Minutes - 09/24/2019 - Board of Trustees MINUTES OF THE SEPTEMBER 10, 2019 REGULAR MEETING OF THE (VILLAGE of PRESIDENT AND BOARD OF OAK BR-92K TRUSTEES OF THE VILLAGE OF OAK BROOK APPROVED AS WRITTEN ON SEPTEMBER 24, 2019 1. CALL TO ORDER The Regular Meeting of the Village Board of Trustees was called to order by President Gopal Lalmalani in the Samuel E. Dean Board Room of the Butler Government Center at 7:03 pm. The Pledge of Allegiance was given. 2. ROLL CALL Village Clerk Charlotte Pruss called the roll with the following persons PRESENT: Trustees John Baar, Philip Cuevas, Michael Manzo, Edward Tiesenga, Asif Yusuf, President Gopal Lalmalani ABSENT: Trustee Moin Saiyed IN ATTENDANCE: Village Manager Rick Ginex, Development Services Director Tony Budzikowski, Golf Manager/Superintendent Sean Creed, Information Technology Director Jim Fox, Police Chief Jim Kruger, Fire Chief Barry Liss, Finance Director Jason Paprocki, Public Works Director Doug Patchin, Head Librarian Jacob Post, and Village Michael Castaldo, Jr. 3. PRESIDENT'S OPENING COMMENTS President Lalmalani welcomed the new Village Attorney, Mr. Michael Castaldo, Jr. He stated that after an in depth search,the Village has selected Ottosen Britz Kelly Cooper Gilbert& DiNolfo, LTD as the Villages Legal Counsel. Michael Castaldo, Jr has over 30 years of experience representing villages, school districts and park districts as General Counsel handling a diversity of matters. President Lalmalani announced the passing of Lucia Sutton, on August 26, 2019. She served as president of the Oak Brook Library Association and was treasurer of the Oak Brook Library Foundation. She also devoted her time and efforts to the Ministry Board and Social Issues Committee at the Union Church of Hinsdale and the West Suburban Faith-Based Peace Collation. President Lalmalani also announced the passing of Frederick Cappetta on August 26, 2019. Mr. Cappetta was a long time Oak Brook resident who served on the Oak Brook Board of Fire and Police Commissioners and was President of the Wendel Woods Homeowners Association. VILLAGE OF OAK BROOK MINUTES Page 1 of 7 REGULAR MEETING OF SEPTEMBER 10,2019 A moment of silence was taken in honor of Lucia Sutton and Fred Cappetta. A. RESOLUTION 2019-MEM-R-1824, Resolution of Memoriam—Fred Cappetta The Resolution was read by Clerk Pruss. Motion by Trustee Baar, seconded by Trustee Manzo to approve Resolution 2019-MEM-R-1824, Resolution of Memoriam — Fred Cappetta. VOICE VOTE: Motion carried. The Cappetta Family was presented with the Resolution by President Lalmalani. Mr. Cappetta's daughter spoke of her father and thanked the Village for honoring her dad. President Lalmalani announced that the Village has once again received the Distinguished Budget Presentation Award from the Government Finance Officers Association. The award is the highest form of recognition in governmental budgeting and represents a significant achievement by our organization. He presented the award to Finance Director Paprocki and thanked him and his staff for their hard work and dedication. President Lalmalani invited everyone to the annual Patriot Day Remembrance Ceremony on September 11th beginning at 9:00 am at the flagpoles located on the north side of the Butler Government Center. B. Receipt of the Six-Month Draft Report From the Long Term Strategic Planning Advisory Committee Anne Huber presented a short presentation of the report from the Long Term Strategic Planning Advisory Committee. She stated that the committee met on May I st and that two sub-committees were appointed, the Village and Sports Core Finance Sub-committee and the Economic Development Sub-Committee. She stated that she is a member of the Village and Sports Core Finance Sub-Committee and discussed financial reporting, clubhouse rentals, golf utilization, and pool memberships. She stated that their findings confirmed that neither golf nor the pool are professionally marketed nor have a significant presence on social media and that this could be the reason that participation has declined. She also discussed Polo, the newly built salt dome on Sports Core property, pensions, fire department calls, the day-time population, and staffing. She stated that the committee suggests caution when considering future expenditures. She further stated that the Village cannot abandon the Sports Core, it is what makes Oak Brook unique, and that it needs to be maintained with a long term vision of attracting Village residents. The final report is expected to be complete by February 2020. President Lalmalani thanked the members of the committee for their hard work and looks forward to the report from the Economic Development Sub-Committee. RESIDENT/VISITOR COMMENTS Resident Terry O'Malley discussed residential waste and recycling pick-up and the importance of recycling. He stated that we should require 50%recycling. He also discussed water and aquafers. 5. APPROVAL OF MINUTES A. REGULAR EXECUTIVE MEETING MINUTES OF JULY 9, 2019 Motion by Trustee Baar, seconded by Trustee Manzo to approve the Minutes of the Regular Executive Meeting of July 9, 2019. VOICE VOTE: Motion carried. B. SPECIAL BOARD OF TRUSTEES MEETING OF AUGUST 13, 2019 Motion by Trustee Baar, seconded by Trustee Manzo to approve the Minutes of the Special Board Meeting of August 13, 2019. VOICE VOTE: Motion carried. C. REGULAR BOARD OF TRUSTEES MEETING OF AUGUST 13, 2019 Motion by Trustee Baar, seconded by Trustee Manzo to approve the Minutes of the Regular Board of Trustee Meeting of August 13, 2019. VOICE VOTE: Motion carried. 