He recommended that a narrower window of time be given to a contractor. Village Manager Veitch stated that the contractor will clean the debris from the roadway or the Village will correct the situation. Staff will review this further. Motion by Trustee McInerney, seconded by Trustee Caleel, to authorize payout #3, for $276,751.24, to Callaghan Paving, Inc., for the 1999 Paving & Water Main Project. AUTUMN appointments to the 1999 Oak Brook Autumn Festival Committee FESTIVAL President Bushy commended Trustee Butler and his committee for their efforts in the 1999 Oak Brook Autumn Festival. VILLAGE OF OAK BROOK Minutes /-6 Page 3 of 13 September 14, 1999 Motion by Trustee McInerney, seconded by Trustee Caleel to approve the appointment of Janis Lundquist to the 1999 Oak Brook Autumn Festival Committee, as the Butler School PTA Representative, to fill the unexpired term of Sherry Mazda (who resigned), with her term expiring December 31, 1999; and the appointment of Joyce Antoniolli to the 1999 Oak Brook Autumn Festival Committee, At -Large Representative, to fill the unexpired term of Adam Butler (elected to the Village Board in 4/99), with her terms expiring December- 31, 1999. ORDINANCES & RESOLUTIONS: 1) ORDINANCE 1999 — SC — G — FOP — S -953 AN ORDINANCE APPROVING AND AUTHORIZING EXECUTION OF AN INSTALLMENT PURCHASE CONTRACT AND THE ISSUANCE OF $820,000 GENERAL FUNDS CERTIFICATES, SERIES 1999, OF THE VILLAGE OF OAK BROOK, ILLINOIS: The ordinance authorizes the issuance of $820,000 General Fund Certificates in order to finance the irrigation system improvements at the Oak Brook Golf Club and the costs associated with the financing. Key provisions of the ordinance include: • Oak Brook Bank will be the purchaser of the certificates. • The interest rate is fixed at 4.93% per year. Based on the opinion of bond counsel, the interest is exempt from federal income taxes. • The certificates will be dated September 24, 1999 (the anticipated closing date of the transaction). Payments will be made over a ten year period with the final installment being due on September 15, 2009. The certificates are callable on or after September 15, 2006. • Interest is paid semi - annually on March 15 and September 15. Principal payments are due on September 15 each year. • In order to obtain the most favorable rate for the financing, sales taxes have been pledged for the repayment of the certificates. Section 9 of the ordinance notes the Village's intent to use golf course revenues as repayment of the obligation. • The Village President is authorized to sign various documents related to the installment purchase financing. The Installment Purchase Contract is to be executed by the Village and the irrigation system contractor (Halloran & Yauch). CERT. purpose of this contract is that the contractor agrees to accept installments over ten years for the irrigation system project. The Assignment Agreement is executed by the contractor and Oak Brook Bank, whereby the contractor assigns his rights to receive installment payments to Oak Brook Bank. Thus, the Village will make the installment payments to Oak Brook Bank. A legal opinion from bond counsel, Katten, Muchin, & Zavis, states that the Village is authorized to finance this project and provides the opinion that this obligation is exempt from federal income taxes. Oak Brook Bank has requested that a section be added which imposes a 2% per annum penalty on any late payments made by the Village. This provision will be added and a revised ordinance will be distributed on Tuesday. Motion by Trustee Caleel, seconded by Trustee McInerney to approve Ordinance 1999 -SC -G- FOP -S -953, "An Ordinance Approving and Authorizing the Execution of an Installment Purchase Contract and the Issuance of $820,000 General Fund Certificates, Series 1999, of the Village of Oak Brook, Illinois" as presented and waive the full reading thereof. AWARD OF CONTRACTS: 1) 1999 SAFETY PATHWAY PROJECT: Two sealed bids were received September 1, 1999. The budget for this project is $98,000 in the Safety Pathway Improvements Program (463- 9070). The engineer's estimate of construction cost was $89,469. Work is scheduled to be completed by November 29, 1999. Motion by Trustee Craig, seconded by Trustee McInerney that a contract be awarded, subject to staff review, to the lowest responsible bidder: Lemont Paving Company, 11550 Archer Avenue, Lemont, Illinois, 60439, based on the unit prices bid, for an estimated total project price of $62,717. Absent: 0 — None. Motion carried. 2) PEDESTRIAN / BICYCLE PATH ASPHALT SEALING: Three sealed bids were received on September 8, 1999 Bid packages were picked up by three companies. The project calls for the asphalt sealing of approximately 32,000 square yards of safety pathway and 4,000 square yards of water pump station driveways. The work is scheduled to be completed by the end of September or early October, weather permitting. This project is undertaken every three years to mitigate water intrusion into the asphalt mix, prolonging pavement life. Funds in the amount of $25,000 have been budgeted in the Safety Pathway Maintenance Program (336- 7200). Cost for the water pump station driveway portion (estimated at $2,144) will be charged to the Water Fund. Motion by Trustee Craig, seconded by Trustee Kenny that a contract be awarded, subject to staff review, to the lowest bidder: R.B. Enterprises, Inc., 1765 Courtland Ct., Unit