitment from the Butler PTA and Oak Brook Park District are reflected in the budget. Resolution 95 -BD- EFC -R -656, "A Resolution Establishing An Ad Hoc Committee For The Purpose Of Planning And Coordinating The 1996 Oak Brook International Ethnic Fe.st ", provides that the Ethnic Fest Committee shall prepare a comprehensive budget for the Ethnic Fest and that the budget shall be subject to the approval of each sponsoring government unit. The Oak Brook Park District has approved the budget. Butler PTA, however, has provided its commitment. President Bushy explained that the Ethnic Fest is a joint effort between the Oak Brook Park District, Butler PTA and School District 53. The Village has not received any monies from the School District, and the budget has been adjusted for this. The question is should the continuing publicity, be changed to Butler PTA, Oak Brook Park District and the Village? She recognized Butler PTA and the Oak Brook Park District for their efforts in this project. The budget needs to be approved for the Ethnic Fest and how the publicity should be displayed. President BiWay stated the budget was based on attendance of 4,000 -5,000 people showing a total income of $22,100, a net income of $24,150, with total expenses of $46,250. The net loss of $24,150 is to be covered by sponsor contributions. Trustee McInerney inquired if the School District representative should be a co- chairman of the event and its budgetary guidelines. President Bushy agreed that another co- chairman should be appointed. Bath and Tennis Club Manager Sartore stated that a School District Board member had explained their contribution would be coming from the Butler PTA. Motion by Trustee McInerney, seconded by Trustee Savino, to approve the budget for the 1996 Ethnic Fest - :.heduled for Saturday, September 28, 1996. Final approval of the 1997 Program Objectives occurs in conjunction with adoption of the Budget in December. A copy of the 1997 Village ]Board Objectives is attached to the official minutes. Motion by Trustee McInerney, seconded by Trustee Bartecki, to preliminarily approve the 1997 Village Board Objectives as submitted subject to further revision and final approval as part of the 1997 Municipal Budget. VOICE VOTE: Motion carried. The actuarial reports for both the Police and Firefighters' Pension Funds as of January 1, 1996 that were prepared by Tepfer Consulting Group indicate both funds remain in an extremely strong financial position, with the Police Pension Fund being 106.31 % funded, and the Firefighters' Pension Fund being 120.99% funded. This compares favorably with 103.95% and 119.82% respectively from the 1995 valuation. The original actuarial report recommended a Village contribution of 16.11% for the Police Pension Fund and 17.88% for the Firefighters' Pension Fund for 1996, as compared to 16.17% and 17.92% respectively for 1995. Since both funds have been overfunded for several years now, Village staff asked the actuary to revisit his original recommendation whereby the Village would receive some offset due to the overfunded position. Tepfer Consulting Group has revised the recommended contribution. With this alternative, the Village will be receiving an offset equal to one year of interest earnings on the increment of overfunding. This revised contribution, expressed as a percentage of payroll, amounts to 12.77% for Police and 6.52% for Fire for 1996. With this alternative method the Village's contribution could fluctuate much more year -to- year than in the past, but, in any event, the Village will not be continuing to over{iwd an overfunded plan. The Village is striving to achieve 100% funding, not 120% funding. Finance Officer Langlois has reviewed this methodology with the Department of Insurance. and both Pension Boards have approved the revised contributions. Trustee Bartecki explained that an adjustment will be made each year to ensure that The Funds are 100% funded. Work has commenced on White Oak Lane, Royal Vale Drive and Baybrook Lane for the Drainage Project. Other locations will follow shortly and restoration will take place in September. President Bushy acknowledged residents complimenting on the York Woods Subdivision project Fin c(Purchasi.g, d. InfQlmation.Services: Trustee Bartecki - Progress is being made on the update of the 1997 -2001 edition of the Five -Year Financial Plan. Negotiations for major portions of the Base Level Implementation are continuing with vendors, and Group 1 and Village staff are beginning work with Minolta to design an imaging system. In the Purchasing Department, projects are being finalized or in the bid process to include Golf Course chemic -:i room, Golf Course HVAC and insulation, paramedic service, Public Works vehicle, office supplies and Administration copier. Plying .