UTILITY TAX Based upon the 1996 -2000 Five -Year Financial Plan as adopted by the Board on September 26, 1995, the Village Manager recommends that the Board adopt Ordinance 95- TX -UT -G -563 to extend the Village's utility tax, on its existing terms, through 1996. The current tax is at the rate of 4 percent on electric and natural gas service, and 3 percent on local telephone service. All receipts from the tax are deposited in the Infrastructure Fund, which supports improvements to and major maintenance of the Village's roads, drainage systems and safety pathways. Sue Lanham, York Woods, requested the Board to consider reducing the telephone tax of commercial residents. President Bushy explained that many Oak Brook businesses do not generate sales tax revenue, rather revenue through the utility tax. Our commercial residents are aware they pay no property taxes in Oak Brook, and the utility tax generates revenue for the Village. Many convnunities in the western suburbs have property taxes and a utility tax in the same range as the Village. Staff has prepared a covering ordinance that would adopt a revised Chapter 14. Tae changes from the previous draft are as follows: Page 5 - The definition of the golf season and language concerning discretion to close for maintenance have been amended pursuant to the Board's discussion on October 10. Pam - The language concerning priority in the reserved weekend starting time drawing has been clarified. Page 1 I - The increases in Bath & Tennis memberships recommended by the staff have been removed pursuant to the Board's direction. P ge 16 - The language in subparagraph (5) under Operation of the Clubhouse has been broadened. ,PAges 22-24 - Staff has made adjustments to the rental fees and minimums that they consider necessary to meet the Club's goal of making the P-od and beverage operation self- supporting and, a positive contributor to the overall Bath & Tennis operation. Staff has also developed language designed to recognize and accommodate the good works and legitimate needs of local civic and not - for - profit organizations. Staff has allocated $30,000 in the 1996 Budget (in a new General Fund supported budget program, "Community Events ") for the clubhouse rental fees forgiven pursuant to the new language. Motion by Trustee Kenny, seconded by Trustee Bartecki, to award Purchase Orders to the following two low bidders, based on bids received by the State of Illinois, and that orders be placed no later than November 15, 1995 in order to receive the indicated discounts: Landmark Ford, Inc., Springfield, for 1996 Ford Crown Victorias, Police Pursuit Package (one (1) @ $18,408, replaces marked squad Unit #304 and u.,e (1) @ $18,261, replaces marked squad Unit #309) for a total package price of $36,669.00; and Celozzi Ettleson Chevrolet, Inc., Elmhurst, for 1996 Chevrolet Luminas, Police Patrol Package (one (1) ar $16,676.26, replaces tactical Unit #318, one (1) @ $16,579.76, replaces detective Unit #313 and one (1) @ $16,579.76, replaces fire inspection Unit #917) for a total package price of $49,835.78. AWARD OE CONTRACT - BATH & TENNIS CLUBHOUSE ROOF /SKY LIGHT REPAIR: Seven (7) companies were advised of this project, and bid packages were picked up by four (4) companies. The required pre -bid meeting was attended by only Voyager Services Co., and one (1) sealed bid was received on October 18, 1995. Based on references submitted, Voyager has successfully performed similar types of roofing work for the Chicago Public Schools system (approx. 20 projects over the last two years ranging in value from $60,000 to $300,000 each). Final interior and exterior work can then continue after November 21 and not affect the use of the facililly. Funds in the amount of $30,000 have been budgeted in the Clubhouse Maintenance and Improvement Program (14 -8402) for this work. Motion by Trustee Kenny, seconded by Trustee Savino, to direct staff to attempt to negotiate a lower price with the lowest responsible bidder, Voyager Services Co., Chicago, in order to reduce the lump sure price of $26,570 by making the design less complex while maintaining the quality aesthetics of the interior. In the event staff is unsuccessful in reducing the price, staff is authorized to accept the bid of Voyager Services Co., Chicago, the lowest responsible bidder, in an amount not to exceed $26,570 for the Bath & Tennis Clubhouse Roof/Sky Light Repair. WROUNUT NOHOW On April 25, 1995, the Village Board passed Resolution R -646 granting approval of a two -lot subdivision of the Diepstra property at 2417 35th Street. Under the Subdivision Regulations, the petitioner has a six-month period to complete all necessary plans, documents, etc. Due to some confusion regarding whether or not the sanitary sewers were in place and misunderstanding regarding what needed to be done, the petitioner is requesting a six -month time extension. Motion by Trustee Kenny, seconded by Trustee Bartecki, to grant the petitioner the requested six -month extension for submission of the final plat revision and related documentation for the Diepstra Subdivision. The agreement, which was prepared by Village Attorney Martens, is substantially identical to similar agreements the Village has in place with the Villages of Lombard, Downers Grove, Westmont and