MEETING CALL: The Special Meeting of the Board of Trustees was called to order by President Bushy in the Samuel E. Dean Board Room of the Village Commons at 7:30 p.m. Pledge of Allegiance was given. ROLL CALL: The Village Clerk called the roll with the following persons PRESENT: President Bushy, Trustees Butler, Caleel, Craig, Kenny, McInerney and Savino. ABSENT: None. IN ATTENDANCE: Stephen B. Veitch, Village Manager; Michael A. Crotty, Assistant Village Manager; Richard A. Martens, Village Attorney; Ruth A. Martin, Library Director and Ronald Gall, Project Manager for Harbour Contractors, Incorporated. President Bushy noted the momentous event of this special meeting for the beginning phases of construction of the new Village Library. She acknowledged, on behalf of the residents of Oak Brook, the Village Board of Trustees for their level of diligence and attention to the projects presented to them during their term in office and especially the Library project. She commended Ruth Martin, Library Director, for her perseverance during these past six years in developing the Library. President Bushy remembered Paul Butler and his vision of the Sports Core property now that children will forever be using with a new Library. She also recognized a Butler family member, Adam Butler, who presently serves as the Library Liaison Trustee on the Village Board. The purpose of the Special Village Board of Trustee's Meeting was to take a series of actions necessary to begin construction of the new Oak Brook Public Library. The actions were as follows: I. Award of trade contracts for various "bid packages" to trade contractors. II. Rejection of bids (in certain cases), approval of allowances for items to be re -bid and approval of allowances for items yet to be bid. Rejection of bids (in certain cases) and approval of allowances for items to be provided or caused to be provided by the construction manager as "incidental" to construction. IV. Approval of allowances for miscellaneous other incidental items. V. Approval of the Agreement with the construction manager and the "Guaranteed Maximum Price" (GMP). VI. Assignment of trade contracts to the Construction Manager. AWARD OF TRADE CONTRACTS — OAK BROOK PUBLIC LIBRARY: I. AWARD OF TRADE CONTRACTS FOR VARIOUS "BID PACKAGES" TO TRADE CONTRACTORS: 1) Motion by Trustee Caleel, seconded by Trustee McInerney, that the Village award a contract to Terra Excavating, Inc., the lowest responsible bidder for Earthwork for the new Oak Brook Public Library in the amount of $143,900.00 and that the Village President and Village Clerk be authorized and directed to execute a contract with Terra Excavating, Inc., subject to staff review. ROLL CALL VOTE: Ayes: 6 - Trustees Butler, Caleel, Craig, Kenny, McInerney and Savino. Nays: 0 - None. Absent: 0 - None. Motion carried. 2) Motion by Trustee Caleel, seconded by Trustee McInerney, that the Village award a contract to Peerless Fence, the lowest responsible bidder for Fencing for the new Oak Brook Public Library in the amount of $36,554.00 and that the Village President and Village Clerk be authorized and directed to execute a contract with Peerless Fence, subject to staff review. Motion carried. 4) Motion by Trustee Caleel, seconded by Trustee McInerney, that the Village award a contract to D.L. Franzen Construction, the lowest responsible bidder for Asphalt Paving for the new Oak Brook Public Library in the amount of $106,329.00 and that the Village President and Village Clerk be authorized and directed to execute a contract with D.L. Franzen Construction, subject to staff review. ROLL CALL VOTE: Ayes: 6 - Trustees Butler, Caleel, Craig, Kenny, McInerney and Savino. Nays: 0 - None. Absent: 0 - None. Motion carried. 7) Motion by Trustee Caleel, seconded by Trustee Kenny, that the Village award a contract to Piazza Masonry, the lowest responsible bidder for Masonry for the new Oak Brook Public Library in the amount of $28,100.00 and that the Village President and Village Clerk be authorized and directed to execute a contract with Piazza Masonry, subject to staff review. Bowman Constructors, the lowest responsible bidder for Structural Steel /Metal for the new Oak Brook Public Library in the amount of $561,575.00 which includes Alternate #5, In -fill of sunscreen throughout, and that the Village President and Village Clerk be authorized and directed to execute a contract with T.A. Timbers, Inc., the lowest responsible bidder for Glue - Laminated Wood Decking for the new Oak Brook Public Library in the amount of $48,500.00 and that the Village President and Village Clerk be authorized and directed to execute a contract with W.W. Pokorny, the lowest responsible bidder for Finish Carpentry for the new Oak Brook Public Library in the amount of $150,000.00 and that the Village President and Village Clerk be authorized and directed to execute a contract with H.J. Motion carried. 