SUBJECT: Intergovernmental Agreement between the County of DuPage and the
Village of Oak Brook

RECOMMENDED MOTION: I move that the Village Board approve this three (3) year
Intergovernmental Agreement (IGA) between the County of DuPage and the Village of Oak
Brook for the Mowing along County Roads and Rights of Way and approve Resolution R-1761.
Background/History: In the past the County Roads and Right of Ways were cut by the
County on their schedule. The original IGA was entered into in order to have certain
areas cut more frequently and in line with other adjacent Village properties. By cutting
the County R-O-W as part of the Village landscape contract, the Village has control over
how and when the grass is cut. The County will reimburse the Village the money that the
County would expense if the County were to cut the R-O-W.

Recommendation: I move that the Village Board approve this three (3) year

RESOLUTION 2018-PW -MOW -IGA-DU-R-1761
A RESOLUTION APPROVING AND AUTHORIZING AN INTERGOVERNMENTAL
AGREEMENT BY AND BETWEEN THE VILLAGE OF OAK BROOK AND
DUPAGE COUNTY REGARDING MOWING ALONG COUNTY ROADS
WHEREAS, the Constitution of the State of Illinois, 1970, Article VII, Section 10, authorizes units
of local government to contract or otherwise associate among themselves in any manner not prohibited
by law or ordinance; and
WHEREAS, the Illinois Intergovernmental Cooperation Act, 5 ILCS 220/1, provides that any
power or powers, privileges or authority, exercised or which may be exercised by a unit of local
government may be exercised and enjoyed jointly with any other unit of local government; and
WHEREAS, the Village of Oak Brook (“Village”) and DuPage County (“County”) are units of local
government as defined in the Intergovernmental Cooperation Act and within the meaning of the Article
VII, Section 10 of the Illinois Constitution; and
WHEREAS, the Village desires to have grass in certain areas of the Village within the County’s
right-of-way cut more often to align with adjacent Village properties; and
WHEREAS, the County agrees to allow the Village to mow such grass within the County’s right-
of-way in certain designated areas as described in, and pursuant to the terms and conditions of, the
intergovernmental agreement between the Village and the County attached as Exhibit A (“Agreement”);
and
WHEREAS, the Village President and Trustees have determined that it is in the Village’s best
interests to enter into the Agreement;
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows:
Section 1: The foregoing recitals are incorporated as though fully set forth in this Section 1.
Section 2: The President and Board of Trustees hereby approve the Agreement by and
between the Village and the County in substantially the same form attached as Exhibit A, and in a final
form acceptable to the Village Attorney.
Section 3: The Village Manager and Village Clerk are hereby authorized and directed to
execute the Agreement attached as Exhibit A, and the Village Manager is authorized and directed to take
all steps necessary to implement the terms of this Resolution and the Agreement.
Section 4: This Resolution shall be in full force and effect from and after its passage and
approval by the Village President.