Hinsdale. The only substantive difference is that while such agreements typically provide for sharing the cost of establishing the interconnection on an equal basis, this agreement provides that Oak Brook will bear 75 percent of the cost. This is reflective of the fact that Oak Brook is the principal beneficiary of the interconnection. Hillside has already executed the agreement. The Village Manager recommends that the Village Board approve the agreement and authorize President Bushy to execute it on behalf of Oak Brook. Motion by Trustee Savino, seconded by Trustee Kenny, to approve the "Municipal Water System Interconnection Agreement" between the Villages of Oak Brook and Hillside, and authorize the Village President to execute the agreement on behalf of the Village of Oak. ESTABLISH AD 110C, INTERNATIQNAL 1996 ETHNIC FEST Pursuant to discussion at the September 26 meeting of the Village Board, and based on further deliberations of the informal organizing group, staff has prepared a resolution creating an ad hoc committee solely for the 1996 Ethnic Fest. Included language intends to maintain proper control over expenditures of public fiends and suggests a structure whereby the Committee would be co- chaired by elected officials of the three sponsoring local governmental units. President Bushy acknowledged School District 53 had outgrown their facilities for hosting their Ethnic Fest. They approached the Village to expand the event with the assistance of the Village. The original borrowing of $300,000.00 commenced in 1992 and provided for the purchase of the 'Tennis Dome. Village Engineer Durfey introduced the newest member of the Engineering Department, Anne Buser, Civil Engineer I. She brings considerable knowledge of the AutoCAD system to assist the department. Village Manager Veitch inquired if the quarterly reports presented sufficient data for the Board members. The Board of Trustees suggested the reports were fine as presented. R4 MF The Village Board, on September 27, 1994, considered results of the June 23, 1994 public hearing of the York Road Bicycle Path Route. The board tabled the subject to allow stab' and the Pathway QUARTERLY REP047S rl YORK ROAD BICYCLE PATH ROUTE VILLAG , OF OAK BROOK Minutep, 9 of 14 October 24, 1995 flp�, Committee to consider alternative routes, in response to concerns expressed at the hearing. One of the concerns expressed at the public hearing was the closeness of the path to existing houses at the south end of the construction, just north of Salt Creek. As a result, the Pathway Committee has spent considerable time investigating options which avoid that conflict point. Options considered include: 1. Path on west side of York Road between 31 st Street and Robin Hood Ranch - (this is the recommended location). 2. Same as above, but for redirecting the path across the south edge of Christ Church property (adjacent to 3312 Oak Road) to provide access to the Forest Preserve path. Staff has met with numerous agencies, (DuPage County Highway, DuPage County Forest Preserve District, Mayors & Managers Conference - Transportation Committee, Illinois Department of Transportation, and Federal Highway Administration), to consider this type of re- routing, and received a positive response from all of them. Based on that information, plus input from Village residents, the Pathway Committee, at its September 14, 1995 meeting recommended the path be located on the West side of York Road, between 31 st Street and Robin Hood Ranch. From that point south, pathway users could access the existing Fullersburg Forest Preserve multi -use path down to York Road/Salt Creek. The reconstructed bridge over Salt Creek (DuPage County's roadway project) will then accommodate pathway users continuing south to the Hinsdale area. This project is being funded through federal Transportation Control Measure grant (administered by Mayors & Managers), with a cost split of 25% Village and 75% Federal. The original Mayors & Managers approval was received in 1992, and has been extended annually. The most recent extension was to the federal FY96. This means that the construction part of the project needs to be awarded no later than September, 1996. Village Manager Veitch stated the Safety Pathway Committee has spent more than a year on the proposed project, and their findings recommend the York Road bicycle path be located on the west side of York Road between 31 st Street and Robin Hood Ranch. President Bushy thanked the Committee for their efforts in pursuing this project. President Bushy asked for public comment: VILLAGE OF OAK BROOK Minutes 10 of 14 October 24, 1995 219, Stanley Strahan, 27 Robin Hood Ranch, on behalf of the homeowners association and Tom Doyle, President of their Association, stated their Association was unable to reach a consensus of the Pathway Committee recommendation. A letter was distributed to the Board of Trustees noting their concern of safety and security of the proposed pathway. Joan Philip, 3412 York Road, commented that the proposed pathway is better than none, as the loose gravel on York Road is hazardous for pedestrians, bicyclists or runners. Village Manager Veitch recognized Bruce Kapff, Purchasing Director /grants Coordinator, as the Village representative who attended the Pathway Committee