Minutes - 11/14/2000 - Board of TrusteesVILLAGE OF OAK BROOK MINUTES OF THE NOVEMBER 14, 2000 CANVASSING BOARD FOR THE NOVEMBER 7, 2000 GENERAL ELECTION APPROVED AS WRITTEN X OR APPROVED AS AMENDED ON December 12, 2000. The Local Canvassing Board of the Village of Oak Brook, comprised of Village President Karen M. Bushy, Village Clerk Linda K. Gonnella and Village Trustee Gerald O. McInerney, met on November 14, 2000 at 7:34 p.m. in the Samuel E. Dean Board Room of the Village Commons for the purpose of canvassing the votes cast in the General Election of November 7, 2000. The local newspapers were notified by mail on November 2, 2000, and said canvass was held in all respects as prescribed by law. It is noted that a senior Trustee is to serve on the Canvassing Board. Presently, Trustee Kenny and Trustee McInerney are the senior Trustees. As prescribed by law, a lot was drawn and Trustee McInerney was chosen by lot to serve as the senior Trustee of the Village Board to the Canvassing Board. The Canvassing Board was in receipt of votes cast in the sixteen (16) precincts as tabulated by the DuPage Election Commission and the one (1) precinct as tabulated by the Cook County Clerk. No other means of verifying the authenticity of votes cast was made available. President Bushy read the vote totals for each of the precincts. President Bushy stated that 4,572 votes were cast in the sixteen (16) precincts of DuPage County, with 3,210 votes in favor and 1,362 votes against, and 5 votes were cast in Cook County, with 3 votes in favor and 2 votes against, and that the total votes cast were as follows: QUESTION OF PUBLIC POLICY: "Shall the Village of Oak Brook Be Authorized to Sell to the County of DuPage Not More than 4.2 Acres of Real Estate in The Oak Brook Sports Core in the Village of Oak Brook Along and Adjacent to Oak Brook Road (31St Street) to Four Lanes, with Left Turn Lanes, a Landscaped Median and New Bridge Over Salt Creek, the Proceeds of Sale to be Use for Capital Improvements in the Oak Brook Sports Core ?" VOTES RECEIVED IN FAVOR AGAINST 3,213 1,364 President Bushy read Resolution #2000- EL- CR -EXI -R -758, "A Resolution Declaring the Results of the General Election Held on the Advisory Question of Public Policy in the Village of Oak Brook on November 7, 2000 in its entirety." Village of Oak Brook Minutes of Canvass of Votes Page 1 of 2 R, November 14, 2000 Village Attorney Martens clarified in the second Whereas clause of the Resolution that it should read: "WHEREAS, the Illinois Election Code provides in relevant part that the Canvassing Board for a Village shall consist of the Village President, the Village Clerk and one member of the Board of Trustees who has served the longest on the Board, in this case determined by lot pursuant to statute, as the two senior Trustees have the same tenure on the Village Board; ". Motion by President Bushy, seconded by Trustee McInerney, to approve Resolution 92000- EL- CR -EXI -R -758, "A Resolution Declaring the Results of the General Election Held on the Advisory Question of Public Policy in the Village of Oak Brook on November 7, 2000" as amended. ROLL CALL VOTE: Ayes: 3 — President Bushy, Trustee McInerney and Clerk Gonnella. Nays: 0 — None. Motion carried. President Bushy recessed the Canvassing Board at 7:45 p.m. so that the written Resolution could be revised as passed by the Board. President Bushy reconvened the meeting at 7:58 p.m. so that the Resolution could be signed. She then read into the record the Cook County Abstract of Votes of which a copy is attached to the official minutes. Motion by Trustee McInerney, seconded by Clerk Gonnella, to approve the execution and certification of the Cook County Abstract of Votes of the November 7, 2000 General Election as presented. ROLL CALL VOTE: Ayes: 3 — President Bushy, Trustee McInerney and Clerk Gonnella. Nays: 0 — None. Motion carried. The Canvassing Board of the Village of Oak Brook, DuPage and Cook Counties, Illinois, proclaimed and declared that the votes in favor of this advisory question of public policy have prevailed and that this Canvassing Board declared the adoption of this advisory question of public policy. Village Attorney Martens noted for the record that there are 6,233 registered voters in DuPage County and Clerk Gonnella noted there are six registered voters in the Cook County portion of the Village of Oak Brook. Gonnella, CMC