Background/History: James R. Hannon of Steeplechase Partners is the owner of the property at 601 Harger Road and has submitted a petition requesting approval of a final plat of subdivision for the 1.157-acre property located on the east side of Harger Road, approximately 320 feet south of Yorkshire Woods. 12. REG BOT 0201318 Agenda Item 8.A - Hannon 601 Harger Road- FP.doc Page 2 The property is currently unimproved and the owner has completed the construction of a vehicular bridge to provide access from Harger Road to lot 1 with no direct access being provided to lot 2 from Harger Road. A perpetual cross access easement will also be dedicated as Exclusive Easement A over a portion of lot 1 (as depicted on the plat) to permit and allow vehicle ingress and egress to lot 2. The subdivision proposal would create two (2) single family lots consisting of 25,195 square feet each. The R-3 Single-Family detached residence district permits and allows a minimum lot size of 25,000 square feet. The property owner intends to sell these lots for the construction of two (2) single family homes. At its meeting on January 15, 2018, the Plan Commission completed its review and deliberations on a petition from James Hannon of Steeplechase Partners, LLC requesting approval of the two (2)lot final plat of subdivision. Mr. Hannon discussed the history behind the request and reiterated that the application complied with the Village’s subdivision code regulations. He also summarized the construction of the access bridge, referenced a tollway sound wall that was being discussed with the Tollway Commission and outlined options for a water main extension. One member of the public did also attend the public meeting and he resides immediately east of the subdivision proposal. The neighbor did object to the proposal and indicated that he was opposed to the second development lot because the project would be too dense and inadequate buildable area was being provided for the construction of each home. The PC did also receive the Village Engineer’s technical review of the application and plat and the Village Engineer approved the plat request with conditions. Recommendation: A motion to approve the subdivision plat failed by a vote of 2 to 3 and as a result a negative recommendation has been forwarded to the Board of Trustees for review and consideration. The PC had concerns regarding the buildable area of the proposed lots and had issues with traffic safety on Harger and as a result a negative recommendation was provided by the PC. Mr. Hannon has since provided a cover letter and zoning exhibit to acknowledge the PC’s commentary on the buildable area of the development lots and this information has been included with the case file. Building setbacks, building footprints and an access driveway have been added to the zoning exhibit to identify one option or scenario for development of these two (2) lots in accordance with the requirements of the R-3 Single family residence district. Please also note that the final plat is in technical compliance with the Village’s subdivision code regulations, zoning ordinance and is consistent with the comprehensive land use plan.
