Minutes - 10/09/1973 - Board of Trustees1' VILLAGE OF OAK BROOK MINUTES OF October 9, 1973 I MEETING CALLED A. Roll Call The regular meeting was called to order at 8 00 P.M. by President Howell. All trustees were present II READING OF MINUTES Trustee Rush moved - seconded by Trustee Hayes... That the reading of the minutes of the regular meeting of September 25, 1973 be suspended and that they be accepted as submitted. Voice vote - all in favor. So ordered. III ORDINANCES, RESOLUTIONS, VARIATIONS, FLATS, ETC. A. Ordinance Amending Ord. G-93 - Parking Fines Ordinance G -151. Each trustee was provided with a copy of proposed ordinance amending Traffic Ordinance G -93, Sec. 5.12, Procedure in Handling Parking Violations, increasing the violation fine from $2.00 to $5.00. Trustee Brown moved - seconded by Trustee Congreve... That the reading of Ordinance G -151 be waived and that said ordinance be approved as presented. Roll Call Vote: Ayes - Trustees Baschen, Brown, Congreve, Hayes, Rush, Swain and President Howell Nayes - None So ordered. B. Ordinance designatilg Building Commissioner - Ordinance G -152. Each trustee was provided with a copy of proposed ordinance amending various ordinances of the Village of Oak Brook by which any reference to the Building Commissioner and Building Inspector are amended to read "The Chief of the Oak Brook Fire Department," and that he be authorized to appoint various persons within his department to discharge the imposed duties of this amendment. Manager Carmignani reviewed the structural staff change and the creation of the Bureau of Inspections of the Oak Brook Fire Department. Trustee Congreve moved - seconded by Trustee Hayes... That the reading of Ordinance G -152 be waived and that said ordinance be approved as presented. Roll Call Vote: Ayes - Trustees Baschen, Brown, Congreve, Hayes, Rush. Ordinance Amending Ordinance G -93 - No Parks Commerce Drive - Jorle Boulevard - Ordinance-7--T53. Each trustee was provided with a copy of proposed ordinance amending Traffic Oriinance G -93, Exhibit H, restricting the parking of vehicles on both sides of Commerce Drive from its intersection with Spring Road East to its easterly terminus; and on both sides of .:'orie Boulevard for its enti;,e length. Trustee Brown moved - aeconded by Trustee Congreve... That the reading of ordinance G--153 be waived and that said ordinance be approved a3 presented. Roll Call Vote; byes - Trustees Baschen, Brown, Congreve, Hayes, Rush, Swa;n and President Howell. Wayes - None So ordered. D. Ordinance G-154- False Alarms_. Each trustee was provided with a copy of proposed ordinance establishing conditions fo-- connection to the Village of Oak Brook's Remote Activating Equipment. All connections to this system are subject to these conditions which requires all users of the system to maintain their equipment in good order. Intentional or negligent cause for each false alarm transmi8 ,4ion is subject to a fee of $25.00 to be paid within 48 hours. Should a user not pay the assessment, immediate disconnection will be made, and reconnection can be made only after, satisfactory proof of safeguards to preclude future false signals has been demon- strated. Trustee Baschen moved - seconded by Trustee Rush... That the reading of Ordinance G -154be waived and that said ordinance be approved as amended to add to the end of Sec. 4 "pl%.s proof of payment of past due assessments." Roll Call Vote: Ayes - Trustees Baschen, Brown, Congreve, Hayes, Rush, Swain and President Howell. Nayes - None S- ordered. E. Resolution R--147 - Immunization Action Month. Each trustee was provided with a copy of a letter from Trustee Brown dated October 5, 1973 and a copy of proposed resolution proclaiming October as 'Immunization Action Month as requested by the Illinois Department of Public Health. The purpose is to bring attention to the low levels of immunization against rubella, polio and measles. Trustee Brown moved - seconded by Trustee Congreve... That the reading of R -147 be waived and that said resolution be approved as presented. Voice vote - all in favor. So ordered. IV FINANCIAL. A. Treasurer's Report All trustees were furnished with a copy of the Treasurer's report for the month of September showing Cash Receipts of $515,097.99 at the end of the month in the Corporate Account, and Cash Receipts in the Wr account of $4,480.95. That the village invest in a $150,000 federally secured Certificate of Deposit in the Oak Brook Bank for a period of 90 days at the rate of 9.2576. Approval of Bills All trustees were furnished with a list of bills XVII -5 -73 to be approved for the month of September. Nayes None So ordered. V REPORT OF OFFICERS A. Building Department Trustee Hayes moved - seconded by Trustee Rush... That the report of the building inspector for the month of September be accepted and approved by the village board as submitted. Voice vote - all in favor. So ordered. B. Police Department Trustee Brown moved - seconded by Trustee Baschen... I hat the report of the police department for the month of September be accepted and approved by the village board as submitted. Voice vote - all in favor. So ordered. C. Fire Department Trustee Hayes moved - seconded by Trustee Congreve... Village Hall Design Each trustee was provided with a copy of letter dated