MINUTES OF THE REGULAR MEETING OF THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF OAK BROOK, ILLINOIS HELD
OCTOBER 23, 1990
I. MEETING CALL:
The Regular meeting of the Board of Trustees was called to order by President Cerne
in the Samuel E. Dean Board Room of the Village Commons at 7:42 p.m.

Trustee Bushy moved, seconded by Trustee Winters to approve the Minutes of
the Regular Meeting of October 9, 1990 as presented and waive the full
reading thereof. Voice Vote: all ayes, no nays except Trustee Maher who
abstained. Motion carried.

Trustee Rush moved, seconded by Trustee Payovich to direct the Village
Attorney to prepare the necessary documentation to annex the South
Frontage Road between Spring Road and York Road, notify the Illinois
D3pdrtment of Transportation (IDOT) that the Village of Oak Brook
wishes to proceed with the IDOT agreement and the Village will maintain
said road after IDOT has provided up to $400,000 to the Village for
rehabilitation of said road per alternative #1 repairs as well as
replacement of the fence. Voice Vote: all ayes, no nays. Motion
carried.
B. Acceptance of Quotes -- Village Underground Storage Tanks:
Direction given at the Regular Meeting of September 25, 1990.
Trustee Rush moved, seconded by Trustee Bushy to authorize the issuance
of a purchase order in the amount of $9,200.00 to Peter J. Hartmann
Company for the removal of two Village underground storage tanks at
Fire Station No. 2 and the filling and abandonment of one other tank at
Public Works. Roll Call Vote:

C. Update on IDOT Salt Creek Dredging and Cermak Bridge Problem:
It was the consensus of the Boare to continue discussion with the State
to deepen the digging of Salt Creek without damaging utility lines
dependent upon soil conditions.
D. Acceptance of Quote - Bath & Tennis Club Roof:
Trustee Maher moved, seconded by Trustee Rush to authorize staff to
accept the proposal from Affordable Roofing Systems, Inc. of Aurora in
the amount of $36,588.00 and waive competitive bidding due to the
specialized nature of the project. Roll Call Vote:

E. Discussion of Scavenger Surety Bond Amount:
The Village Board passed Ordinance G -445 on February 27, 1990 which
increased the required surety bond for scavengers from $5,000 up to
$200,000. Section B -146 of the Village Code indicates this
requirement, stating further that the bond is essentially a performance
bond indemnifying the Village for any damage, loss or liability
resulting from the conduct of business by the contractor.

Trustee Rush moved, seconded by Trustee Bushy to require a surety bond
of $35,000 for scavenger service to the Village of Oak Brook. Roll
Call Vote:

President Cerne
Absent: 0 -None
Motion failed.
Trustee Rush moved, seconded by Trustee Bushy to direct the Village
Attorney to prepare an ordinance which would eliminate the required
surety bond for scavengers in the Village of Oak Brook. Voice Vote:
all ayes, no nays. Motion carried.
Upon further consideration, Trustee Winters requested his vote on the
first motion be changed to aye and his vote on the second motion be
changed to nay.

VII. NEW BUSINESS:
A. ALmxntments:
Trustee Bushy moved, seconded by Trustee Maher to concur with the
recommendation of President Cerne and appoint Keith Schaffner as a
member of the Oak Brook Motel, Convention and Visitors Committee, term
to expire February 28, 1991. Voice Vote: all ayes, no nays. Motion
carried.
Trustee Bushy moved, seconded by Trustee Maher to concur with the
recommendation of President Cerne and appoint Christine Rosenbach as a
member of the Oak Brook Hotel, Convention and Visitors Committee, term
to expire February 28, 1991. Voice Vote: all ayes, no nays. Motion
carried.

to Route 83, bas made application for a flood plain special use permit
for modilOicatior of the Ginger Creek flood plain, rezoning of the
property from R -4 to C /R, and a text amei,dment and special use permit
for construction of a community center.
Both the Plan Commission, at its meeting of September 12, 1990, and the
Zoning Board of Appeals, at its meeting of October 2, 1990, recommended
approval of these applications subject to the Park District actually
constructing the improvements as presented.
Trustee Winters moved, seconded by Trustee Rush to direct the Village
Attorney to prepare the necessary ordinance for rezoning the proposed
Community Center. Voice Vote: all ayes, no nays. Motion carri I.
Trustee Winters moved, seconded by Trustee Rush to table the requested
application for a Flood Plain Special Use Permit and a text amendment
and special use until the next Regular Meeting o-J November 13, 1990.

Upon further consideration, Trustee Winters requested his vote on the

C. Recommendation - Accessory Structures in Rear Yards of Through Lots:
It was the consensus of the Village Board that current zoning
regulations for through lots remain the same, and to request
recommendations from the Plan Commission and Zoning Board of Appeals
regarding accessory structures in rear yards of interior lots.
D. Oak Brook Park District 10 -K Run ind Fun Run:
Trustee Bushy moved, seconded by Trustee Winters to approve the Park
District's 10 -K races which will be held on Sunday, April 28, 1991 at
8:00 a.m., pursuant to the following conditions:
1) The Oak Brook Park District notify all the commercial tenants on
Jorie Boulevard, Kensington and Kensington Court of the race and
the closing of Jorie Boulevard between 0745 - 1000 hours.
2) The Oak Brook Park District supply an :adequate amount of traffic
cones and barricades for traffic control and be responsible for
installing and removing them.
3) The Oak Brook Park District use Oak Brook Police Officers to direct
traffic.
4) The (yak Brook Park District make arrangements with the commercial
tenants on Kensington and Kensington Court for a centralized
parking and staging areas

E. AN -RC Fiber 22tics Agreement - Aseignment of Franchise Rights:
Trustee Bushy moved, seconded by Trustee Rush to direct the Village
Attorney to prepare the necessary documentation approving the
reassignment of franchise rights from AN -RC to Diginet for the
installation of fiber optic cables within the Village. Voice Vote:
all ayes, no nays, except Trustee Winters who abstained due to
employment by Illinois Belk. Motion carried.
F. Request for One -Day Liquor License - Colin Reeves Cuisine, Inc. (Crate
& Barrel):
Trustee Rush moved, seconded by Trustee Bushy to concur with President
Cerne, Local Liquor Commissioner, and authorize the issuance of a
One -Day Class "D" Liquor License at a cost of $100.00 to Colin Reeves,
Cuisine, Inc., caterer, for Crate & Barrel's event to be held November
7, 1990, subject to proof of appropriate insurance and payment of the
required license fee. Voice Vote: all ayes, no nays. Motion carried.
G. Request est for Reduction in Subdivision Security - Buck /Ernie Pyle 2nd
Resubdivision;
Trustee Rush moved, seconded by Trustee Bartecki to reduce the Strict
Joint Order Escrow No. 1104874 from Chicago Title & Trust Company by
the amount of $142,790.00 for the Buck /Ernie Pyle 2nd Resubdivision
Security. Roll Call Vote:

H. Discussion of DuPage Mayors & Managers Conference Model Tobacco

Trustee Bushy moved, seconded by Trustee Rush to pass the Model Tobacco
Ordinance, Ordinance No. G -455, "An ordinance Amending The Code Of
Ordinances Of The Village Of Oak Brook Adding A New Article VI
Regulation Of Tobacco Products" as presented and include a $50.00
license fee. (Section 8 -191) Roll Call Vote:

I. Regional Transportation Authority (RTA) Personal Rapid_ Transit (PRT)
Project:
Consensus was to notify the RTA of the Village's interest in
participating in the development, marketing, and construction of the
PRT demonstration system.
