Dean Board Room of the Village Commons at 7:32 p.m. Pledge of Allegiance was given. The Clerk called the roll with the following persons PRESENT: President Bushy. He remarked that George Mueller has annually organized the Great Lakes naval recruits visiting Oak Brook for Thanksgiving Day with our residents. He asked the newspapers to publish this event and requested residents to contact Mr. Mueller if they wish to have a recruit spend the day with their family. President Bushy explained the recruits are brought to the Village Hall for refreshments and to meet their host family for the day. The recruits are then brought back that evening to the Village Hall for their return to the base. President Bushy noted from the recently concluded election that candidate signs were still posted in the Village. She asked the candidates to please remove them. Signs are legal in Oak Brook, if they are not located in the public right -of -way, but are required to be removed after election night. ORDINANCE 97-TO-RR-G-601 AUICLE Y1 ENTITLED r , , • 11 ORDINANCES OF THE VILLAGE QE OAK BRQ(-)K: The ordinance replaces Article `,' of Chapter 8 of the Code and puts in place an amended and restated set of regulations regarding possession and sale of tobacco products in the Village. It was developed as part of the continuing project to review and update the Code of Ordinances, circulated for comments and discussed at the Regular meeting of October 28, 1997. Many of the provisions of the new ordinance are substantively similar to those in the current Article VI (e.g., requirements for obtaining tobacco dealer's licenses, unlawful sale to persons under 18, unlawful posses, ion, etc.). New provisions include twice yearly inspections of licensed establishments (Section 8 -191), unlawful misrepresentation of age (Section 8 -194), unlawful = by minors (Section 8 -195), and regulation of the placement of vending machines within licensed establishments (Section 8 -200). A number of other provisions have been modernized and improved. In total, the ordinance constitutes an update of this article which is designed to nuke it more effective in fulfilling its historical purpose, preventing access to tobacco products by minors. The ordinance provides a new licensing structure for residential and commercial scavenger service. The adoption of this ordinance will provide for the availability of only one residential scavenger license and an unlimited number of commercial scavenger licenses, provided certain standards are met (e.g., performance bond, insurance requirement, proof of adequate and acceptable vehicles, customer service provisions, etc.). This structure is consistent with the previously approved Residential Municipal Waste Collection Contract commencing January 1, 1998, and with direction given by the Board at the last meeting. The license will run from January 1 to December 31, commencing in 1998. This ordinance constitutes a change in the current licensing structure whereby three licenses are issued, and each license allows for both residential and comInf rcial collection. E P1113LIC; LIBRARY: MANAGEMENT POLICY FOR LIBRARY The Collection Management Policy and the disposal of collection materials portion of the Illinois Local Library Act were first adopted by the Board in 1995. In conformance with Serving Our Public, the VILLAGE OF OAK BROOK Minutes 4 of 18 November 11, 1997 t ,tyke Illinois public library benchroarking tool, this policy requires biennial review by the Library Commission with revisions to be approved by the Village Board. The Collection Management Policy describes the community to be served. identifies the purpose of the collection; assigns responsibility for collection management and sets parameters including subject areas, formats and depth of collection. It also states the criteria used by the institution for selecting, replacing, withdrawing and disposing of collection materials. It addresses gifts, requests for purchasing materials, requests for reconsidering materials already in the collection and intellectual fi•eedom philosophy. The Library Commission and Library Director have worked through this policy and recommend the changes as presented in the redlined copy circulated to the Board on October 31, 1997. The changes are primarily language usage and removing repetitions. Mr. John Birch, 3412 Adams Road, asked for a clarification of pornographic materials being allowed in the Village Library. Library Director Martin explained that professional librarians are responsible for determining available materials in our Library. Residents, if they determine material to be inappropriate for our Library, may file for a reconsideration of its content by the Library. The Library Commission, appointed by the Village Board of Trustees and whose members are Oak Brook residents, know the procedures for this, also. 14L VQ01111till 9119164 M The ordinance authorizes execution of a Traffic Enforcement Agreement with the Midwest Club Subdivision. This agreement authorizes the Village's police officers to enforce certain speeding, stop sign, and street obstruction regulations when requested by the Midwest Club homeowners Association. "The ordinance (1) amends Chapter 3 of the Oak Brook Code (Alcoholic Liquor) to establish a new liquor license classification (Class G) for municipally owned and operated recreational facilities; (21 