& Zoning: Trustee Shumate - The alternative zoning path to enable the development of the Montalbano Condominiums has been withdrawn which leaves the Village with the original request as reviewed by the Plan Commission in 1994 for Rezoning, Text Amendment, Special Use and Flood Plain Special Use with Variation. The Zoning Board of Appeals is scheduled to hold the public hearing on September 3, 1996. The following two recommendations will be on the Village Board's August 27, 1990' agenda: The Butler National Golf Club proposal to resolve their split zoning and nonconforming use situation recommended for approval by both the Plan Commission and Zoning Board of Appeals with no opposition to these requests. The Village of Oak Brook petition for Text Amendments to delete the Amortization Provisions of the Zoning Ordinance and to make several other needed housekeeping revisions which received recommendations of approval from both bodies. The issue of the parking restrictions on Wennes Court was raised at both hearings. The Police Department was monitoring evening parking on Wennes Court. and to date they have not observed any problems. However, the York Road bridge project may be having an adverse effect on the business volumes at the York Tavern. The Village will continue to monitor the situation into the summer of 1997 to give a fairer appraisal of the Wennes Court parking situation. Due to time scheduling problems of the participants of the Institute in Basic Life Principles appeals, both Appeal Public Hearings will be continued to the November 5. 1996 Zoning. Board of Appeals meeting. The Plan Commission will be reviewing the Sanctuary Su'odivision Final Plat at a meeting scheduled for August 14, 1996. This is for a 22 -lot detached single - family residence subdivision of the Illinois State Toll Highway Authority south oasis property west of Meyers Road. Only the access road is in the Village of Oak Brook and not the remainder of the property. Public Works & Cable Television: Trustee Savino - 80% of the Public Works annual (in- house) pavement striping is completed. Brush trimming along the safety pedestrian/bike path system is completed. Crews will begin grading and placing asphalt along the safety pathway system the week of August 12th. Placement of asphalt will be on the east side of Yoi': Road from 31 st Street to Windsor and on 31 st Street from York Road to Hunt Club. These areas are presently stone. Once the safety pathways are completed, crews will begin pavement patching along Spring Road. They will be starting with meters that are at least 10 years ola, and, subsequently, less accurate than meters that are newer. This is a long -term change -out program anticipating changing out approximately 500 meters annually. Due to the volume of mosquito complaints, mosquito light trap counts and recent rains, the Village authorized another Village-wide adulticiding spray which occurred on August 7th and 8th. Staff anticipates mosquito abatement may be over budget this year. The Village of Oak Brook received a thank you from the City Manager of Naperville for use of the Village's equipment to assist in their cleanup of the devastating floods in their community. Villa e�, Clerk: Clerk Gonnella - Attended a tour of the Elmhurst Quarry operation with staff members. This was an excellent opportunity to see the completion and operation of this important stormwater management project. Swearing -in ceremonies for all the newly appointed members of Village Boards and Commissions have been completed. Attended a tour of the new Marshall Field's Home Store and was delighted to view the services they offer to the public. Met with Group 1 and Minolta representatives who will be interviewing all departments within the next two weeks to view their information flow process for developing the Village's records management procedures. Village President: President Bushy - Also toured the new Marshall Field's Home Store and noted the importance of this sales tax based facility in Oak Brook. Will be attending the National League of Cities convention in Seattle, Washington next week. Began work as Vice President of the DuPage Mayors and Managers Conference to coordinate meaningful programs for its members. Westmont Mayor Addington, President of the DuPage Mayors and Managers Conference, and she are coordinating areas of concern of the Mayors and Managers municipalities, especially in Springfield. Attended the swim team awards ceremony and dinner and was pleased with the high record of participants. The Independence Day Celebration was once again a huge success. An estimated 4,800 cars were parked. and approximately 20,000 people ca-me to view the fireworks display. The Golf Course has improved and is getting closer to last year's figures. For the Month of July, there has been an increase in greens fees and a decrease in cart fees. Driving range fees are up $4,358, lounge sales up $1,406 and pro shop sales down $471. I EINISLIED AND NEW BUSINESS (Final Action N!2t Anticipated): No Business k , W-K Due to the recent retirement of two Fire Department officers and subsequent promotions, two vacancies have been created at the