Village Clerk Village of Oak Brook Minutes of Canvass of Votes 210 Page 2 of 2 November 14, 2000 RESOLUTION #2000-EL-CR-EX I -R-758 A RESOLUTION DECLARING THE RESULTS OF THE GENERAL ELECTION HELD ON THE ADVISORY QUESTION OF PUBLIC POLICY IN THE VILLAGE OF OAK BROOK ON NOVEMBER 7, 2000 WHEREAS, on November 7, 2000, there was held in and for the Village of Oak Brook, DuPage and Cook Counties, Illinois, an election for the purpose of voting on the advisory question of public policy, "Shall the Village of Oak Brook be Authorized to Sell to the County of DuPage Not More than 4.2 Acres of Real Estate in the Oak Brook Sports Core in the Village of Oak Brook Along and Adjacent to Oak Brook Road (3131 Street) at a Price Not Less than $835,000 for the Principal Purpose of Improving Oak Brook Road (31" Street) to Four Lanes, with Left Turn Lanes, a Landscaped Median and New Bridge Over Salt Creek, the Proceeds of Sale to be Used for Capital Improvements in the Oak Brook Sports Core?"; and WHEREAS, the Illinois Election Code provides in relevant part that the Canvassing Board for a Village shall consist of the Village President, the Village Clerk and one member of the Board of Trustees who has served the longest on the Board, in this case as determined by lot pursuant to statute, as the two senior Trustees have the same tenure on the Village Board (collectively "the Canvassing Board "); and WHEREAS, the said election has been regularly called and held as provided by law, and the returns of said election, including the Certificate of Results for the General Election, November 7, 2000, have been filed with the Village Clerk of the Village of Oak Brook; and WHEREAS, the results of the November 7, 2000 General Election are now before the Canvassing Board of the Village of Oak Brook for the purpose of canvassing the votes cast at said election and declaring the results of said election and the said Canvassing Board is familiar therewith; NOW, THEREFORE, BE IT RESOLVED, by the Canvassing Board of the Village of Oak Brook, DuPage and Cook Counties, Illinois as follows: SECTION ONE: That the election held on November 7, 2000, was held in all respects as provided by law. Notice of said election was duly given by each of the County Clerks of DuPage and Cook Counties by publishing Notices of Election as required by law in newspapers of general circulation within the Village of Oak Brook. The Judges appointed by the County Clerks of DuPage and Cook Counties were duly qualified to fill such offices in each of the precincts and were duly sworn to perform their duties before the commencement of said election. ANNOUNCEMENTS AND OPEN FORUM: ANNOUNCE & FORUM President Bushy publicly thanked the 3,213 residents for voter approval of the public question to widen 31 st Street. She stated these residents understood the need and value of widening the roadway for public safety vehicles to pass through safely and swiftly. She further thanked Constantine Xinos, Arthur Hascek and Joe Fullan for their passing of petitions to have the public question placed on the November 7, 2000 General Election ballot. The plan for the Village presently is for the Village to re -enter into an agreement with DuPage County. The maintenance presently being done on 31St Street is for maintaining the roadway surface during the winter months. These lanes will remain open during the construction of the north half of the westbound bridge. Then the westbound lanes will be constructed and the traffic will move to the westbound lanes and removal of the eastbound lanes will occur and be rebuilt. President Bushy commented on the expansion of Midwest Road. She stated that Brook Forest residents have contacted the Village about their concern of the number of trees being removed on the east side of Midwest Road. She explained that the Village Board tried to have the road moved in a westerly VILLAGE OF OAK BROOK Minutes Page 1 of 13 November 14, 2000 direction so the ten feet of green space would have remained on the east side of the road and the bicycle pathway would have been on the Brook Forest side of the street. This would have saved a considerable number of trees and green space on east side of the roadway. Unfortunately, some Brook Forest residents who were against this prevailed with the DuPage County Board. 