1. MEETING CALL:
The Regular Meeting of the Board of Trustees was called to order by President
Bushy in the Samuel E. Dean Board Room of the Village Commons at
7:31 p.m. Pledge of Allegiance was given.
2. ROLL CALL:
The Village Clerk called the roll with the following persons
PRESENT: President Bushy, Trustees Caleel, Kenny, McInerney and Savino.
ABSENT: Trustees Butler and Craig.

3. ANNOUNCEMENTS & OPEN FORUM:
Trustee Caleel commented on a recent newspaper article of the plans of the
DuPage Forest Preserve selling the Friary to the DuPage Housing Authority for
one dollar. He recalled a referendum of a 575,000,000 bond issue that was to
directly keep this as open space for people of DuPage County. The article
indicated the Housing Authority would have to issue $ 15- 20,000,000 worth of
revenue bonds to subsidize the cost of rehabilitation of that facility. His only
comment is that it did not strike him as being appropriate as from the intent of
the referendum.
President Bushy indicated that the Village has written to DuPage County and
the Housing Authority to inform them that the property is currently zoned
conservation/recreation, which does not include a housing component. The
Village has strongly suggested that before they continue much further that they
be in contact with our Community Development Department or Village
Manager for clarification and understanding of the Village's processes.
Village Manager Veitch remarked that Community Development Director
Kallien has been in contact with the Executive Director of the Housing

OPEN FORUM
Authority to coordinate a meeting with the Village Manager, Director Kallien
and the Housing Authority. He suggested from his reading of the article, that it
appears at a minimum that the project would require approval of a subdivision,
approval of rezoning, approval of a zoning ordinance text amendment and
probably approval of a special use pursuant to that text amendment.
Trustee Caleel noted in the latest Civic Association Newsletter several
inaccuracies that he" recommended be corrected. A statement was made that
the property along 31" Street is going to be condemned which is incorrect. He
asked that the Village write a letter to the Association to correct this and
reproduce another article that is more in keeping with what actually exists.
Trustee McInerney noted the reporting of the Village Board meeting by Phil
Mayer. He made editorial comments concerning the telecommunication tax.
Trustee McInerney explained that there are meetings held throughout the year
such as the budget meeting and the Five Year Financial Plan where the public
does not attend, only the Village Board members and staff. This is an example
of a meeting where we held four discussions concerning this issue. The current
tax is on local and interstate telephone calls and the telecommunication tax will
allow the Village to tax cellular and intrastate telephone calls. The revenue
stream will come mostly from the business and community sectors and the
benefit will accrue to mainly the business and commercial sectors primarily
due to increased fire and ambulance staffing which was also discussed
concurrently with this. In regard to the editorial comment of the Villages
lawsuits; "prior Village Boards had always adopted the policy that this is Oak
Brook and that you better sue us as we are not going to cooperate with
anyone," Trustee McInerney indicated is a foolish comment. Governments
ought to agree what is the highest and best use for its citizens and that is what
the Village Board attempted to do on 31" Street.
He voiced his concern of the overall issues of e- commerce. The Republican
Governor of Virginia, is chairman of a commission reviewing the effects of
e- commerce. His report indicates there isn't a reason to tax e- commerce as it
would affect e- commerce. The Village derives a high amount of its revenue to
support the infrastructure in our community such as fire, police, roads, etc.
from our sales tax revenue. Our sales tax revenue has grown slightly and we
have not seen the total affect of e- commerce.
Trustee McInerney then announced that two busloads of sailors are coming to
Oak Brook for Thanksgiving. Seventy or more are coming which is double
last year. He thanked the press, Village residents and surrounding
communities that are participating in this project.

President Bushy suggested that the Village will more formally contact the
Civic Association and ask for some clarification and accuracy checks in the
newsletter articles of the Village to strengthen creditability so that basic facts
are more accurate.,

Motion by Trustee Caleel, seconded by Trustee Savino, to approve the minutes
of the Regular Meeting of November 9, 1999, as presented and waive the full
reading thereof.
President Bushy requested changes on page 11 to read: "President Bushy will
be meeting with Homeowners Association Presidents" and "Staff is working
with the Timber Trails Property Homeowner's Association to determine if they
wish the concrete ribbons as a road shoulder finish when the Village repaves
the roads in their subdivision."
Motion by Trustee Caleel, seconded by Trustee Savino, to approve the
amended minutes of the Regular Meeting of November 9, 1999 as presented

Village Manager Veitch explained the complicated and extensive
payout to Ameritech for several months of service in which the
Village was transitioning from one rate plan to another plan to reduce
the Village's costs. Staff is reviewing this to insure that the Village
has received all of the credits the Village was suppose to receive and
therefore the check will be held until this process is completed.
Motion by Trustee McInerney, seconded by Trustee Savino, to
approve the list of bills. ROLL CALL VOTE.