meetings. grants Coordinator Kapff stated the Illinois Department of Transportation (IDOT) has specific guidelines of what can be constituted as a pathway. The route must be determined before proceeding with any formalized project. He clarified that the majority of the pathway system is along major streets in Oak Brook. If IDOT does not accept the proposed pathway along York Road, then the Village would pursue an off-street pathway. Michael Macken, 4 Robin Hood Ranch, suggested the pathway behind his home is under water on a regular basis, as it is below the Creek level. Ana Sisson, Pathway Committee member, commented that, presently, there isn't a pathway available for children from that area to walk or bicycle to Butler School, the Park District, Library or another subdivision. The children must maneuver along York Road, and she offered the proposed pathway is better than none. Arlene Birkhahn, 3312 York Road, voiced her concern that the pathway through her property would cause a hardship. Her property would be the most affected by the proposed route, and it could decrease the value of her home. She further voiced her concern for the safety of pedestrians on the ;pathway with vehicles coming into and out of her driveway. She requ - -ted the Board members to consider the pathway to proceed al. -+g the Christ Church property, and the Village propose this to the Church Trustees. Co- Chairman Tom. Richardson, Safety Pathway Committee, expressed the Committee's concern for safety and not affecting property owners in the design of the pathway. He suggested it was not feasible without obtaining more easements on York Road. He recommended, due to the Robin Hood Ranch residents' concern of VILLAGE ()1; OAK BROOD. Trustee Kenny asked if a feasible alternative would be a route through the Christ Church property on an elevated walkway. Grants Coordinator Kapff commented that staffs consultant, Civiltech Engineering, had not considered this as a viable option. Staff would need to review this option. Rhea Anderson, 2 Robin Hood Ranch, noted the bicycle safety force from our Police Department patrols the pathway system, and there has been no incidences in Fullersburg Woods or along the pathway of any security problems. Trustee Barteela stated his concern of two unacceptable a t; €natives for a pathway unless barriers are located along York Road. Consultant Mark Hine, Civiltech Engineering, explained that federal funding has been secured from the Federal Highway Commission. This funding providi-s the facilities, i.e., landscape, sidewalks or pathway along and within the right-of-way of highways. It is their purpose to offer alternatives for vehicular usage. Trustee Kenny inquired if the pathway was developed along the Christ Church property, could the Village lose the federal funding. The consultant will have to inquire if this option is possible. President Bushy indicated the three -lane configuration proposed for York Road, by DuPage County, would be a two -lane traffic flow with a center static lane for turning. It would improve the moving condition of traffic but not increase the carrying capacity. Matt Anderson, 2 Robin Hood Ranch, voiced his opposition to a pathway system along York Road and requested researching an alternative route along the Christ Church property. He inquired as to why the pathway system is asphalt. Connie Craig, Co- Chairman of the Safety Pathway Committee, explained the Village surveyed residents of the pathway system. 86'x/0 of the respondents requested the pathways be asphalt based. AOL W 00 Trustee Bartecki stated the two proposed pathways were iuiacceptable and to pursue better alternatives with IDOT. Trustee Savino asked if the suggested boardwalk by Trustee Kenny be a viable alternative. Village Engineer Durfey clarified that the pathway would have to be designed for horses. Consultant Hine stated the boardwalk would not be allowed on Forest Preserve property. Trustee McInerney recommended the use of the west side of the Christ Church property, directing the pathway south, and investigate the present muddy conditions of the pathway on Forest Preserve property. Trustee Henry Bronson, Christ Church of Oak Brook, clarified to the Board of T jL iastees that the right -of -way on the south end of the Church property is a possibility but has not been approved by the Church. It would need approval by their Trustees of the Church. Trustee Kenny requested the Village initiate a proposal to Christ Church of a proposed pathway along the south end of the Church property for their consideration and to further request their view of this option. Motion by Trustee Kenny, seconded by Trustee Bartecki, that the Village Board initiate a written formal request to the Trustees of Christ Church for consideration of an easement across the southern portion of the Church property between York Road and the area where the bicycle path exists in the Fullersburg Woods. Motion by Trustee Kenny, seconded by Trustee Bartecki, to amend the motion to read: That the Village Board initiate a written formal request to the Trustees of Christ Church for consideration of routing a bicycle /pedestrian pathway across the southern portion of the Church property between York Road and the area where the bicycle path exists in the Fullersbu g Woods.