3. President Bushy noted the need for improvement of technology in the Village whereby residents would have access to high speed Internet connections. The Village has been working with AT &T Broadband and their last indication is that this service should be available at the end of the year. There are residents interested in being served by Ameritech with a DSL line capability. She has received requests from volunteers in the Village who are willing to work with AT &T, Ameritech or other providers of this service to determine what services are needed and how to advance Oak Brook into this area. She suggested these citizens meet informally with staff to determine their needs, concerns and then determine how to address their issues. The Board concurred with this recommendation and they will be informed of what occurs. Trustee Savino asked Village Manager Veitch to address the work being done in Westchester Park as a resident inquired into what is occurring. Village Manager Veitch explained that work has begun on the land modifications associated with the public improvements for the Sports Core Westchester Park subdivision that the Village is developing, which will lead to the sale of the three lots. 4. APPROVAL OF MINUTES: Motion by Trustee McInerney, seconded by Trustee Caleel, to approve the minutes of the Regular Board of Trustees Meeting of October 24, 2000 as presented and waive the full reading thereof. VILLAGE OF OAK BROOK Minutes Page 5 of 13 November 14, 2000 B. 5) RESOLUTION #2000 -TX- PRPTY -EXP -EX2 -R -759 RES #00 -TX- RESOLUTION AUTHORIZING THE EXECUTION OF A PRPTY -EXP- CONTRACT FOR THE SALE OF PUBLIC REAL ESTATE TO EX2 -R -759 DUPAGE MAYORS AND MANAGERS CONFERENCE PUB R.E. (1220 OAK BROOK ROAD, OAK BROOK, IL 60523): 1220 oB RD The property consists of Lot 1 of the International Association of Y's Men's Clubs Assessment Plat (0.722 acres) and Lot 82 of the Forest Gate Subdivision (0.196 acres). The total land area is 0.918 acres (40,007 square feet). The property is zoned R -3 Single Family Detached Resident District and is covered by a special use (on Lot 1) for a governmental service facility. The existing structure on Lot 1 contains 2,793 square feet of floor area plus a partial basement used for storage. Lot 1 has always taken its primary access from the larger tract to its west (formerly known as "Village Green ") which has since become the Forest Gate Subdivision. As part of the subdivision and special use approval process for Forest Gate, it was determined that a small out -lot (Lot 82) would be deeded to the Village in order to maintain this access. Forest Gate retains the right to use Lot 82 for construction access and for emergency access thereafter. The proposed transaction has several advantages for the Village: • It generates substantial funds for the Municipal Complex Project. • Control over use is maintained through zoning, special use and right of first refusal. • It ensures that the DuPage Mayors and Managers Conference will remain in Oak Brook for the foreseeable future. The Village benefits substantially from its involvement in the Conference and from the proximity of the Conference's offices to the Village's offices. The sale will be contingent on the Conference obtaining: 1. Necessary financing. 2. A Zoning Ordinance text amendment to clarify that "governmental service facility" specifically includes intergovernmental and quasi - governmental organizations such as the Conference. 3. An amendment to the existing special use for the proposed expansion of the building and additional improvements to the site. 4. A building permit. President Bushy noted that the Village retains a right of first refusal should the Conference decide to sell the property in the future. Staff VILLAGE OF OAK BROOK Minutes Page 6 of 13 November 14, 2000 1�__) has determined that it is not feasible to use the facility for Village operations, as only one Village department could be accommodated in that building, it has limited access and is far removed from other departments. 