16) Motion by Trustee Caleel, seconded by Trustee McInerney, that the Village award a contract to Chicago Drywall & Acoustical, the lowest responsible bidder for Rough Carpentry /Drywall for the new Oak Brook Public Library in the amount of $213,650.00 and that the Village President and Village Clerk be authorized and directed to execute a contract with Chicago Drywall & Acoustical, subject to staff review. Motion carried. 19) Motion by Trustee Caleel, seconded by Trustee McInerney, that the Village award a contract to DuPont Flooring Systems, the lowest responsible bidder for Flooring for the new Oak Brook Public Library in the amount of $83,000.00 which includes Alternate #4, Primary color accents in story room, and that the Village President and Village Clerk be authorized and directed to execute a contract with DuPont Flooring Systems, subject to staff review. Motion carried. 22) Motion by Trustee Caleel, seconded by Trustee McInerney, that the Village award a contract to Airtite Contractors, Inc., the lowest responsible bidder for Access Flooring for the new Oak Brook Public Library in the amount of $154,602.00 which includes a Voluntary Alternate to add stringers, and that the Village President and Village Clerk be authorized and directed to execute a contract with Airtite Contractors, Inc., subject to staff review. Motion carried. 35) Motion by Trustee Caleel, seconded by Trustee McInerney, that the Village award a contract to Parr Electric, Inc., the lowest responsible bidder for Electrical for the new Oak Brook Public Library in the amount of $415,500.00 and that the Village President and Village Clerk be authorized and directed to execute a contract with Parr Electric, Inc., subject to staff review. The sum of the contract prices for the trade contracts that were awarded was $3,353,734.00. The sum of the pre -bid estimates for these bid packages is $3,234,982.00. II. REJECTION OF BIDS (IN CERTAIN CASES), APPROVAL OF ALLOWANCES FOR ITEMS TO BE RE -BID AND APPROVAL OF ALLOWANCES FOR ITEMS YET TO BE BID: Special Meeting Minutes Page 8 of 17 November 2, 2000 VILLAGE OF OAK BROOK A. ITEMS TO BE RE -BID: 5) Motion by Trustee Caleel, seconded by Trustee McInerney, that the Village reject all bids for landscaping for the new Oak Brook Public Library, as the apparent low bid was incomplete and thereby non - responsive, the other bids exceeded the pre -bid estimate, and the public interest will be served by the rejection of all bids; I further move that this Board authorize staff to re -bid landscaping for the new Oak Brook Public Library and approve an allowance of $60,000 for landscaping for the new Oak Brook Public Library for purposes of establishing the guaranteed maximum price in the construction manager's contract with the Village. ROLL CALL VOTE: Ayes: 6 - Trustees Butler, Caleel, Craig, Kenny, McInerney and Savino. Nays: 0 - None. Absent: 0 - None. Motion carried. 6) Motion by Trustee Caleel, seconded by Trustee McInerney, that the Village reject all bids for Cast -In -Place Concrete for the new Oak Brook Public Library, as the bid received exceeded the pre -bid estimate and the public interest will be served by the rejection of all bids; I further move that this Board authorize staff to re -bid Cast -In -Place Concrete for the new Oak Brook Public Library and approve an allowance of $257,550 for Cast -In -Place Concrete for the new Oak Brook Public Library for the purposes of establishing the guaranteed maximum price in the construction manager's contract with the Village. Motion carried. 17) Motion by Trustee Caleel, seconded by Trustee McInerney, that this Board authorize staff to re -bid Ceramic Tile for the new Oak Brook Public Library, as no bids were received for this item and approve an allowance of $19,200 for Ceramic tile for the new Oak Brook Public Library for purposes of establishing the guaranteed maximum price in the construction manager's contract with the Village. ITEMS YET TO BE BID: Motion by Trustee Caleel, seconded by Trustee McInerney, that the Board approve an allowance of $355,000.00 for furnishing and equipment for the new Oak Brook Public Library for purposes of establishing the guaranteed maximum price in the construction manager's contract with the Village, and further, that staff seek bids for furnishings and equipment later in the project schedule. REJECTION OF BIDS (IN CERTAIN CASES) AND APPROVAL OF ALLOWANCES FOR ITEMS TO BE PROVIDED OR CAUSED TO BE PROVIDED BY THE CONSTRUCTION MANAGER AS "INCIDENTAL" TO CONSTRUCTION: 13) Motion by Trustee Caleel, seconded by Trustee McInerney, that the Village Board reject all bids for Security Partition for the new Oak Brook Public Library, as the apparent low bid was not responsive to the specifications, no other bids were received as the public interest will be served by the rejection of all bids; I further move that the Village waive further competitive bidding, and approve an allowance in the amount of $3,000.00 for inclusion in the construction manager's incidental construction costs which will be included in the construction manager's guaranteed maximum price. Special Meeting Minutes Page 10 of 17 November 2, 2000 VILLAGE OF OAK BROOK H 21) Motion by Trustee Caleel, seconded by Trustee McInerney, that the Village Board find that no bids were received for Toilet Accessories /Partitions for the new Oak Brook Public Library, and that the Village waive further competitive bidding for Toilet Accessories /Partitions and approve an allowance in the amount of $7,050.00 for inclusion in the construction manager's incidental construction costs which will be included in the construction manager's guaranteed maximum price. ROLL CALL VOTE: Ayes: 6 - Trustees Butler, Caleel, Craig, Kenny, McInerney and Savino. Nays: 0 - None. Absent: 0 - None. Motion carried. 23) Motion by Trustee Caleel, seconded by Trustee McInerney, that the Village Board reject all bids for Flagpoles for the new Oak Brook Public Library, as the sole bid received was not responsive to specifications and the public interest will be served by the rejection of all bids, and further, that the Village waive further competitive bidding and approve an allowance in the amount of $4,000.00 for inclusion in the construction manager's incidental construction costs which will be included in the construction manager's guaranteed price. Motion carried. 24) Motion by Trustee Caleel, seconded by Trustee McInerney, that the Village Board reject all bids for Signage for the new Oak Brook Public Library, as the sole bid received was incomplete and thereby non - responsive and the public interest will be served by the rejection of all bids, and further that the Village waive further competitive bidding and approve an allowance in the amount of $13,417.00 for inclusion in the construction manager's incidental construction costs which will be included in the construction manager's guaranteed maximum price. Motion carried. 25) Motion by Trustee Caleel, seconded by Trustee McInerney, that the Village Board find that no bids were received for Fire Extinguishers for the new Oak Brook Public Library, that the Board waives Special Meeting Minutes Page 11 of 17 November 2, 2000 VILLAGE OF OAK BROOK L6 further bidding, and approves an allowance in the amount of $750.00 for inclusion in the construction manager's incidental construction costs which will be included in the construction manager's guaranteed maximum price. Motion carried. 27) Motion by Trustee Caleel, seconded by Trustee McInerney, that the Village Board find that no bids were received for Building Specialties for the new Oak Brook Public Library, and I move that the Village waive further bidding, and approve an allowance in the amount of $5,440.00 for inclusion in the construction manager's incidental construction costs which will be included in the construction manager's guaranteed maximum price. Motion carried. 28) Motion by Trustee Caleel, seconded by Trustee McInerney, that the Village Board find that no bids were received for Appliances for the new Oak Brook Public Library, and I move that the Village waive further bidding and approve an allowance in the amount of $6,000.00 for inclusion in the construction manager's incidental construction costs which will be included in the construction manager's guaranteed maximum price. Motion carried. 