Firefighter/Paramedic entry level. This presents the Village with options in terms of how to proceed to fill these vacancies. Essentially, the vacancies can be filled either by hiring from the list of eligible candidates as certified by the Board of Fire and Police Commissioner, or by exercising the Village's option under its contract with Paramedic Services of Illinois. Inc. (PSI), suppliers of contractual personnel to the Village since 1989, to increase the number of contract personnel, from the current level of three, to a total of five. Either option is readily available. The Board approved a three -year extension of the contract with PSI on July 9, 1936. A new eligibility list was es €ablished by the Board of Fire and Police Commissioners as of .tune 14, 1996. These options are the same ones that have been considered and discussed by the Board from time to time over a period of several years. In teens of costs, contractual personnel are somewhat more costly in the near term but con,iderably less so over the long term. Additionally, the PSI contract guarantees that the specified personnel will be present for all scheduled shifts, i.e., the problems normally associated with covering absences are not an issue. On the other hand, the newness of the Village's eligibility list maximizes the probability that the Village would be able to hire the top people from the list. Motion by Trustee Kenny, seconded by Trustee McInerney, to fill the two vacancies of firefighter/paramedics in the Oak Brook Fire Department by selecting from the June 14. 1996 eligibility list established by the Board of Fire and Police Commissioners. Mark Fleishman, 3109 York Road, a forty -one year resident of Oak Brook and a 17 -year member of the Fire Department, spoke to the Village Board of his concerns. He noted our Village personnel receive the highest test scores and seek higher education. They provide the Village with our special teams that include the water rescue, technical rescue team and hazardous material response team. Contract personnel do not contribute to these teams nor the leadership to the Fire Department, nor can they be called back to duty for a large scale emergency. He recommended the Village Board not pass this motion, as it is not in the best interest of the Village of Oak Brook. Fire Chief Nielsen responded that the Village Board had a meeting on this issue the previous night and personally supports the hiring of our own personnel for the Fire Department. President Bushy requested the minutes specifically indicate that, even though she may not vote, she does not concur with the hiring of contract personnel but would hire from the eligibility list established by the Fire and Police Commissioners. The Commissioners have done an excellent job, and it is in the best interest for the Village to hire from this list. She feels this is a grave long -term mistake to take this view. NOV. 5, 1996 (Library) Trustee Bartecki asked if a level of interest could be received from the Oak Brook Park District Board for a one or two -story library facility, with no time constraints or meetings. Trustee Shumate requested a letter of agreement be entered with the Oak Brook Part: District Board to allow the building of a Village Library on a certain footprint of their land. Trustee McInerney stated the Village Board still has to decide what to do. His concern is meeting with two Boards within the next two weeks. Even if the referendum is defeated, the Village Board still must address the improvement of the Village Library. Trustee Savino asked if a two -story building could be tiered on a side of hill in Central Park. Village Manager Veitch indicated that in January he notified the Village Board of the architects strenuously recommending against that building configuration. The feasibility of a Park District site became diminished at that point. Trustee Shumate asked if the Village Board could pass an ordinance with a question of public policy indicating if the voters wish a library and what location. President Bushy indicated it would be difficult for the voters to decide this issue when the Village Board, after a one- year review, could not address this issue. The architects are to design a concept for the voters to view. Village Attorney Martens stated a public policy question cannot be drafted in the alternative. Each question should be separate with a maximum of three questions. Each question must be a yes or no answer. Shall the Village of Oak Brook have a Library? Shall the Library be sited on the Village of Oak Brook Sports Core properly? Shall the Library be sited on the Oak Brook Park District property? Roberta Petz, Library Commission President, stated the Library should be located on Sports Core property. Their members have not heard of residents against this concept. Trustee Shumate noted that all three of these public questions could pass. This is just an advisory referendum, and the Village Board would have the final decision.
