ORDINANCE NO. G -241: AN ORDINANCE OF THE VILLAGE OF OAK BROOK,
DU PAGE AND COOK COUNTIES, ILLINOIS, PROVIDING THAT THE CODE OF
ORDINANCES OF THE VILLAGE OF OAK BROOK, ILLINOIS, BE ED B
REVISING IN PART SECTION 12 -87 OF SAID CODE
The proposed ordinance provides for revision to rates, fees, and
charges as follows:
1) Turning on water following interruption in service, $25.
2) An additional charge of 10% is hereby added to bills not
paid within 21 days of billing date.
3) There shall be charged a fee of $10 for all payments returned
by the maker's bank for non - sufficient funds, regardless of
date payment was attempted.

with the Final Plat, dated November 6, 1978, with the recommendation
that the design standards be waived to allow the Midwest Club parkway
to have barrier curbs; that the tree planting requirements of the
Subdivision Ordinance be waived to allow landscaping in substantial
compliance with the landscaping plan by the Theodore Brickman Company
dated September 1, 1978; and that bike paths be installed in lieu of
sidewalks; and that the requirement for street lights be waived, ex-
cent at intersections.

of their satisfactory past performance, and request that they submit
their estimate of providing the 1978/79 audit.
F. Long Range Financial Plan
Trustee Cerne highlighted the comprehensive Long Range Financial Plan
dated December 1978 and the variables affecting both revenue and ex-
penditure projections. This update is provided as a planning document,
only, and will be reviewed at a Committee -of- the -Whole meeting along
with the Village goals and objectives.

A. Franciscan Fathers - Village of Oak Brook Rezoning
December 12, 1978
Trustee Brown commented that the Village of Oak Brook: has established a
policy to maintain Oak Brook Road as a residential street and to maintain
residential zoning and land uses along its length through the Village.
This policy is reflected in the revised Comprehensive Plan of the Village
of Oak Brook as recommended by the Plan Commission and adopted by the
President and Board of Trustees in May 1978.
In furtherance of this policy, the Village has initiated during 1978,-on
its own motion, several petitions to rezone various parcels along Oak Brook
Road to a residential zoning district category. Two of these petitions
have resulted in the rezoning of about 75 acres of property abutting
Oak Brook Road from the B -1 local shopping center district and the
institutional district categories to the R -3 single - family detached
district category.
In the furtherance of this policy to insure residential development along
Oak Brook Road, the Village initiated a petition to rezone about 88.5 acres
at the southwest corner of Oak Brook Road and Route 83 from the institu-
tional district to the R -3 single - family detached district with special
uses. This action is in keeping with the Comprehensive Plan adopted in
May 1978 and is also in keeping with the previously adopted Comprehensive
Plan and with the trend of development on the properties in the surround-
ing and abutting area.
All required public hearings have been held. The property owner was
notified of these proceedings and has participated in them. Both the Plan
Commission and the Zoning Board of Appeals have submitted their recommenda-
tions.
Mr: James D. Murphy, representing the Franciscan Fathers, voiced opposition
to the rezoning and asked that deferment be made_ until such time as a con-
crete plan could be presented.

That the President and Village Board of Trustees of the Village of Oak Brook
approve the rezoning of approximately 88.5 acres on the southwest corner of
Oak Brook Road and Route 83 from the institutional zoning district classifi-
cation to the R -3 single - family detached zoning district classification with:
1) a special use for a Chapel and accessory uses customarily incidental
thereto, including but not limited to a cemetery or private burial plot;
2) a special use for a monastery with accessory uses customarily incidental
thereto, including but not limited to dwelling units and lodging rooms; and
3) a special use for the growing of farm garden crops and nursery stock, all
in accordance with a plat of said property prepared by Toups Corporation
dated October 6, 1977, as annotated on December 7, 1978, by Assistant to
Village Manager Glatfelter;
and that the Village Attorney be directed to prepare the appropriate ordinance
or ordinances for action by the Board of Trustees at its regular meeting of
January 9, 1979.

B. Oak Brook Water Policies
A review of the water service policy raised concern about the water service
area, and Public Works Superintendent Floyd Wilson presented a report
dated November 21, 1978, commenting on the realignment of the boundaries
as shown on the Water Service Area Map.

D. Village of Oak Brook Zoning Amendment - Driveway Widths
December 12, 1978
On November 20, 1978, the Plan Commission recommended the Zoning Ordinance
be amended to increase the maximum width of nonresidential driveways from
30' to 35' to permit 3 -lane driveways. On December 5, 1978, the Zoning
Board of Appeals recommended that the amendment be denied on the grounds
that no criteria have been established for the granting or denial of
requests for 3 -lane driveways, and because there are no adequate safeguards
in the Village Ordinances to substantiate the denial of requests for
3 -lane driveways.

That the Zoning Ordinance amendment be denied, as recommended by the
Zoning Board of Appeals.

E. 711 Jorie Blvd. - Special Use, Flood Plain
Both the Plan Commission on November 20, 1978, and the Zoning Board of
Appeals on December 5, 1978, recommended approval of the Special Use
under the Flood Control Ordinance for construction of a parking facility
in the flood plain in conjunction with the development of the property.

To grant the Special Use under the Flood Control Ordinance as recommended
by the Plan Commission and the Zoning Board of Appeals, and that the
Village Attorney be directed to prepare the required ordinance.

F. Reimbursement - Water Main - Oak Brook Christian Center
Reverend Scott requested final payment of the reimbursement for the
Midwest Road water main. The Village had agreed to participate in 37%
of the cost of construction of this project, for a total commitment to
$24,819.35, of which $20,881.03 had previously been paid, leaving a
balance due of $3,938.32.

To authorize Staff to reimburse Oak Brook Christian Center the amount of
$3,938.32, subject to receipt of waivers of lien.

G. Extension Hunter Trails Public Improvement
On May 9, 1978, the Board granted an extension of six months for the
completion of the improvements for the Hunter Trails West Subdivision,
expiring on December 10, 1978. As of this date, all of the public im-
provements have not been completed.

Due to the fact that all of the capital improvements have not been
completed and the winter months make it difficult to complete construc-
tion, that the developer be granted an additional 6 -month extension to
June 10, 1979.