Trustee Savino asked for a clarification of Agenda 5 J. concerning the
acceptance of storm sewer easements. He asked how long the Village
has been waiting for the final execution of the easement document at
44 Bradford Lane by the American National Bank and Trust
Company and inquired if there was a way to expedite this. Village
Engineer Durfey remarked that the Village has been waiting several
months. Village Engineer Durfey recommended that Village Attorney
Martens contact their attorney directly to assist in this matter.
President Bushy noted that the Village is banking with American
National and suggested speaking with them on this issue.

Pursuant to the Village Board's direction at their November 9, 1999
Board meeting, the Village Attorney has drafted Ordinance #1999-
SC-EX 1 -G -647 adopting a comprehensive amendment to Chapter 14,
Village Recreational Facilities, of the Code of Ordinances.
The following changes were made according to the Village Board's
direction at their November 9, 1999 meeting:
Page 13,_21 paragraph: No person may go in or upon any pond or
other body of water, whether liquid or frozen, in the Sports Core
except maintenance personnel authorized by the Bath & Tennis Club
Manager; notwithstanding the foregoing general prohibition, at the
pond adjacent to the Bath & Tennis Club, wading shall be permitted
in a designated roped -off area when a lifeguard is present, and
%T-and paddle b water recreation equipment shall be
permitted in strict conformity with Section 14- 13(g)(5).

THE VILLAGE OF OAK BROOK IL AS AMENDED BY
REPEALING THE U -TURN PROHIBITION ON
SOUTHBOUND YORK ROAD AT DOVER DRIVE:
For approximately the last twenty years, and possibly longer, U -turns
have been prohibited on southbound York Road at Dover Drive. The
restriction appears to date to the intersection improvement at 22 "d and
York that created the median on York between Dover Drive and 22 "d
Street.
Since the access into the Drake Hotel property from Dover Drive was
eliminated in the early 80's there has been a continuing problem with
vehicles traveling south on York intending to enter the Drake Hotel.
Finding that they must go north on York Road to reach the hotel
entrance, drivers do one of three things: They make the illegal U -turn
on York, they turn into Dover and then make a U -turn, or they use a
residential driveway on Dover to turn around. During the 8 to 9 a.m.
hour on eight recent weekday momings, police personnel in
unmarked vehicles observed on average 7 U -turns on York, 4 U -turns
on Dover and 31 driveway turnarounds on Dover.
A staff review in 1982 observed the problem much as it is today. At
that time, there was no recommendation to repeal the U -turn
restriction because, it appears, there was concern about conflicts with

northbound traffic backed up from 22' Street. There also seemed to
be a sense that traffic would eventually realize that there is no entry to
the Drake from southbound York, and that with better public and
private. signage, motorists could be directed to the Windsor Drive
entrance more effectively. Although the signage steps were
implemented to a degree and probably helped to some extent, the
problem persists.
With the completion of the most recent intersection improvements at
22 "d and York, York Woods residents asked the Village to review the
situation again. Staff has done so and it is the opinion of both the
Engineering and Police Departments that the U -turn prohibition can
now be removed.
The intersection improvement created dual left turn lanes and a
dedicated right turn lane for northbound York Road traffic at 22 "d
Street. This has eliminated the occasional situation where
northbound traffic could back up as far as Dover. There is a protected
left turn lane on southbound York at Dover in which to store vehicles
waiting to make a left or U -turn. Northbound traffic at Dover has two
through lanes and a wide shoulder area on the right. These
geometrics, combined with the excellent sight distance in both
directions, has convinced the Village that the U -turn movement can
be executed safely and that this U -turn prohibition need not exist any
longer.
Motion by Trustee Savino, seconded by Trustee Caleel, that the
Village Board approve Ordinance # 1999- TC -TRN -G -648, "An
Ordinance Amending Ordinance G -642, The Traffic Code Of The
Village Of Oak Brook, IL, As Amended, By Repealing The U -Turn
Prohibition On Southbound York Road At Dover Drive." ROLL

