A RESOLUTION APPROVING THE FINAL PLAT FOR THE
SENESE RESUBDIVISION IN
THE VILLAGE OF OAK BROOK, ILLINOIS

WHEREAS, at its meeting on November 19, 2012, the Plan Commission completed its review
and deliberations on an application submitted to the Village by Mary Murphy, Joseph Senese and Lucien
Senese (collectively, the "Owners") seeking approval of a final plat of subdivision for a 217,058 square
foot parcel located at 3324 Roslyn Road ("Subject Property'); and
WHEREAS, by a vote of 6 to 0, the Plan Commission recommended approval of the request for a
final plat of subdivision for the Subject Property; and
WHEREAS, the Subject Property is legally described as follows:
LOT 2 OF HARRY YOUNG'S PLAT OF SURVEY OF THE EAST 988.96, MEASURED ON THE SOUTH
LINE AND THE WEST LINE BEING PARALLEL WITH THE EAST LINE, OF THE SOUTHEAST
QUARTER OF THE NORTHWEST QUARTER OF SECTION 33, TOWNSHIP 39 NORTH, RANGE 11,
EAST OF THE THIRD PRINCIPAL MERIDIAN, IN DUPAGE COUNTY, ILLINOIS. PINS: 06-33-104-035
and 06-33-104-036. Containing 217,508 Square feet or 4.99 Acres.
WHEREAS, the Village President and Board of Trustees have reviewed the recommendations of
the Plan Commission and deem the final plat of subdivision for the Subject Property, as set forth below, to
be in the best interests of the Village.
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1. Recitals. The foregoing recitals are incorporated herein by reference as though
fully set forth herein.
Section 2. Approval of Final Plat of Subdivision.
A. Approval of Final Plat. Subject to and contingent upon the conditions set forth in Section 3 of
this Resolution, the Final Plat prepared by Krisch Land Surveying, LLC, dated September 5,
2012, as attached to this Resolution as Exhibit A ("Final Plat'j, is hereby approved.
B. Authorization and Execution. The Village President, Clerk, and other appropriate Village
officials are hereby authorized and directed to execute and seal, on behalf of the Village, the
Final Plat and provide the customary certifications indicating such approval.
C. Recordation. Upon the execution of the Final Plat by all required parties, the Village Clerk is
hereby directed to record the Final Plat with the Recorder of Deeds of DuPage County,
Illinois, and the Village Clerk will then be authorized and directed to assess against and
collect from the Owners of the Subject Property any costs in connection with those actions or
this Resolution.
Section 3. Conditions. The approvals granted in Section 2 of this Resolution are hereby
expressly subject to and contingent upon each of the following conditions:

A. All improvements made on the Subject Property must comply with all applicable setback
requirements contained in the Zoning Ordinance of the Village of Oak Brook, Illinois of 1966,
as amended ("Zoning Ordinance'), that apply to properties located in the R-3 Zoning
District;
B. In the event that either or both of the subdivided lots are developed, the Owners shall strictly
comply with all of the requirements -of Title 9 of the Village Code of the Village of Oak Brook,
Illinois as if the lots were not subdivided pursuant to this Resolution.
C. The Owner shall comply with all requirements of law, including without limitation, federal,
state, and local laws, ordinances, resolutions, and regulations, relating to the Subject
Property,
Section 4. Severability. If any section, paragraph, clause or provision of this Resolution
shall be held invalid, the invalidity thereof shall not affect any of the other provisions of this Resolution.
Section 5. Effective Date. This Resolution shall be in full force and effect from and after its
passage, approval, and publication in the manner provided by law.