L, Addison, Illinois, 60101, at a unit cost of $0.536 per square yard (estimate of 36,000 square yards) for an estimated total project price of $19,296.00. VILLAGE PRESIDENT: President Bushy remarked that our Emergency Management Team is working to insure our staff is prepared for the Y2K event. This week Fire Chief Jarvis supervised a tabletop exercise in our Emergency Operating Center. Staff is continuing these type of activities and a Y2K special edition of our Village newsletter will be sent to our residents very soon. VILLAGE OF OAK BROOK Minutes Page 6 of 13 September 14, 1999 PEDESTRIAN/ BICYCLE PATH ASPHALT SEAL INFORMATION &c UPDATE: VILLAGE PRES. 91 President Bushy suggested that parents consider working with their children to practice what may happen if they were without power during the Y2K event and what activities they could do. She participated in a panel discussion on Aurora's public television dealing with the Y2K issue. She also spoke with a group of business people and elected officials of three municipalities in the Kankakee area. They wish to improve their zoning, code enforcement, building and community design work and she will continue to communicate with them in this area of development. B. VILLAGE MANAGER: v MGR. Village Manager Veitch will be moderating a panel discussion of the Y2K event at the Illinois Municipal League this Friday at their Conference in Chicago. DEPARTMENTAL REPORTS: Liaison Assignments. DEPT. RPTS.- LIAISON ASGNMT. Community Development: Trustee Savino — Commercial Development: 700 Commerce — Construction is progressing on this five -story, 200,000 square foot office building (this is the old Eastern Airlines property at the east end of Commerce Drive). 2001 York Road — The John Buck Co., is the developer of this five -story, 180,000 square feet office building. Ninety -five percent of the building exterior has been enclosed. 306 Windsor — Construction is underway for this two -story building which will connect the structures at 300 and 310 Windsor. A significant element of this construction involves an underground stormwater retention vault. Residential Development: Since August 20, 1999, four permits for new homes have been issued in the newly established Forest Gate Subdivision. Two of these four have had foundations poured. Plan Commission/ZBA Assessment Plats: There are no new petitions that have been filed. The DuPage County Forest Preserve District has indicated they will be filing a petition seeking a Special Use permit to allow office use in the renovated Graue House. The Northridge's First Assessment Plat (3404 Adams) has been received and is under review. Project Under Discussion: Staff has met with representatives of the Butler National Golf Club who have expressed an interest in constructing three residential cottages in the southeast corner of their property. To accomplish these plans, the established yards for the property will need to be amended. Special Projects: Staff has initiated work toward a recommendation on establishing a Property Maintenance Code for consideration by the Village Board of Trustees. It is hoped that such a document could be completed before the end of the year with administration beginning in the year 2000. VILLAGE OF OAK BROOK Minutes Page 7 of 13 September 14, 1999 0 WE _1 President Bushy noted that the DuPage County Housing Authority is progressing with consideration of developing the Friary into a senior housing development. This would place housing in a conservation/recreation district. This appears to be a very difficult situation with consideration of rezoning a small portion of a conservation/recreation district. People may think of this in terms of spot zoning and would the Village want to allow residents in a CR district. Notably Butler National Golf Club is R -1 so that if they wish three residential cottages on their property they do not face the same issue as it is located in a residential district. She indicated DuPage County Housing Authority has had an informal discussion with the Village on this matter. Trustee Kenny asked that the Village consider notifying the DuPage County Forest Preserve and DuPage Housing Authority regarding this issue. He indicated people may think the Village of Oak Brook is perceived as trying to diminish this project when raising zoning issues to prohibit housing for the elderly. The County should have a clear understanding that they have zoning regulations that they must contend with for this project. President Bushy explained that the Village could forward a letter to DuPage County Forest Preserve and the DuPage Housing Authority of the zoning issues that must be addressed for this type of project. Attorney Martens indicated the letter should confirm that previous discussions have been held with the DuPage Housing Authority and they are aware of the issues. Finance, Information Services & Purchasing: Trustee Caleel — Information Services — The Minolta document imaging system has been installed and is being fine -tuned to meet staff and system requirements. We continue to investigate various options to improve data communications between buildings including radio frequency (RF), fiber and alternate suppliers of these services. Y2K upgrades to PC's and network systems are complete. Testing of the financial system applications will be completed by the end of September. Repeat testing will continue through the end of the year in order to recheck