I. CALL MEETING TO ORDER
A. Roll Call
The regular meeting was called to order at 7:30 P.M. by President Howell.
All trustees were present.
II. READING OF MINUTES

That the reading of the minutes of the regular meeting of September 13, 1977
be suspended and that they be accepted as submitted.

ORDINANCE, OR THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS TO
REGULATE DEVELOPMENT OF FLOOD PLAINS AND WETLANDS

To approve Ordinance G -223 as presented and waive reading of same.

B. Bliss & Laughlin Industries Subdivision - Final Plat of Subdivision
Trustee Reynolds reviewed the recommendations made by the Plan Commission
on September 19, 1977 and the plat presented for consideration has incorporated
all these provisions.
Trustee Reynolds moved - seconded by Trustee Glaves. . .
To approve Bliss & Laughlin Industries Subdivision, dated July 26, 1977,
revised September 20, 1977, and that the Building Setback Line be shown.

Trustee Brown commented on the recommendations made by the Plan Commission on
September 19, 1977 relative to the 604 Right -of -Way instead of the required
664 Right -of -Way which had been required in R -3 zoning districts, and it is
in the best interest of the village for a development of this size to conform
to the requirements of the Subdivision Regulation Ordinance.
Trustee Brown moved - seconded by Trustee Reynolds. . .
Based upon the 604 Right -of -Way, that the preliminary plat of Trinity Estates
(Mayslake Estates) be denied.
Mr. John L. Kinley, Director of Planning for Toups Corporation requested the
following letter be read into the record:
President and Board of Trustees
RE: Swissco, Inc. Request for Right -of -Way Variation in Trinity Lakes Estates
Gentlemen:
Last week, the Village of Oak Brook Plan Commission recommended denial of
the Preliminary Plat for Trinity Lakes Estates (previously Mayslake Estates)
based on their objection to the petitioner's request for a right -of -way variation
from 66 feet to 60 feet. It was noted at that meeting that the request for variation
was based on two specific points: (1) a waiver of sidewalks was likely and (2)
utilities could be placed in front yard easements; thus the 66 foot requirement was
unnecessary.
The question of right -of -way width is examined in the publication:
Residential Streets - Objectives, Principles, and Design Considerations. The book
was published by the Urban Land Institute, t e American Society of Civil Engineers
and the National Association of Homebuilders. There are several points made in the
discussion relative to right -of -way widths which are pertinent to the Trinity Lakes
Estates situation.
14Right -of -way widths for residential streets should be adequate to
provide required street pavements."
The Trinity Lakes Estates Preliminary Plat provides for a 27 foot pavement
width as specified by the Oak Brook Subdivision Ordinance.
.....(Right -of- Ways)""must be adequate to accommodate sidewalks, utilities,
drainage facilities, landscaping and grading."
There is a proposed waiver of sidewalks in Trinity Lakes, and the Oak Brook
Village Engineer has indicated that placement of utilities in front yard
easements is an acceptable practice.
'Right -of -way width may be conserved where utilities are placed within ease-
ments which become part of rear lot or front sideyard building setback space.t1
"When grade differentials are minimal and pedestrian walks and utilities are
not located in the street right -of -way and the street is curbed, there is
usually no justifiable reason for a right -of -way width appreciably wider than
the roadway pavement."
t4A community realizes no tax revenue from a street right -of -way, and every
needless square foot of street right -of -way also represents an avoidable
maintenance liability."
It is clearly recognized that there are instances when the uniform application
of ordinance standards should give way to certain variable conditions. We believe
that there are justifiable reasons, as we have noted, to request a right -of -way
variation for Trinity Lakes Estates.
We respectfully request that you consider the points we have raised in your
deliberations relative to the preliminary plat for the above - referenced property.

V. OLD BUSINESS
A. Saddle Brook Development Company - Rescheduling of Phases
The Annexation Agreement provided for the numerical scheduling of phases,
unless the village approves the exception. Due to the additional amount
of planning required for the Meyers Road "S" curve, the request is to proceed
with Units #4 and #6 rather than Units #4 and #5.

That the rephasing of Units #4 and #6 as presented be approved.

B. Report of Activities
Administration & Communication - Trustee Philip
Sports Core Management input has been received from the Bath & Tennis
Club, and the Oak Brook Association of Commerce and Industry.
Finance & Capital - Trustee Cerne
Policies are being established relative to the Sports Core, and
the preliminary draft of the agreement with the Park District is
being reviewed.
Public Safety - Trustee Glaves
Read letters of commendation for Sgt. Shaw and Patrolmen Haas and
Kasper from Police Chief Ceren.
Public Works - Trustee Rush
York Road water has been tested, but Hisndale Sanitary District
Water line has developed leaks. Landscape Contractor will begin
his work soon. Wells #6 and #7 and the Reservoir are proceeding well.
Traffic - Trustee Reynolds
DuPage Mayors and Managers are responding to State of Illinois
funding of road projects. "A" list includes drainage at overpass
at Route 83 and Oak Brook Road,,and the resurfacing of a portion
of Butterfield Road. "B" list includes 22nd St. improvements from
Clearwater east to the village limits.
Zoning & Planning - Trustee Brown
Comprehensive Plan is being reviewed by the Plan Commission and
a recommendation is forthcoming. . .

VI. NEW BUSINESS
A. Well Request- Vito Falco

Engineer Littleton noted that the request from Mr. Falco to install a well
to serve his residence should be denied because there is water available
within 2501 of his property line.
Trustee Rush moved - seconded by Trustee Cerne. . .
To table this to the next regular meeting to allow the owner to be so
notified.

B. Open Forum
So ordered.
Mr. Robert Steinbock - Sinclair requested the Board to enforce the agreement
with Oak Brook Development Company to install plantings as a security hedge
along the Bike Trail that runs parallel to Spring Road and was a requirement
of the approval of the Hunter Trails Subdivision.
Mx. Robert Hutchens, President of the Hunter Trails Homeowners Association,
spoke in opposition of the Bike Trail and further requested that a dense hedge
be planted for security, eliminating access from the Bike Trails across private
property.
Manager Carmignani was directed to seek a solution with all parties concerned.
C. Dr. Warren E. Bu ye - Final Plat of Subdivsion
Referred to Plan Commission meeting of October 17, 1977.
D. James Wolak - Variation Rear Yard $ Lot Area
Referred to Zoning Board meeting of November 1, 1977.
