CALL MEETING TO ORDER The Regular Meeting of the Board of Trustees was called to order at 7:30 P.M. by President Cerne in the Samuel E. Dean Board Room of the Village Commons. A. APPROVAL OF MINUTES Trustee Philip moved - seconded by Trustee Congreve... That the minutes of the Regular Meeting of September 23, 1980 be approved as submitted and waive reading of same. Voice vote: all in favor So ordered III. ORDINANCES, RESOLUTIONS, VARIATIONS, PLATS, ETC. A. RESOLUTION NO. R -284: A RESOLUTION APPROVING THE FINAL PLAT OF TRINITY LAKES, UNIT NO. 'Bid Recommendation - Surplus Personal Property Trustee Rush moved - seconded by Trustee Watson... To accept the high bids received in the total amount of $2,986.04 and authorize the Public Works Department to dispose of the other 96 items in the best possible manner. To accept the letter from David M. Gooder, dated October 14, 1980, representing 711 Jorie Boulevard Building Joint Venture, withdrawing the request for a permit to construct an access driveway unto 22nd St. Voice vote: all in favor So ordered C. Dennis J. Twarog - Lot Size Variation Trustee Reynolds moved - seconded by Trustee Congreve... To defer action on this matter until the final plat of Twarog's Subdiv- ision is on the agenda. Voice vote: all in favor So ordered D. McDonald's Corporation - Special Use Flood Plain The Plan Commission on September 4, 1980 and the Zoning Board of Appeals on October 7, 1980 considered the petition of McDonald's Corporation and both recommended the granting of the Flood Plain Special Use as requested, condi- tioned to incorporating provisions for flood proofing and first floor eleva- tions. Trustee Reynolds moved - To approve the request of the McDonald's Corp. as applied for and updated as per letter of David M. Gooder, dated October 1, 1980, and as recommended by the Plan Commission and the Zoning Board of Appeals, with the stipulation that any buildings without basements built on or adjacent to proposed retaining walls and or within the area previously included within the former flood plain, shall have their first floor elevation at an elevation of at least three (3) feet above the high water level of the flood plain; and if basements are built, they are to be flood proofed to an elevation of at least three (3) feet above high water level; and further that the final approval be qualified by approval of an Improvement Plan which is consistent with the site plans submitted as part of the Special Use Flood Plain application; and that the Village Attorney be directed to prepare the required ordinance; with approval of said ordinance to be without prejudice of the villages' rights. Motion died due to lack of a second. Trustee Philip moved - seconded by Trustee Congreve... To accept the motion of Trustee Reynolds with the exception that reference to buildings without basements built on or adjacent to proposed retaining walls be amended to add "or any retaining wall" and that the provision "and or within the area previously included within the former flood plain" be excluded. Roll call vote: Ayes: Trustees Congreve, Imrie, Philip, Rush, and Watson Nays: Trustee Reynolds President Cerne indicated approval of the motion. So ordered. E. Saddle Brook Community Association Fence Variation (Lot #3 & #40 - SB Unit #1; Lots #40 to #57, inclusive, - SB Unit #2; Lots #126 & #127 - SB Unit # 3) On October 7, 1980, the Zoning Board of Appeals recommended approval for the fence variation request. Trustee Reynolds moved - seconded by Trustee Watson To approve the variation as recommended by the Zoning Board of Appeals for a permanent five (5) foot high open chain link fence on the subject lots, and that the Village Attorney prepare the required ordinance. Macken - Side Yard & Rear Yard Setback Variation October 141- 19�9G On August 5, 1980, the Zoning Board of Appeals recommended denial of a variation to the Side Yard. On October 7, 1980 the Zoning Board of Appeals recommended granting a variation to the Rear Yard, to allow for the construc- tion of an addition to a non- conforming residence. Due to being an adjacent property owner, Trustee Reynolds abstained from discussion and casting a vote. Trustee Congreve moved - seconded by Trustee Imrie... To table for further review. James Pehta Request =(Lot 19 Saddle Brook Chase Subdivision - 101 Livery Circle) Easement Vacation Trustee Reynolds moved - seconded by Trustee Congreve To approve the Plat of Vacation of drainage easement as submitted and dated September 19, 1980, and authorize the President and Clerk to affix their signatures thereon. November Zoning Board of Appeals meeting date Due to the Samuel E. Dean Board Room of the Village Commons being utilized as a polling place for the Election on November 4, 1980 the regularly scheduled meeting of the Zoning Board of Appeals will be rescheduled for November 3, 1980. B. Mayslake Village Fire Protection Trustee Watson moved - seconded by Trustee Rush To extend Fire Protection, excluding Ambulance Service, to Mayslake Village to June 1, 1981 or annexation to the Village of Westmont, whichever occurs first, and that the attorney prepare the appropriate document. Voice vote: all in favor So ordered C. Oak Brook Park District - Request for Waiver of Fees Request received to waive$25.00 permit fee related to automatic protection device to be installed in the new Park District Shelter Building.