systems after software upgrades and patches are installed. Finance — The completion of 2000 -2004 Five -Year Financial Plan was the major project worked on during the month of August. The Committee-of-the- Whole meeting last night discussed this issue extensively. The preparation of the 2000 Municipal Budget began during August. Departmental requests are due September 17, with individual departmental meetings beginning soon after. We have now received indications from our major software vendors that their software is Y2K compliant. The Finance Department will be conducting a test of its major systems on September 13 and 14 to assess whether the software is in fact Y2K compliant. The testing will involve setting the system clock forward to 2000 and we test all transactions processing in 2000. VILLAGE OF OAK BROOK Minutes Page 8 of 13 September 14, 1999 R, Intergovernmental Relations: Trustee McInerney — indicated that several Committee -of -the -Whole meetings have conflicted with his attendance of any school district or government meetings. He noted in School District 53 they have grouped in mathematics. He also indicated athletes from Oak Brook that are participating in many of the athletic programs offered in the area schools. Library & Community Events: Trustee Butler — Library - Work proceeded with our architect and value engineers in refining the Library building design. Groundbreaking for the new building is scheduled for September 19` at 1:00 p.m. at the site. Everyone is invited to join the Village President and Trustees as we take this next step toward providing a beautiful new Library for our community. August - was the highest circulation August since monthly statistics have been kept. The usual August slowdown did not occur. Library staff was delighted to be kept very busy. Youth Fall programming began today. Call the Resource Desk to check if space is still available. The Reference Department is hosting opera talks in conjunction with the Lyric Opera season. Schedules are available in the Library. September is Library Card Sign -up month. If you do not have a Library card, stop in and register for your card! Community Events — the Autumn Festival Preview party is scheduled from 6:00 -11:00 p.m. with international foods and dessert table. Admission is $15 for the event. The Autumn Festival will be on Sunday September 19`h from 12:00 -6:00 p.m., there will be games and activities for the entire family. Public Safety: Trustee Kenny — Fire Department — Month of August, 1999 fire calls totaled 100, with Mutual Aid given two (2) times and received one (1) time. Ambulance calls totaled 99, with Mutual Aid given one (1) time and received four (4) times. During August the Oak Brook Fire Department responded mutual aid to York Center for a house fire in Chambord. Oak Brook fire crews assisted with establishing a water supply and assessing safety issues concerning structural stability. Oak Brook fire units responded to five small brush fires in August in the parking area of the Shops of Oak Brook. The fires were extinguished with no damage to nearby parked cars. Discarded cigarettes most likely caused these fires. The Fire Chief and one firefighter attended the Incident Management Symposium hosted by the Phoenix Fire Department in early August. The Fire Chief from Columbine gave a presentation on the tragic event at their High School. The Oklahoma City Fire Chief gave a presentation about their response to the fatal tornado last May with comparisons of their incident command structure to the 1995 Oklahoma City bombing. A large portion of the conference was devoted to efficient and effective E.O.C. procedures and command structures. The Fire Chief and two officers attended the International Association of Fire Chiefs Conference in Kansas City. They attended workshops on ISO Insurance Rating, Fire Department Accreditation, Terrorism and gathered information on the types VILLAGE OF OAK BROOK Minutes Page 9 of 13 September 14, 1999 01 and functions of thermal imaging cameras. Oak Brook will be purchasing two of these cameras within the next few months. A CPR class was given to 13 people at the Park District. Twenty -five people responded to the monthly blood pressure screening at the Oak Brook Club and 200 people at the Good Samaritan Health Fair. A class on the proper use of fire extinguishers was given to 20 office workers at the Oak Brook Bank, as well as instruction to 80 of their employees on evacuation of the building. The aerial truck, an engine and an ambulance attended two picnics at Brook Forest and RPS Payroll Services, 64 children and 80 adults were in attendance at these functions. Police Department — Patrol Officer Benjamin Kadolph has completed his probation period and is now a sworn officer. Honorable mention was given to Patrolman Kadolph who made a traffic stop on a driver that had been speeding. A routing computer check on the driver indicated that an arrest warrant from Calhoun County Mississippi matched the driver. Patrolman Kadolph brought the driver into the police station and after questioning the driver, he confirmed that he was the wanted subject. The subject is being held in the Calhoun County jail on five counts of sale of cocaine. While awaiting trial on these charges, the offender and three other inmates overpowered a Deputy and escaped. Patrolman Kadolph charged the subject with felony fugitive from justice. The offender will be