Trustee Savino commented before York Road was widened to four
lanes there was a lot of cut through traffic from Windsor Drive. As a
result of this, the Village placed on Hunt Club Lane a no left hand
turn sign for the evening and no right hand turn permitted into Hunt
Club Lane in the morning to eliminate the cut through traffic. Since
the road has been widened, it doesn't appear that the problem exists

anymore and this causes an inconvenience for the homeowners in
York Woods. He suggested Village Manager Veitch contact the
Homeowners Association to determine if they would like to have
those signs removed.
AWARD OF CONTRACTS:
1) ACCEPTANCE OF BID — GOLF CAR FLEET:
Two sealed bids were received on November 3, 1999. The
recommendation is that a contract be awarded, subject to staff review,
to the Lowest Responsible Bidder: E -Z -Go Golf Cars/Textron, Inc.,
24004 N. Highway 12, P.O. Box 548, Lake Zurich, IL, 60047, for 70
E -Z -Go model year 2000 electric golf cars, 4 E -Z -Go model year
2000 gas golf cars, alternate #2, #3 and #4 on a four year
lease /purchase, with an annual estimated cost of $41,000.
Delivery will be arranged sometime between January 1 - March 25,
2000 depending on staff's schedule. The recommendation is also to
declare the existine 74 carts as surplus property and accept E- Z -Go's
bid for the trade -in (the lease /purchase price includes trade -in value
for the existing carts).
Bid packages were picked up by three companies. Nadler Golf Car,
which sells Club Car, chose not to bid at this time. The four year
term is recommended since it is consistent with the useful life of the
carts. The existing carts were acquired under a four year
lease /purchase arrangement and have a respectable resale value.
The Village's usual practice in the past has been-to purchase the golf
car fleet under a lease/purchase arrangement. As funds are not
currently available within the Sports Core Fund to elect the purchase
option, staff recommends a lease /purchase arrangement again. The
interest rate is imputed in the lease payments, which staff calculates
to be between 6.5% and 7.0 %. This lease offers the advantage of
paying six (not twelve) installments annually, payable during the
spring and summer months at which time the corresponding revenues
are received from the rental of the golf car fleet.
Sufficient funds have been budgeted in the Golf Cart Operations
Program (52 -833) for the lease payments.

8. INFORMATION & UPDATES:
A. VILLAGE PRESIDENT:
Village President - Attended a meeting with Timber Trails Homeowner
Association helping to prepare them for the issues surrounding the
shoulder treatment and road paving program. The Village continues
to fine tune its plans for the Y2K event as it is our obligation to see to
the comfort and safety of the residents of Oak Brook. As a member of
the DuPage Mayors and Managers Legislative Committee, they met
this morning and their legislative action plan is almost ready. They
discussed some of the issues the Village Board has asked for as well
as other communities in preparation for the spring session of the
DuPage Mayors and Managers Conference's presentation to our state
legislators. In the veto session, the bill vetoed by Governor Ryan that
gives the ability for non -home rule communities by referendum to add
`/4 or %2 cent incrementally to the sales tax in their jurisdiction, has
passed the House. Our Representative, Jim Durkin, had voted against
this bill but it appears as though it will pass the Senate. The Village
has some indication that the Governor has lessened his displeasure of
this idea as this would provide somewhat of a safety valve for the
Village for future income. The Metropolitan Mayors Caucus
continues to work on the economic development program and a final
report has been received from the consultants hired to assist that
committee. December 1, 1999 the committee will be meeting to
complete the actual writing of the document of what will be presented
to Governor Ryan. As a member of the DuPage County Anti -
Terrorism Committee, its work is nearing completion and the minutes
of those meetings' will be given to DuPage County Chairman

Schillerstrom approximately within the next month. President Bushy
was re- elected to serve on the DuPage County Stormwater Committee
representing District II and feels it is important that the Village have a
seat at the table when application and legislation of stormwater
management is being discussed. She spoke on behalf of the Village
Board to wish all of our residents a Happy Thanksgiving and
meaningful holiday for everyone.
B. VILLAGE MANAGER:
Village Manager Veitch explained that the backup generator at the
Bath & Tennis Club is now installed and functioning. We have it for
the Y2K event and now for any periodic power outages which will
enable the facility to be better prepared. The equipment to the backup
operation of one of our wells at 31" Street and Meyers Road has
arrived. It will be functional for the Y2K event. Village Manager
Veitch will be participating in a forum on December 1, 1999 at the
Museum of Science and Industry sponsored by Chicago Metropolis
2020. This is a first in a series of forums that the organization is
sponsoring over the next several months leading to shaping a final set
of shared goals for the region. Participants will be commenting and
voting on a series of draft goals that are distilled from the Commercial
Club report.
President Bushy noted that the Village has started to receive reports
from the residents of the west portion of Oak Brook experiencing
greater problems of interference from the AM 1000 radio tower than
has been in the past. The FCC has told the Village they will not
remedy this situation unless the interference has increased beyond
your telephone or television. Please contact the Village in writing if
you are experiencing more interference than before.
9. DEPARTMENTAL REPORTS: No Business.
10. UNFINISHED AND NEW BUSINESS (Final Action Not Anticipated):
A. DISCUSSION — ADOPTION OF 1998 INTERNATIONAL
PROPERTY MAINTENANCE CODE:
One of our objectives this year is to formally consider adoption of the
BOCA Property Maintenance Code. The objective was established in
response to the gradually increasing level of concern and complaint