creates two Class G licenses for issuance on the Oak Brook Sports Cur,:; and (3) amends the penalty provision of the liquor ordinance to make licensees who violate the ordinance responsible for the costs of violation hearings. President Bushy explained that the State of Illinois Liquor Control Commission has requested the Village change the liquor license for the Oak Brook Bath & Tennis Club and the Oak Brook Golf Club to individual licenses. A local liquor license is required for obtaining a State liquor license. Since these two facilities did not meet the criteria of classifications in the ordinance, a new Class G has been established. An amendment to the ordinance has also been est,-Wished relating to any violations of this ordinance. Violations will result in the licensed establishment being responsible i'or the cost of any violation hearings. Absent: 1 - Trogtee Shumate. Motion carried. :.•:� MICROFILMING Bid packages were picked up by three (3) firms. One (1) sealed bid was received on October 29, 1997. One company is no longer microfilming records (instead has shifted to recording documents on CD) and the other lacked resources to meet Village requirements. Vital Record Banc is the Village's current contractor, acquired through a similar bid process three years ago, and has continued to give good service. Pi:cing will remain constant for the three -year term of the contract. Some of the unit costs remain the same as the Village's previous contract, and others have increased less than 3% per year. Microfilming is required by the State of Illinois for the retention of Village records. The period of required retention varies based on the type of document. The Village only microfilms those items which are required to be maintained for greater than three years. Shorter term documents are stored in boxes and then disposed of as permitted by the State. Village departments ,vliich microfilm include Administration, Engineering, Finance, Purchasing, Legal, Library and Police. Adequate funds are budgeted annually in each of these areas to cover anticipated microfilming. VILLAGE OF OAK BROOK Minutes 7 of 18 November 11, 1997 4 Bid packages were picked up by six (6) firms. Two (2) scaled bids were received on October 29, 1997. The one other bid was submitted by Yonan Floor Coverings for a total cost of $27,500. Barsamian- Barkho comes highly recommended from north suburban municipalities, where they have done much of their work. This project will be coordinated with the replacement of auditorium seating. Both contractors will need to work closely to make sure that use of the Board Room is disrupted for the shortest period of time possible. Barsamian- Barkho indicates that the Board Room carpet replacement (carpet and pad), filling of seating anchor holes, and new carpet installation will take eight working days. The remaining glue - dow-n carpet work will take one day. Commencement of the carpet work will need to await delivery of the new auditorium seating. Funds in the amount of $25,000 have been budget in the Municipal Building Improvements Program (01 -4201) for this work. Motion by Trustee Bartecki, seconded by Trustee Caleel, to award a contract, subject to staff review, to the lowest responsible bidder, Barsamian- Barkho Floors, Inc., Skokie, for the replacement of carpeting in the `Tillage Board Room, Upper and Lower Level Conference Rooms, lower level hallway and connecting stairway, at a total cost of $23,980. The Village Board, at its meeting of October 14, 1997, waived bidding and authorized staff to negotiate with JG Furniture Group for the replacement of auditorium seating and the supply of staff tables and chairs in the Board Room. JG Furniture Group is the manufacturer of the original Board Room auditorium seating, and by using their replacement seating for this project, the Village's cost is lower than if staff were to bid the total replacement (including seating frames) with a different firm. JG plans to reuse the existing seat frames, reinstalling them following carpet replacement (setting new anchor holes) and replacing the seats, arms, and seat backs with new material. Aside From labor and delivery costs, the cost proposed for the chairs and tables is 39% of list. This project will be coordinated with the carpet replacement and will not begin until all necessary supplies have been received. The lead time for receiving the seating supplies will likely be 10 -12 weeks, but could be as long as 17 weeks following placement of order. Both contractors will need to work closely to make sure that use of the Board Room is disrupted for the shortlzst period of time possible. Although this work was not budgeted this year, replacement of the seating in conjunction with the carpet is highly recommended. To wait until a later date to replace the seating (24 years old, original with the Village Hall) would be difficult, as it would require carpet patching of all the ol(I lead anchor seating supports. Resources to complete this work are reflected in the proposed 1998 Budget, split between the 1997 estimate and 1998 budget columns. Motion by Trustee McInerney, seconded by Trustee Bartecki, to award a contract, subject to staff review, to JG Furniture Group, Inc., Chicago, for the replacement of auditorium seating and supply of staff tables and chairs in the Village Board Room, at a total cost