extradited and face charges in Calhoun County Mississippi. Justin Long is in the Social Justice Program out of the Olivet Nazarene College, which is located in Kankakee, Illinois. Justin was accepted into the internship program and started on Tuesday, September 7, 1999 and will complete the program on Friday, October 22, 1999. The program is designed to provide the student with an opportunity to combine classroom theory with practical field experience. Trustee Caleel requested inclusion of public safety reports from building inspections. Village Manager Veitch indicated this may be included with the monthly reports. Public Works & Engineering: Trustee Craig — Public Works — Street Division — The majority of the street division's efforts have been concentrated on placing asphalt overlays on specific sections of the safety Pathway system in the Trinity Lakes subdivision. Crews overlaid approximately 2,200 linear feet of deteriorated asphalt. All the work was completed in house. However, we would like to thank the Village of Villa Park for loaning us their asphalt paver. Water Division — In addition to monitoring and inspecting private contractors for utility installations, crews remain busy replacing residential water meters per our replacement program. Additionally, our new Water Department employee, Shawn Rice, who comes to us from the Village of Bensenville where he worked for nine years in the Water Department, is in the process of becoming acclimated with the Village. Shawn is fitting in nicely and with his experience, should prove to be an excellent addition to the department and the VILLAGE OF OAK BROOK Minutes Page 10 of 13 September 14, 1999 Village. Water Pumpage — Again, with extremely hot and dry weather we experienced in August, water pumpage for the month, 186 million gallons, was the second highest pumpage for the month of August since 1991 when we pumped 201 million gallons. Engineering — 1999 Paving and Water Main Project — In Yorkshire Woods, installation of concrete shoulders is complete and surface asphalt is scheduled to be placed on Friday, September 10 . Additional drainage issues have been discussed with many residents including a committee of three ladies and some additional fine tuning has bee accomplished. Staff is disappointed that Commerce Drive, McDonald's Drive and Clearwater Drive have not been completed and have so informed the contractor. Staff also informed the contractor that we are not happy with the delay in restoring the other residential streets within the project. Midwest Road/I -88 Bridge — Work is substantially complete with minor items remaining. 1999 Safety Pathway Project — staff asked that the Board award a contract at the September 14th meeting. The work should be done by late November. Village Clerk: Clerk Gonnella - The Secretary of State's Mobile drivers services program will be available in the Samuel E. Dean Room of the Village Hall, on September 30, 1999 from 9:30 a.m. to 2:30 p.m. Services include written And vision testing, the issuance of driver's licenses, identification cards and the sale of license plate renewal stickers for upcoming, present and past months. The Mobile driver services program is part of the implementation of Illinois' new digital driver's license system. For a $5 fee, applicants may exchange their current valid Illinois driver's licenses for a digital license. In addition to surrendering their old license, applicants will need to show an additional form of identification containing their signature. Individuals within one year of the expiration date of their driver's license may go ahead and renew for a $10 fee. The digital license provides increase security and durability, and it also offers new tools for law enforcement to protect Illinois citizens from fraud and misuse of identification. Using digital imaging, the Secretary's office can electronically capture and store images and signatures. Only the Secretary of State's office and law enforcement may retrieve these images for verifying identity or issuing duplicate licenses. Village President: President Bushy — Bath & Tennis Club - The "Last Fling" Family Game Day took place over Labor Day weekend at the Bath and Tennis and was a huge success. Club attendance was over 500 for the day with over 200 people participating in the organized games. The Club will be sponsoring it's annual Family Halloween Party and Buffet on Friday, October 29th. The event is open to all Oak Brook residents and includes many activities such as a bonfire with story tellers and costume competitions. A village -wide postcard invitation will be mailed with all the important information. The tennis dome VILLAGE OF OAK BROOK Minutes Page 11 of 13 September 14, 1999 is schedule to be reconstructed on September 11 `h. The indoor seasons will begin on Monday, September 20`h. Tennis program information and brochures may be obtained by calling (630) 990 -3029. Golf Club — As of year -to -date, there have been 33,686 rounds of golf played, down 3,034 from last year. Green fees collected year to date total $613,903, Cart fees total $205,194, Drive Range fees total $99,775, Lounge Sales total $95,149 and Pro Shop sales total $59,385. Due to the construction at the Golf Club, the Lounge was closed for a good portion of the summer. President Bushy asked residents to visit the new Golf Clubhouse and indicated that the Pro Shop has a wonderful selection of items for sale. 10.
