1. MEETING CALL:
The Regular Meeting of the Board of Trustees was called to order by President
Bushy in the Samuel E. Dean Board Room of the Village Commons at 7:34
p.m. Pledge of Allegiance was given.
2. ROIL CALL:
The Clerk called the roll with the following persons
PRESENT: President Bushy, Trustees Bartecki, Caleel, McInerney, Savino
and Shumate.
ABSENT: Trustee Kenny.
IN ATTENDANCE: Michael A. Crotty, Assistant Village Manager; Dale L.

3. ANNOUNCEMENTS & OPEN FORUM:
President Bushy announced that the Local Canvassing Board for the November
3, 1998 General Election shall occur at 7:20 p.m. before the regularly
scheduled Village Board meeting of November 10, 1998. The Canvassing
Board consisting of the Village President, Village Clerk and Senior Village
Trustee shall open and canvass the precincts and prepare the abstract of votes
received for the advisory referendum, "Shall the Village of Oak Brook be
authorized to sell not more than three (3) acres of vacant real estate fronting on
Coolidge Street and Lincoln Road in the Westchester Parr Resubdivision north
of Oak Brook Road (31" Street) and west of York Road in the Village of Oak
Brook for single-family residential use, the proceeds of the sale to be used for
making capital improvements at the Oak Brook Golf Club ?"
President Bushy publicly thanked the Oak Brook Press for their interview
regarding the advisory referendum with the Village President, Village Manager
Veitch and Golf Club Manager VanDyke, as they were given the opportunity
to explain the reasons for the Village referendwn.

homes for sharing their 'thanksgiving dinner with sailors from the Great Lakes
base. Resident George Mueller is organizing, in association with the Oak
Brook Civic Association, a breakfast that day at the Village Hall after which
the sailors depart for the day with their designated families. Please call the
Village Hall at 990 -3000 foi further information.

Patrick Mauro, 38 Mockingbird Lane, addressed the Village Board,
for the record, as a resident and voting citizen that it is a mistake for
the Village to proceed with the approval of the Rocca project and that
the Forest Preserve District should be involved in the purchase of the
property. fie further voiced his opposition to the drive -in facility for
the bank and that this concept is inappropriate for the area.

"WHEREAS, in 1972 in a case entitled Cilic§ Sgrvice Qil Cempau
v. Village f Oak Brook 71- 1443 -G, the Circuit Court found that
with respect to the northerly parcel, "the zoning of the Village of Oak
Brook for residential use is not compatible with the character of the
neighborhood and existing uses therein, and has no tendency to
promote the health, safety, morals, convenience and general welfare
of the citizens of the Village of Oak Brook." and further found that
the "general character of the neighborhood is business "; and
WHEREAS, the Circuit Court's decision was affirmed in Cities
Service Oil Company v. Village of Oak Brook, 15 lI1.App. 3d 424,
304 N.E.2d 460 (2nd Dist., 1973), wherein the Appellate Court found
that with respect to the northerly parcel the existing uses of the area
were basically commercial with considerable public use for forest
preserve purposes, including the historic Graue Mill site, and with
comparatively few residential uses and went on to state: "The area
cannot be characterized as solidly residential, but rather is developing
commercial; and any damage to the property of the surrounding area

THE ISSUANCE OF A 1122,293.47 REFUNDING NOTE OF
THE VILLAGE OF OAK BRQOK, DU PAGE AND COOK
COUNTIES, IL:
The ordinance authorizes the issuance of a Sports Core Refunding
Note in the amount of $122,293.47 with Oak Brook Bank. The
original borrowing of $300,000 commenced in 1992 and provided for
the purchase of the Tennis Dome. The financing has been
accomplished by means of a series of one -year notes due on October
28 each year, with th, remaining principal balance being refinanced
for an addit' -nal c,ne -year term. The interest rate on the note is
4.81 % and (iit monthly rayment on this obligation is $2,805.78, the
same terms as those in etfcct when the note was originally issued.
'The payments have been budgeted in the 'tennis Operations- Indoor
Program (8 104 ). which is then reimbursed by the General Corporate
Fund through a monthly transfer.

A request has been received from Westcoast Properties, Inc., at 1919 ROADWAY Midwest Road, for Village Board review and approval of a plan INFRASTRUCTURE
delineating the taking of a portion of their property at 1919 Midwest
Road. This property taking is part of the Illinois Department of
Transportation (IDOT) Butterfield Road Improvement Project.
Zoning Ordinance Sections V(B)(6) and V(F) provides protection to
property owners with respect to Floor Area Ratios and yard setbacks
when property is being taken for public roadway purposes provided
that a site plan depicting the taking has been reviewed and approved
by the Village Board. A copy of the plat filed by IDOT which
delineates the property being taken is included in the official files.
The submittal by Westcoast Properties, Inc. is in accordance with the
requirements of the Zoning Ordinance.
Motion by Trustee Savino, seconded by Trustee Bartecki, to accept
the property taking of a portion of the property at 1919 Midwest
Road. VOICE VOTE: Motion carried with Trustee Shumate voting
:gay.
Trustee Shumate asked the Board to consider this action in light of
future redevelopment of existing properties on Midwest Road. He
expressed concern over limiting the Village's ability to regulate
setbacks and other provisions of the Zoning Ordinance in the future.

clue to health reasons, please let the Village's Communications Center be
aware cyf this. It is the Village's hope that a complete list of every resident in
the Village, that may need assistance during that time frame, is known.
Public Works Director Meranda stated the Village has contacted the County
regarding the markers on Meyers Road and requested their removal.
President Bushy announced the leaf pick -up program has started and requested
only leaves be placed at the curb, as other yard waste would cause damage to
our equipment.
President Bushy stated she appreciated the Stangaronc's presentation of the
Swim and Dive Team's video of their summer events before this evening's
Village Board meeting Trustee Shumate inquired if the video could be
included with the cable company for viewing by the residents, as this meeting
is short. The videographer indicated it could be viewed by our residents after
their regularly scheduled viewing of this Village Board meeting.
Bath and Tennis Club Manager Sartore explained that the remodeling has
begun in the Clubhouse locker rooms and will be completed by next year. The
locker rooms have been painted, plumbing improved and the benches will be
recovered. Trustee Shumate asked that the maintenance storage area west of
the pool be used for a storage area rather than the locker rooms so that the
locker rooms will incur less damage from storage.
Trustee Caleel inquired of the $10,000 emergency repair of the pool and noted
the large expenditure. Bath and Tennis Club Manager Sartore explained that
these bills were from Riverside Plumbing for emergency repairs to the air
conditioning condenser units on the Clubhouse roof.

REQUEST FOR USE
The Village is in receipt of a letter from the Oak Brook Historical OF LOWER LEVEL
B p OF EXISTING
Society which requests a formal indication from the Village Board LIBRARY
concerning its position on future use of the lower level of the existing
Oak Brook Public Library by the Historical Society.
President Bushy remarked that William Watson, former Village
Trustee. has graciously chronicled resident's oral impressions mid
stories on the history of Oak Brook. He is presently the President of
the Oak Brook Historical Society and is organizing their society.

They wish to fend a locution to house their artifacts in which they may
catalog and sort their materials.
Trustee Bartecki asked that this request be deferred due to the
constraints of storage and space in the Village complex at this time.
The 'i rustees concurred in the support of the Oak Brook Historical
Society, but the Village is unable to take action at this time. The
Board would review this request again as the Village develops the
new Library and determines our needs, and then offer assistance.
