A RESOLUTION APPROVING THE FINAL PLAT FOR THE
TEMPLETON WOODS SUBDIVISION IN
THE VILLAGE OF OAK BROOK, ILLINOIS 60523
(A parcel of approximately 57 acres, located at the Southeast Corner of
Route 83 and 35th Street(f/k/a Brittwood Creek Subdivision), in the
Village of Oak Brook, Illinois)
WHEREAS, TK Templeton Woods, LLC is the owner of Lots 1 through 16 and 18 through 30 as
described in Exhibit A attached hereto and incorporated herein; and Binu Philip, Trustee (together with
TK Templeton Woods, LLC, "Owners"), is the owner of Lot 17 as described in Exhibit A, (Lots 1 through
30 are collectively, "Subject Property'l; and
WHEREAS, the Subject Property is located at the Southeast corner of Route 83 and 35th Street
and depicted in the Brittwood Creek Plat of Subdivision, attached hereto and incorporated herein as
Exhibit B; and
WHEREAS, the Owners submitted an application to the Village seeking approval of a final plat of
re-subdivision of the Subject Property as depicted on the subdivision plat attached as Exhibit C attached
hereto and incorporated herein ("Final Plat"); and
WHEREAS, the Owners have also requested approval of: (i) a variation from Section 14-6-3A2 of
the 'Village Code of the Village of Oak Brook, Illinois," as amended ("Village Code'), to allow for the
pavement width of the public rights-of-way within the Subject Property to be 22-feet wide; (ii) a variation
from Section 14-6-3A.3 of the Village Code to allow for three-foot wide concrete shoulders and swales
instead of curbs and gutters along the public rights-of-way; and (iii) a variation from Section 14-6-3E of
the Village Code allow the owners to install three-foot wide concrete shoulders along the rights-of-way in
lieu of sidewalks(collectively, the "Requested Relief; and
WHEREAS, at its meeting on June 18, 2012, the Plan Commission completed its review and
deliberations on the approval of the Final Plat and the Requested Relief; and
WHEREAS, at its June 18, 2012 meeting, by a vote of 7 to 0, the Plan Commission
recommended approval of the Final Plat and Requested Relief; and
WHEREAS, the Village President and Board of Trustees have reviewed the recommendations of
the Plan Commission and deem the approval of the Final Plat and Requested Relief, as set forth in this
Resolution and subject to the conditions described below, to be in the best interests of the Village.
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part
of, this Resolution as the findings of the President and Board of Trustees of the Village of Oak Brook.
Section 2: Approval of Plat of Vacation.
A. Approval of Plat of Vacation. Subject to and contingent upon the conditions set forth in
Section 5 of this Resolution, the Plat of Vacation of the Brittwood Creek Final Plat of
Subdivision, attached hereto and incorporated herein as Exhibit B ("Plat of Vacation"), is
hereby approved.

B. Authorization and Execution. The Village President, Clerk, and other appropriate Village
officials are hereby authorized and directed to execute and seal, on behalf of the Village, the
Plat of Vacation and the customary certifications indicating such approval.
C. Recordation. Upon the execution of the Plat of Vacation by all required parties, the Village
Clerk is hereby directed to record the Plat of Vacation with the Recorder of Deeds of DuPage
County, Illinois, and the Village Clerk will then be authorized and directed to assess against
and collect from the Owners of the Subject Property any costs in connection with those
actions or this Resolution.
Section 3. Approval of Final Plat of Subdivision.
A. Approval of Final Plat. Subject to and contingent upon the conditions set forth in Section 5 of
this Resolution, the Final Plat prepared by Engineering Resource Associates with a latest
revision date of May 18, 2012, as attached to this Resolution as Exhibit C, is hereby
approved.
B. Authorization and Execution. The Village President, Clerk, and other appropriate Village
officials are hereby authorized and directed to execute and seal, on behalf of the Village, the
Final Plat and the customary certifications indicating such approval.
C. Recordation. Upon the execution of the Final Plat by all required parties, the Village Clerk is
hereby directed to record the Final Plat with the Recorder of Deeds of DuPage County,
Illinois, and the Village Clerk will then be authorized and directed to assess against and
collect from the Owners of the Subject Property any costs in connection with those actions or
this Resolution.
Section 4. Approval of Variations. Pursuant to Section 14-74A of the Village Code and
subject to and contingent upon the conditions set forth in Section 5 of this Resolution, the following
Requested Relief is hereby granted:
A. Pavement Width Variation. A variation is hereby granted to the Subject Property from
Section 14-6-3A.2 of the Village Code to permit the pavement width to be 22-feet wide
instead of 27 feet wide.
B. Curb and Gutter Requirement. A variation from Section 14-6-3A.3 of the Village Code is
hereby granted to the Subject Property to permit the public rights-of-way to have three-foot
wide concrete shoulders and swales instead of curbs and gutters.
C. Sidewalk Requirement. A variation from Section 14-6-3E of the Village Code is hereby
granted to the Subject Property to permit three-foot wide concrete shoulders on the public
rights-of-way instead of sidewalks.
Section 5. Conditions. The approvals granted in Sections 2, 3, and 4 of this Resolution are
hereby expressly subject to and contingent upon each of the following conditions:
A. The Owners must install 22-foot wide asphalt pavement public rights-of-way on the Subject
Property as depicted on the Final Plat.
B. The Owners must install three-foot wide concrete shoulders and swales along the public
rights-of-way as depicted in the Final Plat.
C. The Owners must obtain final engineering approval from the Village Engineer for the
improvements listed in subsections A and B above.

D. The Owners shall comply with all requirements, conditions and standards of the Village Code
accept as specifically modified and waived by this Resolution.
E. The Owners shall comply with all other requirements of law, including without limitation,
federal, state, and local laws, ordinances, resolutions, and regulations, relating to the Subject
Property.
F. All prior Village approvals that are in conflict with this Resolution as to the Subject Property
are hereby revoked as to the extent of any such conflict.
Section 6. Severability. If any section, paragraph, clause or provision of this Resolution
shall be held invalid, the invalidity thereof shall not affect any of the other provisions of this Resolution.
Section 7. Effective Date. This Resolution shall be in full force and effect from and after its
passage, approval, and publication in the manner provided by law.
