DEAN BOARD ROOM BUTLER GOVERNMENT CENTER 1200 OAK BROOK ROAD OAK BROOK, ILLINOIS 630-368-5000 AGENDA ITEM Regular Board of Trustees Meeting of June 12, 2018 SUBJECT: Plat of Easement Grant for Sanitary Sewer and Watermain – 1 Pine Hill Lane, 2 Pine Hill Lane and 4008 Adams Road – Dedicate Utility Easements FROM: Tony Budzikowski, AICP, Development Services Director BUDGET SOURCE/BUDGET IMPACT: N/A RECOMMENDED MOTION: I move that the Village Board approve and adopt Resolution R-1730, which approves a Plat of Easement Grant for Sanitary Sewer and Watermain for the properties at 1 Pine Hill Lane, 2 Pine Hill Lane and 4008 Adams Road, subject to the following conditions: 1. Final engineering approval of the Plat of Easement Grant; and 2. Recording the resolution granting the requested Plat of Easement Grant. Background/History: Mr. Sami Diab, the property owner at 1 Pine Hill Lane will be demolishing the existing single- family home on his property and will be constructing a new single-family home in its place. The property was previously served by well and septic for utility purposes but village water and Flagg Creek sanitary service will now be provided to the property as part of the new single- family home construction. Since Pine Hill Lane is a private street, the requisite village street right-of-way is not available for utility installations and easements must be dedicated on private property to accommodate utilities. As such, in order to accommodate the existing water main and new sanitary sewer service line for this project, specific utility easements will need to be granted for the property at 1 Pine Hill Lane and this plat dedicates those easements. REG BOT 061218 Agenda Item 6.D.4 - Easement 1 Pine Hill- PE.doc Page 2 The accompanying Plat of Easement identifies a 15-foot water main easement on lot 3 and a 15- foot sanitary sewer easement on lots 1 and 2. These are standard and customary easement widths and should more than adequately permit and allow utility installation as well as future maintenance for these utilities. Recommendation: Please also note that the Plat of Easement Grant is in technical compliance with the Village’s subdivision code regulations. As such, staff recommends approval of a motion to approve and adopt the Plat of Easement for Sanitary Sewer and Watermain for 1 Pine Hill Lane, 2 Pine Hill Lane and 4008 Adams Road. Approve Resolution R-1730 RESOLUTION 2018-ST-PE-EX- R-1730 A RESOLUTION APPROVING A PLAT OF EASEMENT GRANT FOR SANITARY SEWER AND WATERMAIN (1 Pine Hill Lane, 2 Pine Hill Lane and 4008 Adams Road) Oak Brook, IL 60523 WHEREAS, the Village President and Board of Trustees have determined that it is in the best interests of the Village to approve the Easements, as set forth below; NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1. Recitals. The foregoing recitals are incorporated herein by reference as though fully set forth herein. Section 2. Approval of Easements. The Easements granted are hereby approved in accordance with the accompanying Plat of Easement Grant attached to this Resolution as Exhibit A and in final form as acceptable by the Village Engineer. Section 3. Authorization and Execution. The Village President, Clerk, and other appropriate Village officials are hereby authorized and directed to execute and seal, on behalf of the Village, the Plat of Easement Grant and the customary certifications indicating such approval. Section 4. Recordation. Upon the execution of the Plat of Easement Grant by all required parties, the Village Clerk is hereby directed to record the Plat of Easement Grant with the Recorder of Deeds of DuPage County, Illinois, and the Village Clerk will then be authorized and directed to assess against and collect from the Owner any costs in connection with those actions and this Resolution. Section 5. Severability. If any section, paragraph, clause or provision of this Resolution shall be held invalid, the invalidity thereof shall not affect any of the other provisions of this Resolution. Section 6. Effective Date. This Resolution shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