of $44.390. SAFETY PATHWAY - YORK ROAD BIKE 101NT AGREEMENT WITH IDOT FOR PI IASE III: PA`rH - JOINT .AGREEMENT WITH The Local Agency Agreement for Federal Participation (referred to as IDOT FOR the Joint Agreement) is a standard part of the process and depicts the PHASE III cost sharing arrangement between the Federal Highway Administration, the Illinois Department of Transportation (IDOT) and the Village. The Village's estimated share is $25,000 for VILLAGE OF OAK BROOK Minutes 9 of 18 November 11, 1997 U construction and $2,500 for engineering construction services. The 1997 Budget contains $35,000 for this construction project ($24,000 for construction (the Village's share of the construction contract) and $11,000 for engineering services (the Village pays the initial full amount and receives back 75/0 of the engineering costs from IDOT)). Since this project has taken longer than anticipated and it will not be constructed until spring 1998, the proposed 1998 Budget contains $29,000 for construction and $19,950 for engineering services (which will be offset by reimbursement from IDOT). The current construction estimate is $105,000 and the engineering inspection contract will not exceed $15,000. The Joint Agreement does not need to be changed to reflect these minor differences, and tine percentages will govern. Motion by Trustee Bartecki, seconded by Trustee Savino, to approve the "Illinois Department of Transportation Local Agency Agreement For Federal Participation" (known as the Joint Agreement) for the York Road Bicycle Trail for Phase III and direct the Village President to affix her signature thereon. The Village Board, at their meeting of November 12, 1996, approved the Phase II Engineering Services Agreement with Civiltech Engineering, Inc., to design plans and specifications for the York Road Bicycle /Pedes[rian Trail. That work has been accomplished and the next step is to have an agreement with an engineering consultant to perform Phase III Inspection Services. Since Civiltech is most familiar with this project, the Village Engineer asked them to submit an agreement to perform the Phase III Services. The Village sent this draft agreement to the Illinois Department of Transportation (IDOT) for their initial review to which they responded with minor comments and asked staff to submit four copies of the agreement executed by the Village for further processing. This project is pant of a STP -TCM Federal /IDOT Grant for both engineering and construction. Consistent with this tradition, it is recommended that the Village Board cancel its meeting of December 23, 1997. DEPARTMENTAL RFPORIS - LIAISON ASSIG DEPARTMENTAL REPORTS Engine. �ri.�,: Trustee Bartecki - Most of the 22nd Street/York Road project is underway. Due to traffic congestion, staff is reviewing ways to mitigate this congestion in the future without compromising safety. Trustee Bartecki suggested residents use alternate routes. Finance and Hotel Commillge: Trustee McInerney - Most of the Finance Department's time has been spent completing the 1998 Municipal Budget. Staff has spent a significant amount of time with the upcoming conversion of the payroll system. This has been delayed due to a scheduling conflict with our computer vendor. Eir&: Trustee Kenny - The Fire Department responded to 181 emergency fire and rescue calls during the Month of October. Of those, 99 were fire - related calls and 82 were ambulance calls. Mutual aid was given to other communities for 6 fire calls and 3 ambulance calls. Mutual aid was received from other communities for 2 fire calls and 6 ambulance calls. On October 12, Oak Brook firefighters extinguished a house fire with minor damage. A Fire Department open house was held Saturday. October 5 at Station #1. Approximately 50 adults and children participated. Eight public fire safety education classes were given during Fire Prevention Month including 6 schools. Nordstrom's hosted 35 students from Elmhurst for one of these fire safety presentations. Monthly Officer Professional Development Sessions were initiated in October, and the first session covered budget preparation and departmental procedures. She has been asked to be a participant in a joint conference of metropolitan Chicago councils of government with Mayor Daley for developing methods to benefit the City of Chicago and its suburbs. They will be reviewing the economic health of the entire region and any problem areas such as the congestion of the Eisenhower Expressway. Bath and Tennis Club - The Club hosted 200 participants during a very successful children's Halloween party which included a spook walk through the Sports Core property, a bonfire with ghost stories told by witches, and an exotic petting zoo. The Club also sponsored its first ladies night out which featured a flower arranging demonstration by Russ Phillips of Phillip's Florists, as well as a dinner prepared by Chef Bryan. TO YORK ROAD) CONSTRUCTION PROJECT 0 The agreement provides that DuPage Comity will: 1. Complete all improvements according to the project plans; 2. Pay all costs and expenses for the improvements including a new bike path, rebuilding Bath & Tennis Drive, water main relocation, stormwater detention and compensatory storage. (The cost of preemption equipment for the new traffic signal would be the Village's responsibility, as is the normal case); 3. Obtain