AN ORDINANCE AMENDING AND GRANTING A SPECIA� USE PERMIT
FQR YILLAGE OWNED PRORERTY QT THE BUTLER GOVERNMENT CENTER

WHEREAS, on September 12, 2000 the President and Board af Trustees approved Ordinance
2000-ZO-SU-S-972 granting a special use permit in connection with the expansion of an existing
municipal complex located at 1200 Oak Brook Road ("Property"), subject to certain conditions; and
WHEREAS, the Village of C}ak Brook filed a petitian requesting an amendment of special use
Ordinance S-972 to permit and allow the construction of a one-story, 2,000 square foot building addition
to the no�theast corner of the Butler Government Center for the use by the Oak Broak Police Department;
and
WHEREAS, the proposed building addition includes the expansion of a two-bay sally port, the
relocation of the firing range equipment and ancillary starage and these improvements will address safety
concerns for the public, employees and police officers as well as address compliance with building and
fire code regulations, and
WHEREAS, at its meeting on November 20, 2017, the Plan Commission reviewed the proposed �
amendment to the special use and recommended approval of the proposed amendment;and
WHEREAS, at its meeting on December 5, 2017 the Zoning Board of Appeats conducted the
required public hearing pursuant to due and appropriate legai notice and found that the applicant had
addressed and satisfied the requirements with respect to the propased special use amendment; and
WHEREAS, the Zoning Board of Appeals recommended approval of the special use and found
that the Petitioner satisfactarily addressed the factors required for approval of the requested special use
amendment and made specific findings identified as Exhibit A, including that the special use will not
endanger the public health, safety and welfare, and that there will be no substantial injury to other
property in the neighborhood;and
WHEREAS, the Village President and Board of Trustees have reviewed the recommendation of
the Plan Commission and Zoning Board of Appeals and deem the special use, as set forth below, ta be in
the best interests of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROUK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows:
Section 1. Recitals. The foregoing recitals are restated and incorporated herein as the �
findings of the President and Board of Trustees. '
Section 2. Restatement and Grant of Special Use. The Village is hereby granted an ;
amendment to special use Ordinance 20Q0-ZO-SU-S-972 to permit and allow the construction of a one- !
story, 2,000 square foot building addition to the northeast corner of the But{er Government Center for the i
use of the Oak Brook Police Department. I

Section 3. Conditians. The special use granted in Section 2 of this Ordinance is expressly
subject to and contingent upon each of the following conditions:

A. Compliance with Plans. The building addition shail be in substantial conformance to the site
pian, landscape plan and building elevations identified as Exhibits B, C and D except for
minor changes and site wark approved by the Development Services Director in accordance
with all applicable Viilage rules, regulations and ordinances;
B. Comqliance with Laws. The development, maintenance and operation of the Property must
comply with all applicable, State, County and Village Statutes, ordinances, codes, rules and
regulations;
C. Certificate of t)ccupancv. Ali work shown in the plans must be completed prior to the
issuance of a final certificate of occupancy and operation of the facility;
D. Amendment to Special Use Permit. Any amendment to the special use granted in the
Ordinance that may be requested by the Petitioner, after the effective date of the Ordinance,
and may be granted pursuant to the procedures and subject ta khe standards and limitations,
provided in the Zoning Ordinance
Section 4. All other applicable provisions of Ordinance S-972 shall remain in full force and effect.
Section 5: If any sectian, paragraph, clause or provision of this ordinance shall be held invalid,
the invalidity thereof shall not affect any of the other provisions of this ordinance.
Section 6: All ardinances in conflict herewith are hereby repealed to the extent of such conflict.
Section 7: The effect of this ordinance is limited to the following property:
Oak Brook Village Gommons being a resubdivision of Lot 1 in Oak Brook Village Green
Subdivision, being a subdivision of parts of the Southwest Quarter of Section 26 and Lots 1 and 5
in Oak Brook Investment Campany Assessment Plat No. 3, and Lot 1 in Butler Company Spring
Road Subdivision; Unit One, being a subdivision of part of Lot 6 in Oak Br�ok Investment
Company Assessment Plat No. 3, and part of Lot 6 in Oak Brook Investment Campany, Plat Na.
3 and part of Lot 7 in Plat of Lands of F.O. and J. F. Butler, all being subdivisions in part of
Section 26, Township 39 North, Range 11, East of the Third Principal Meridian in DuPage
County, IL. PIN: 06-26-400-012
Commonly known as the Butler Government Center at the northeast corner of Jorie Boulevard
and Oak Broak Road, Dak Brook, IL 60523
Section 8: This ordinance shall be in futl force and effect from and after its passage, approval
and publication as provided by law provided, however, that this Ordinance shall not come into effect and
replace prior ordinances until the time at which the Village shall enter into contracts for the construction of
the new building addition.

A) The extent to whi�h the propasa!promotes th�hea/th, safety, mo�a/s, or
genera/welfare of the public.
RF�POIVSE: A space needs assessment was completed in 2012 and 2013 for the Butler
Government Center. While there were numeraus cancems with the building ta perform
as a functional madern day municipal govemment cen#er, i#was determined that the most
immediate need was to rectify several safety concems with the facility pertaining to the
Police Department and more specifically the lock up, booking, and sally port area
(referred to as detention area) of the building.
The rslocation of the Booking �rea has been identified as a concem because the current '
location is both a fire safety and officer safety issue whereby armed and unarmed
personnel traverse the main corritior when handling arrestees. This causes oMy the
hallway doors leading to the lower floor exit ta be available for egress purposes. Currently
both doors in that hallway are kept IQ�ked for both ingress and egress for#he safety of
the community at the expense of the safety of the employees.
The anafysis also determined that the current sally port is unable to adequately hold a
police vehicle and allow far officers to remove an arrestee from the vehicle due to a lack
of clearance from, interior posts and a wall built subsequent ta the original 1975
construction of the building, As we knaw, the exterior walkway on the northern end of the i
building also severely leaks intc� the sally port and the proposeti constructian would �
include a new roof, closing the walkway permanently and makin� the north wall af '
windows laoking into the village halE more secure. Sometime in the past a large ventilation
stack was also constructed through the current sally port also creating a hazard. The
proposed sally port would be large enough ta handle arrestees, with the doors closed,
create an interlock vestibule inta the lock up, provide for a decontamination shower and
also provide space for an ambulance to be parked in the event an arrestee needs to be
transportet� to a hospital for treatment.
These above mentioned changes will contribute to praviding a more modern Pofice facility
that will better serve and pramote the health, safety and general welfare of the Village
employees and the gener�l public.

l2ESPONSE: The importance of maintaining high quality municipal compiex is a
theme faund throughout the adopted 1990 Camprehensive Plan. The �earganizatlon
af the� Pt�lice Department daily aperations is consistent with those stated g4als and
objectives for the residential zoning districts.
C) The communit�need for the use p�oposed by the property awn�r.
RESPONSE: The Pt�lice Department and Butler Government Center are municipal
facilities that provide essenti�l functions to the community. It is important and vital
that maintenance and continued improvement of these Village facilities be provided
fc�r residents to provide safe, cost-effective and reliable services to the commun�ty.