September 6, 1973 from Trustee Baschen, Chairman of the Finance, Corporate Planning, and Public Properties Committee in regard to heat, site work, and interior furnishings of the new village hall. Trustee 3aschen also reviewed the open meeting held at 7:00 P.M. prior to this regular board mcating at which Mr. Gene Cook of Holabird & Root Architects was also present. Trustee Baschen moved - seconded by Trustee Congreve... That Holabird & Root be authorized to prepare final plans and specifications of the Village Hall Complex subject to comments on plans dated September 21, 1973 for Board Room and Main Complex discussed at the open meeting of the Finance, Corporate Planning and Public Properties Committee held October 9, 1973 prior to the regular board meeting. Roll Call Vote: Ayes - Trustees Baschen, Brown, Congreve, Hayes, Rush, Swain and President Howell. Nayes - None So ordered. President Howell requested that the village pre - qualify bidders prior to advertising for bids on the building. B. Authorization Holabird & Root - Interior Design & Graphics Each trustee was provided with a copy of Letter from Trustee Baschen dated September 24, 1973 in regard to meeting of the Finance, Corporate Planning & Public Properties Committee of September 24, 1973. The Village had requested proposals from independent firms for the interior design for the Village Hall Complex and Holabird & Root was also asked to submit their proposal. It was, therefore, the recommendation of the Committee,, that Holabird & Root be directed to prepare design services for the furniture, furnishings and interior graphics for the Village Hall complex at a rate of 12% of the cost of the items being bid. Trustee Baschen moved - seconded by Trustee Congreve... That the recommendation of the Public Properties Committee as stated above be approved as presented. Roll Call Vote: Ayes - Trustees Baschen, Brown, Congreve, Mayes, Rush, Swain and President Rowell. Nayes - None So ordered. C. Chanee Order #2 - Public Works_ Buildin Each trustee was provided with copies of letters from Trustee Baschen, Chairman of the Finance, Corporate Planning & Public Properties Committee dated September 24, 1973 and October 4, 1973 in regard to payment of Change Order #2 as submitted by Klein Construction Co. for steel joists in accordance with specifications of the architect, and the increase is specifically related to delivery'of material at increased cost from the supplier. It was the recommendation of the Public Properties Committee that the Village approve Change Order #2 in the amount of $4,649.00 for the cost increase of metal decking and bar joists from the supplier. Trustee Baschen moved - seconded by Trustee Swain... That Change Order #2 in the amount of $4,649.00 be approved for the cost increase of metal decking and bar joists. Payout #3 - Public Works 'Building. Each trustee was provided with a copy of letter dated October 2, 1973 from Holabird & Root along with Certificate #3 in the amount of $36,895.50 as part payment to the Klein Construction Co. in connection with their contract for the subject property. Also included were the required waivers of lien and contractotr's statement, Trustee Baschen moved - seconded bj Trustee Congreve... That payout #3 to Klein Construction Co. for the amount of $36,895.50 be approved. Roll Call Vote: Ayes - Trustees Baschen, Brown, Congreve, Hayes, Rush, Swain and President Howell Nayes - None So ordered. E. Horace Barnhart (Andy's Steak House) Front yard variation. Each trustee was provided with a copy of the minutes of the Zoning Board of Appeals meeting of October 2, 1973, along with the request of Horace Barnhart, owner of Andy's Steak House. Because the circumstances were unique, the variation would not harm the character of the locality, and the petitioner would be denied a fair ret+.irn on his property without the allowance of said request. The Zoning Board of Appeals recommended approval of the request for a front yard variation of 21 feet instead of 100 feet. Trustee Rush moved - seconded by Trustee Brown... That the recommendation of the Zoning Board of Appeals be approved as presented and the Village Attorney be requested to draft the required ordinance. Mrs. Daniel Kolodziejski - Fence Variation Each trustee was provided with a copy.of minutes of the Zoning Board of Appeals meeting of October 2, 1973 and a copy of the request for a variation from Mrs. Daniel Kolodziejski, 1800 York Road, to erect a 6 foot solid fence instead of 42" open fence, 21-,feet from the side lot line. The Zoning Board of Appeals voted to deny this request for a variation. Trustee push moved - seconded by Trustee Brown... That the request for a variation as presented be denied and that the $150.00 filing fee be returned. Roll Call Vote: Ayes - Trustees Baschen, Brown, Congreve, Hayes, Rush and President Howell. Nayes - Trustee Swain So ordered. VII NEW BUSINESS ' A. Christ Church - Building Reauest Each trustee was provided with a copy of letter, dated September 217 1973 from Christ Church of Oak Brook, requesting board approval to use approximately 70 feet of additional space west of their property for temporary parking. Manager Carmignani in a letter dated October 3, 1973 reviewed their request along with the past history of the church and the zoning requirements.