regarding the maintenance of-private property, especially residential
property. The issue is by no means widespread, but with the aging of
the housing stock Oak Brook is seeing the signs of deterioration in a
small number of cases.
As staff began to work on the objective, a new edition of the BOCA
code was issued with which staff needed to become familiar and the
1998 edition of the International Property Maintenance Code was
published. It also began to become clear that the International code
series would likely become the standard for reference codes.
Accordingly, staff shifted their focus to the International Property
Maintenance Code.
The process of adopting a reference code involves consideration of
what sections to adopt as written and what sections to modify or
delete via the adopting ordinance. Community Development Director
Kallien has completed a review of the 1998 International Property
Maintenance Code. In his report he has summarized the Code, drafted
the amendments staff proposes to make and discussed the
enforcement process staff envisions. In connection with several of the
chapters, Director Kallien has indicated the types of conditions known
to exist in the Village where staff sees the Code assisting in the
improvement of conditions from the outset. Chapter 3 covers most of
the conditions that staff expects to use the Code to address
immediately.
Page 9 of the Code, Exterior Property Areas, address most of the
complaints seen in the Village such as debris in yards, weed issues,
grading, drainage and some exterior of structures. This will give our
Code Enforcement personnel another tool to use.
Trustee Savino asked for a clarification of Section 111, Means of
Appeal, 111.1 Application for appeal. States that an appeal would
have to be filed within twenty days after notification of a violation.
Community Development Director Kallien remarked that it is not
necessary that the appeals process specify a specific time frame of
twenty days. Trustee Savino requested that Subsection III.I be
corrected to read Application for Appeal rather than Membership of
Board. He asked if items such as storage of construction materials on
a residential site are included in the Code. Director Kallien stated that
if it is not clear within the context of the Code as written, then this
language could be added. Village Manager Veitch recommended for

organization, to add another item to the list of items under Section
302. Exterior Property Area.
Trustee Savino noted that they had discussed maintenance of ponds
and that staff would be developing language in that area also.
Regarding Subsection 303.3 Street Numbers in which the Village
requests street numbers on resident structures, he asked how will the
Village enforce this provision. Director" Kallien explained that the
Village is giving them the opportunity to display their address.
President Bushy suggested that the Village has discouraged the
placement of a street address on mailboxes as many are clustered or
located on the opposite side of the street.
Trustee Savino commended the Village Manager Veitch, Community
Development Director Kallien and staff for - their excellent
presentation which gives the Village a tool to address any properties
with problems.
Trustee Caleel commented on page 13, 403.2 Bathrooms and Toilet
Rooms and requested clarification of this section. It states that it must
be vented to the outside and not be recirculated. He recalls that our
building code allows that it could be vented to the attic. Director
Kallien will investigate this further for clarification.
President Bushy asked if there are regulations governing basement
stairways. If so, then these should be reviewed further. Village
Manager Veitch suggested that staff will review this area further
especially as the BOCA Code should have included these regulations.
Motion by Trustee Caleel, seconded by Trustee Savino, to authorize
the Village Attorney to prepare the necessary ordinance for
consideration on the active agenda at the Village Board meeting of
December 14, 1999. VOICE VOTE: Motion carved.
11. OTHER BUSINESS PERTAINING TO VILLAGE OPERATIONS:
Trustee Kenny acknowledged receipt of a letter in our Fire Department from
the Captain of the Fire Department in Bay Village, Ohio in which one of the
men in his department was visiting in Oak Brook when his wife was stricken
with cardiac arrest. Oak Brook Firefighters Pavolic, Comsten, Bitterlin and
Shoppe were able to resuscitate the woman. She regained consciousness and
she was able to speak with her husband and parents before she passed away.

The family was very grateful for the efforts of our Fire Department and
commended the efforts of service from our firefighter /paramedics.
President Bushy indicated a swearing in ceremony will occur November 24,
1999 in which William Haas will be promoted to the rank of Police Lieutenant
and Randy Mucha will be promoted to the rank of Sergeant.