all necessary permits for the project; and 4. Compensate the Village for right -of -way as provided in Exhibit C attached to Village Manager Veitch's memo dated November 6, 1997. In turn, the agreement provides that the Village will: 1. Convey its interests in the various parcels of right -of -way; 2. Provide certain other temporary easements (shown on the plans) for the bike path and compensatory storage area, 3. Assume maintenance and jurisdiction of Spring Road (a formality, since both agencies have assumed that fact for many years); and 4. Allow all turning movements at the 31 st/Spring Road intersection with the exception of the evening right turn restriction from eastbound 31 st to southbound Spring. The reason for this last provision, of course, is that warrants for a traffic signal at the 31 st /Spring intersection are not met if the current restrictions are maintained. The County's initial position was that all restrictions had to be removed, but they have agreed to permit the evening peak period prohibition on right turns from eastbound 31 st to southbound Spring Road. With removal of the physical barrier, the Board might want to consider exempting school buses from the right turn restriction, as is the case at other locations where similar restrictions exist. It is important that left turns not be restricted because, in addition to the effect on signal warrants, restrictions on left turns into or out of Spring Road would introduce serious safety concerns. An unsafe condition would be created b} vehicles entering a left turn lane, only to discover that the left turn movement could not be completed. The Village has the option of maintaining the current restrictions if it is willing to forgo the traffic signal. Village Manager Veitch indicated that if the traffic signal installation was eliminated, DuPage County would stripe out the left turn lane on Oak Brook Road at the Spring Road intersection. Trustee Caleel requested, since DuPage County will install the conduit for the traffic signal now, to negotiate with them the possibility of a signal installation for the near future. Motion by Trustee Caleel, seconded by Trustee McInerney, to authorize and direct the Village Manager to negotiate amendment to agreement as submitted to delete traffic signal at 31 st Street and Spring Road and retain the existing traffic regulations. Birch, Jr., Patricia and Jon Carlson, Peggy Vendel and a telephone call from Mr. Arnashus. President Bushy asked for citizen comments, and the following residents addressed their concerns to the Board of Trustees: Gerald Vetterick, 6 Natoma, requested the Board to consider installation of the signal for easier access to Oak Brook Road in the late afternoon for those who attend the Park District facilities and Library. He asked for a compromise of the signal installation and then remove it if the affected residents were not satisfied. He further suggested if that option was not agreeable, then change the restricted hours of the gate to 4:30 p.m. through 6:30 p.m., as the bus may not access Spring Road to bring school children home. Children must ride the bus further to an alternate route to enter Spring Road. Formerly, he had requested stop signs along Natoma, Adams and Spring Road, but Village Manager Veitch indicated they were not warranted due to the amount of traffic. Dr. Raymond Dunn, President of the Hunter Trails Homeowners Association, agreed with Mr. Vetterick as their residents have difficulty getting out of their subdivision due to the short timing of the signal at their entrance. He requested that a signal at Oak Brook Road and Spring Road could be synchronized with periodic turns. He further requested a trial basis of turning the signal off and installing signage. She asked the Board to consider the character of their neighborhood, and they could review the timing of the gates. Mario Vescovi, 3625 Madison, stated the Board's decision would impact the property value of these residents. David Pequet, 3719 Madison. clarified that the gate restrictions were removed before and it was dangerous for the school children when the buses arrived, as there are no street shoulders. John Birch, 3412 Adams Road, commented that Spring Road is a taxpayer funded road for the people. He again requested the light, as he resents his child riding a bus longer due to the gate restriction of access to Spring Road. President Bushy recessed the Village Board meeting at 9:27 p.m. due to a change in the video tape of the meeting telecast. The meeting convened at 9:37 p.m. Robert Waite, 3609 Madison, submitted signatures of area residents who requested the gate installation remain. He explained the early setting of the gate was for protection to the children coming home from school, since there are no roadway shoulders for them to walk on. President Bushy remarked that the Village of Oak Brook is neither a proponent or opponent of the gate and signal installation. The Village wanted public comment without the staff determining a summary judgment of this issue. Former Trustee, Joseph Rush, noted that the Village of Hinsdale has calibrated their signal at Ogden Avenue and York Road to the extent passible for allowing left turns onto Ogden Avenue. President Bushy requested Fire Chief Jarvis to investigate the number of automobile accidents at the Spring Road/Oak Brook Road intersection.
