RECOMMENDED MOTION: I move to approve Resolution R-1706, which
approves a preliminary and final plat of subdivision for the property located at 1900
Spring Road.
Background/History:
At the February 13, 2018 meeting, the Village Attorney was directed to prepare the
necessary resolution granting approval of preliminary and final plats for the Franklin
Subdivision located at 1900 Spring Road. The approval is for a preliminary and final 3-
lot subdivision.
Recommendation:
Approve Resolution R-1706.

A RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLATS OF SUBDIVISION
FOR THE FRANKLIN SUBDIVISION
IN THE VILLAGE OF OAK BROOK, ILLINOIS
1900 Spring Road

WHEREAS, at its meeting on January 15, 2018, the Plan Commission completed its review and
deliberations on an application by Franklin 1900 Spring Road, LLC (“Owners”), the owners of the 8.43-
acre property located at 1900 Spring Road (“Subject Property”), requesting approval of a three (3)-lot
preliminary and final plat of subdivision; and
WHEREAS, the Subject Property is legally described as follows:
Parcel 1:
Lot 1 in First Federal Resubdivision of Lots 1 and 2 in Oakbrook Hotel Co’s Resubdivision in Section 23,
Township 39 North, Range 11, East of the Third Principal Meridian, according to the Plat of said First
Federal Resubdivision recorded May 5, 1978 as Document R78-38235, in DuPage County, Illinois.
Parcel 2:
A permanent non-exclusive easement for the benefit of Parcel 1 recorded as Document R83-46294, for
the purpose of installing, operating, cleaning, maintaining, repairing and removing a storm water drainage
line, tributary connections and appurtenant facilities under, across, along and under the following
described land:
That part of Lot 9 in Oak Brook Terrace, recorded as Document 984765, described as follows:
Commencing at the Northeast corner of Lot 5 in said subdivision; thence South 1 degree 05 minutes 37
seconds West 894.18 feet along the East line of said Lot 5 to a place of beginning; thence Easterly on a
curve convex to the North, having a radius of 570.24 feet, an arc distance of 10.84 feet and a chord
bearing of North 86 degrees 44 minutes 30 seconds East along the North line of said Lot 9; thence South
33 degrees 33 minutes 57 seconds West, 20.14 feet to the West line of said Lot 9; thence North 1 degree
05 minutes 37 seconds West 16.17 feet along last West line to the place of beginning, in DuPage County,
Illinois.
Parcel 3:
A permanent non-exclusive easement for the benefit of Parcel 1 recorded as Document R83-46294, for
the purpose of connecting, removing and re-connecting the storm water drainage lines located within the
First Federal Drainage Easement No. 3 with the storm sewer lines, the tributary connections and
appurtenant facilities thereto located on the following described land:
Easement through a 10 foot strip of land crossing part of Lot 5 in Oak Brook Terrace, recorded as
Document 984765, described as 5 feet on each side of the following described line: Commencing at the
Northeast corner of said Lot 5, aforesaid; thence South 1 degree 5 minutes 37 seconds West 901.05 feet
along the East line of said Lot 5 to a place of beginning; thence South 33 degrees 33 minutes 57 seconds
West 5.59 feet; thence North 40 degrees 58 minutes 14 seconds West 27.61 feet; thence North 45
degrees East 9.37 feet; thence North 1 degree 05 minutes 37 seconds East 316.25 feet; thence North 1
degree 42 minutes 46 seconds West 326.89 feet; thence South 88 degrees 54 minutes 22 seconds East
31.01 feet to the East line of said Lot 5, aforesaid, also being the West line of Lot 1 in First Federal
Resubdivision, recorded as Document R78-38235, in DuPage County, Illinois; and
WHEREAS, the Subject Property is currently improved with a multi-tenant office building and an
ancillary parking lot; and

WHEREAS, by a vote of 5 to 0, the Plan Commission recommended approval of the request for
the preliminary and final plats of subdivision for the Subject Property; and
WHEREAS, the Village President and Board of Trustees have reviewed the recommendations of
the Plan Commission and deem the preliminary and final plats of subdivision for the Subject Property, as
set forth below, to be in the best interests of the Village;
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1. Recitals. The foregoing recitals are incorporated herein by reference as though
fully set forth herein.
Section 2. Approval of Preliminary and Final Plats of Subdivision.
A. Approval of Preliminary and Final Plats. Subject to and contingent upon the conditions set
forth in Section 3 of this Resolution, the preliminary and final plats prepared by V3
Companies of Illinois, LLC, dated November 17, 2017 and December 13, 2017 and attached
to this Resolution as Exhibits A ("Preliminary Plat") and Exhibit B ("Final Plat"), are
hereby approved.
B. Authorization and Execution. The Village President, Clerk, and other appropriate Village
officials are hereby authorized and directed to execute and seal, on behalf of the Village, the
Preliminary and Final Plats and the customary certifications indicating such approval.
C. Recordation. Upon the execution of the Preliminary and Final Plats by all required parties,
the Village Clerk is hereby directed to record the Preliminary and Final Plats with the
Recorder of Deeds of DuPage County, Illinois, and the Village Clerk will then be authorized
and directed to assess against and collect from the Owner any costs in connection with those
actions and this Resolution.
Section 3. Conditions. The approvals granted in Section 2 of this Resolution are hereby
expressly subject to and contingent upon each of the following conditions:
A. All improvements made on the Subject Property must comply with all applicable requirements
contained in the Zoning Ordinance of the Village of Oak Brook, Illinois of 1966, as amended
("Zoning Ordinance"), that apply to properties located in the B-2 Regional Shopping Center
Zoning District;
B. That all of the subdivided lots on the Subject Property shall be subject to full stormwater
compliance in the event of any future development/redevelopment;
C. The final plat and final engineering plans be approved by the Village Engineer;
D. That the “parking and cross-access easements” dedicated in the final plat, which govern the
Franklin Subdivision, shall remain in place and will allow all existing and future buildings to
use parking spaces in the Franklin Subdivision and allow access to all existing and future
buildings.
E. The Owner and all subsequent owners of the Subject Property shall comply with all
requirements of law, including without limitation, federal, state, and local laws, ordinances,
resolutions, and regulations, relating to the Subject Property.
Section 4. Severability. If any section, paragraph, clause or provision of this Resolution
shall be held invalid, the invalidity thereof shall not affect any of the other provisions of this Resolution.

Section 5. Effective Date. This Resolution shall be in full force and effect upon passage and