29) Motion by Trustee Caleel, seconded by Trustee McInerney, that the Village Board find that no bids were received for Projection Screen for the new Oak Brook Public Library, and I move that the Board waive further bidding and approve an allowance in the amount for $1,490.00 for inclusion in the construction manager's incidental construction costs which will be included in the construction manager's guaranteed maximum price. APPROVAL OF ALLOWANCES FOR MISCELLANEOUS OTHER INCIDENTAL ITEMS: Motion by Trustee Caleel, seconded by Trustee McInerney, that the Village Board find that certain miscellaneous items involved in the construction of the new Oak Brook Public Library are most properly included in the construction manager's incidental construction costs to be included in the guaranteed maximum prices and accordingly, and I further move that the Village waive competitive bids and approve the following allowances totaling $172,982.00 for inclusion in the construction manager's incidental construction costs which will be included in the construction manager's guaranteed maximum price: Utility Connections, $67,000; Clean -Up Allowance, $20,000; Winter Protection Allowance, $20,000; Incidental Rough Carpentry (Site Safety), $20,000; Printing & Distribution Allowance, $10,000; Site Security Fencing, $10,000; Site Engineering/Layout, $10,000; Caulking and Sealants, $7,492; Recessed Floor Mats, $4,490 and Temporary Utilities, $4,000. These allowances are included in the construction manager's Incidental Construction Cost line item in the GMP. They total $172,982.00. APPROVAL OF AGREEMENT WITH THE CONSTRUCTION MANAGER AND THE "GUARANTEED MAXIMUM PRICE" (GMP The Guaranteed Maximum Price (GMP) is a key feature of the "at risk" construction management approach that the Village is taking to this project. The GMP is the sum of all trade contracts, other allowances, the construction manager's incidental construction, general conditions, insurance, bond costs, a construction contingency and, finally, the construction manager's fee. Variances from the allowances for incidental items will be applied to the construction contingency. Motion by Trustee Caleel, seconded by Trustee McInerney, that the Village waive competitive bids and approve an agreement, subject to staff review, with Harbour Contractors, Inc. for construction services, authorize the Village President and the Village Clerk to execute the agreement, and approve a guaranteed maximum price (GMP) in the amount of $4,991,100 computed as set forth on page 12 of Mr. Veitch's memorandum to the Board dated November 1, 2000, with the understanding that the GMP will be adjusted as allowances for items to be re -bid or yet to be bid become contract prices, are awarded by this Board and ultimately assigned to the construction manager and with the further understanding that any variances from the allowances for incidental items will be applied to the construction contingency. ASSIGNMENT OF TRADE CONTRACTS — OAK BROOK PUBLIC LIBRARY: VI. ASSIGNMENT OF TRADE CONTRACTS TO THE CONSTRUCTION MANAGER: As bids are received on the packages to be re -bid and yet to be bid, recommendations for award of contract will be brought to the Village Board together with recommendations that those contracts also be assigned to Harbour Contractors, pursuant to the Agreement. Motion by Trustee Caleel, seconded by Trustee McInerney, that, following the execution of the agreement between the Village (owner) and Harbour Contractors, Inc. (construction manager), the Village President and Village Clerk be authorized and directed to execute an assignment to Harbour Contractors, Inc. (the Village's construction manager), of each of the 23 trade contracts for the new Oak Brook Public Library which were previously awarded this evening. President Bushy explained that due to the amount of data and time constraints that staff were unable to place these items on the last regular Board meeting and requested a special meeting be called for the award of contracts so that construction could begin weather permitting. This meeting was also videotaped for the resident viewing, which will be cablecast with the regular Village Board meeting. President Bushy suggested the Village Board, by motion, request the Village Clerk to include these bid tabulations, memorandums and letter from Harbour Contractors be attached to the official minutes of this meeting. Motion by Trustee Caleel, seconded by Trustee Butler, that the Village Clerk attach the bid tabulations, memorandum and Harbour Contractors letter dated November 1, 2000 (revised) be attached to the official minutes of the Village Board. VOICE VOTE: Motion carried. President Bushy wanted to thank the residents of Oak Brook and especially, Joe Fullan, who was in attendance of this meeting for his years of support of this Library. She publicly commended the Village staff, Village Manager Veitch, Village Attorney Martens, Harbour Contractors and Ron Gall for the commitment of their company. Village Manager Veitch also recognized Marshall Olsen and Robert Bush in their contribution prior to the involvement of Mr. Gall in the project. Trustee Caleel thanked Roberta Petz, Barbara Benezra and Anthony Ingrisano as members of the Library Commission for their years of service to the Library. 5.
