WHEREAS, at its meeting on January 19, 2015, the Plan Commission completed its review and
deliberations on an application by ZFO Properties, LLC ("Owner'j, the owner of the 5.6 acres located at
1220 and 1300 Kensington Road ("Subject Property'l, seeking approval of a two -lot final plat of
subdivision; and
WHEREAS, the Subject Property is legally described as follows:
LOT 1 IN TED SZYWALA ASSESSMENT PLAT OF LOT 2 IN CORPORATE PLAZA LOT 8
RESUBDIVISION, BEING A RESUBDIVISION OF LOT 8 IN CORPORATE PLAZA SUBDIVISION UNIT 2
OF PART OF LOTS 1 AND 2 IN OAKBROOK INVESTMENT COMPANY ASSESSMENT PLAT NO. 3 OF
PART OF SECTION 26, TOWNSHIP 39 NORTH, RANGE 11, EAST OF THE THIRD PRINCIPAL
MERIDIAN, ACCORDING TO THE PLAT THEREOF RECORDED SEPTEMBER 8, 1978 AS

WHEREAS, the Subject Property is currently improved with two office buildings and a parking lot;
and
WHEREAS, by a vote of 4 to 0, the Plan Commission recommended approval of the request for
a final plat of subdivision for the Subject Property; and
WHEREAS, the Village President and Board of Trustees have reviewed the recommendations of
the Plan Commission and deem the final plat of subdivision for the Subject Property, as set forth below, to
be in the best interests of the Village;
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1. Recitals. The foregoing recitals are incorporated herein by reference as though
fully set forth herein.
Section 2. Approval of Final Plat of Subdivision.
A. Approval of Final Plat. Subject to and contingent upon the conditions set forth in Section 3 of
this Resolution, the final plat prepared by Edward J. Molloy & Associates, Ltd., dated January
15, 2015, and attached to this Resolution as Exhibit A ("Final Plat'), is hereby approved.

B. Authorization and Execution. The Village President, Clerk, and other appropriate Village
officials are hereby authorized and directed to execute and seal, on behalf of the Village, the
Final Plat and the customary certifications indicating such approval.
C. Recordation. Upon the execution of the Final Plat by all required parties, the Village Clerk is
hereby directed to record the Final Plat with the Recorder of Deeds of DuPage County,
Illinois, and the Village Clerk will then be authorized and directed to assess against and
collect from the Owner any costs in connection with those actions and this Resolution.
Section 3. Conditions. The approvals granted in Sections 2 of this Resolution are hereby
expressly subject to and contingent upon each of the following conditions:
A. All improvements made on the Subject Property must comply with all applicable setback
requirements contained in the Zoning Ordinance of the Village of Oak Brook, Illinois of 1966,
as amended ("Zoning Ordinance"), that apply to properties located in the ORA -1 Zoning
District;
B. That each of the subdivided lots on the Subject Property shall be subject to full stormwater
compliance in the event of any future development;
C. The Declaration of Reciprocal Easements, Covenants and Restrictions prepared by Owner
and in a final form approved by the Village Engineer shall be recorded against all of the lots
on the Subject Property and recorded prior to the recording of the approved Final Plat; and
D. The Final Plat be approved by the Village Engineer; and
E. The Owner and all subsequent owners of the Subject Property shall comply with all
requirements of law, including without limitation, federal, state, and local laws, ordinances,
resolutions, and regulations, relating to the Subject Property.
Section 4. Severability. If any section, paragraph, clause or provision of this Resolution
shall be held invalid, the invalidity thereof shall not affect any of the other provisions of this Resolution.
Section 5. Effective Date. This Resolution shall be in full force and effect upon passage and
approval in the manner provided by law.