7. B.S. Village Manager Veitch explained the sale price is $485,000, which is the average of two appraisals. Pursuant to State Statute the Village may not sell the property through this type of procedure for less than 80% of the property's appraised value. Separately, the parties have agreed on a credit for property improvements previously paid for by the Conference in the amount of $115,000. That amount is slightly less than the compensation which would be payable under the existing lease if the Village were to terminate it now. This results in a net amount of $370,000. In 1991, the Conference invested over $250,000 in the property with approximately $130,000 of that amount used to improve the site, repair the exterior of the building and perform major work on mechanical, electrical and plumbing systems. The remainder was spent on interior leasehold improvements. The amount of compensation that would be due, if the Village were to terminate the lease, would be approximately $117,000. Trustee Savino requested drafting a contract where at the end of the current lease, the Conference has the option to purchase the property at the appraised value. The Board discussed further the issue of the $115,000 credit given the Conference. President Bushy noted that, under its current zoning, only another governmental agency or quasi - governmental body could purchase this property. She stated the Village has benefited more from having the DuPage Mayors & Managers Conference than having them elsewhere. Our larger home -rule communities, whether through financing or other mechanisms available through home -rule, have frequently assisted the Conference more than the Village has been asked. Lynn Montei, Executive Director, DuPage Mayors and Managers Conference addressed the Village Board. She explained that the property improvements that are still outstanding are, in the Conference's view, owed to the cities and villages of DuPage County who funded the repair of a building that was in deplorable condition. That has not, in the view of those who negotiated the agreement, been retired as of yet. They believe that the $115,000 represents funds expended improvements on the Village of Oak Brook's behalf. Trustee Savino recommended that staff discusses this further with the Conference and presents a different proposal to the Village Board. President Bushy indicated that staff has done that and if this is not approved that the Conference will move to another site in order to expand. Motion by Trustee Caleel, seconded by Trustee Kenny, to approve the sales contract provided the right of first refusal is modified to include $115,000 credit if the Village elects to exercise the right. Village Attorney Martens clarified that in the fourth paragraph, last sentence of the rider, would then read: "At the closing, Purchaser shall execute and record a right in favor of seller to purchase the subject property on the same terms as a new purchaser less a credit of $115,000." Village Attorney Martens further indicated that the Conference's attorney had agreed to delete the requirement that the Village provide extended coverage on the Title Insurance Policy. When the requests were issued, it was not anticipated that purchases from any one vendor would exceed $10,000.00. Funds in the amount of $20,000.00 have been budgeted for the purchase of this equipment. C. 3) BATH & TENNIS CLUBHOUSE PROJECT: B &T PRJ Ten companies, of which eight submitted bids, picked up bid packages. The low base bid submitted by Sigalos and Associates was $1,588.000.00. Sigalos subsequently negotiated a reduced base bid with his subcontractors for a revised base bid of $1,581,376.00. In addition, a letter from Larson - Kramer & Associates (Project Architects) recommends the acceptance of various alternates and reductions resulting in a revised total bid price of $1,520,000.00. Alternates #5, 7 and 17 were changed in scope after review of the low bid. A revised project schedule will be issued upon receipt of permits. Substantial completion is anticipated by June, 2001. Peter Kramer, Architect, Kramer, Larson & Associates, presented the various alternates and reductions in the revised bid proposal to the Village Board. EMERGENCY WATER INTERCONNECTION AGREEMENT - EMGNCY x20 ELMHURST: INTCN AGRMT ELMURST Staff has reached agreement with the City of Elmhurst for an emergency water interconnection at the southeast corner of Butterfield Road and Knighton Court. This emergency connection would provide a means of serving the Yorkfield area (certificated area north of Roosevelt Road and west of I -88 spur) in the event of a problem with either of the two mains that run under Roosevelt Road to serve this area. The agreement is substantially identical to similar agreements the Village has in place with the Villages of Lombard, Downers Grove, Westmont, Hinsdale and Hillside.