6. CONSENT AGENDA All items on the Consent Agenda are considered to be routine in nature and will be enacted in one motion. There will be no separate discussion of these items unless a Board member so requests, in which event, the item will be removed from the Consent Agenda and considered as the first item after approval of the Consent Agenda. BOARD & COMMISSION RECOMMENDATIONS A. Oak Brook Commons, LLC — 1120 22nd Street and 2111 McDonald's Drive—Oak Brook Commons Final Subdivision Plat—Final Plat for a 15-Lot Subdivision VILLAGE OF OAK BROOK MINUTES Page 4 of 7 REGULAR MEETING OF SEPTEMBER 10,2019 Community Development Director Budzikowski gave a brief description of the proposal and stated that the plat approval is one of the necessary steps to move forward. Motion by Trustee Manzo, seconded by Trustee Cuevas to concur with the recommendation from the Plan Commission to approve the proposed 15-Lot Oak Brook Commons final plat of subdivision and subdivision regulations variations, subject to (1) final engineering approval prior to recordation of the plat and (2) authorizing the Village Attorney to prepare the necessary resolution. ROLL CALL VOTE: Ayes: 5 —Trustees Baar, Cuevas, Manzo, Tiesenga, and Yusuf Nays: 0—None Abstain: 0—None Absent: 1 —Saiyed Motion carried 9. ACTIVE BUSINESS A. Discussion of an Amendment to Ordinance 2014-ZO-V-EX-S-1403: Use of Lights at 1450 Forest Gate Road Trustee Tiesenga stated there was a good faith problem with how the ordinance specifies where you measure the glare from the ball fields to Forest Gate. He discussed the recommended changes to the Ordinance and deferred to the Village Attorney to make the agreed upon corrections to the Ordinance. Trustee Baar thanked Trustees Tiesenga and Manzo for their hard work and stated that this problem will eventually go away when LED lights are installed on the field. Trustee Manzo agreed with Trustee Baar and stated the issue with this is the cost since LED lighting is expensive. He thanked the Forest Gate representative, the Park District, Trustee Tiesenga and Carl Miller, Trustee Tiesenga's intern, for all their hard work. Trustee Yusuf stated he worked on the previous Ordinance and that with vegetation continuing to thicken and grow and LED lights coming in, this will become less and less of an issue. 10. INFORMATION & UPDATES A. Village Manager Manager Ginex stated that the Village received a check for $114,740 from insurance to cover some of the expenses of the Taste of Oak Brook. B. Village Clerk Clerk Pruss stated that November 3, 2020 is the next election and reminded residents, especially young adults, that they can register to vote at the Village and at the Library. Trustees Trustee Tiesenga commended the Public Works Department and the contractor working on the Brook Forest Water Main Project. He discussed businesses leaving the suburbs for Chicago and what the city is proposing in new taxes. He stated that Oak Brook will continue to honor zero taxes for as long as we can. Trustee Manzo discussed the new marginal tax that will target Chicago businesses. He also mentioned Mr. Cappetta's passing and stated that although they did not always see eye to eye there was mutual respect. He stated that Mr. Cappetta will be sorely missed and thanked him for his dedication to the Village. Trustee Baar recognized 9/11 and stated that we have great respect for our first responders. He also stated that there were over 1,000 attendees at Polo, putting Polo in Oak Brook on the map. He sent his condolences and prayers to the Cappetta family and stated that he and Mr. Cappetta developed a friendship and came to respect and enjoy each other. He stated that Mr. Cappetta was a deep thinker and thought very strongly about his Christian faith. Trustee Cuevas sent his condolences to the Cappetta family and stated that he and Fred had many spirited conversions. He also commended Chief Kruger and the Police Department for taking care of the problem at the Hyatt in a swift manner. Trustee Yusuf sent his condolences to the Cappetta family, stated that Fred was not a hard man to read, that they didn't always agree but his heart was always in the right place. He stated that this is a great loss to the Oak Brook community and that he will be missed. He further mentioned that the days are getting shorter and asked everyone to be careful on the roads and to watch for people walking on the streets. D. Village Attorney Attorney Castaldo thanked the Board on behalf of the law firm for the opportunity to work with the Village and stated that they are honored for the opportunity. E. Village President Information Services Director Fox gave an update on the communication tower work taking place at the Village. Chief Kruger discussed the incident that occurred at the Hyatt hotel and thanked the agencies that came to help. He mentioned the signs that were put up on a temporary basis reminding everyone to lock their cars. He also stated that he will make a recommendation for an ordinance to have a three way stop at 31St and Saddle Brook. Public Works Director Patchin stated that the pool closed a week ago and that the Park District used the Village pool for a few events since their pool was closed. He stated contractors will be in to check the lines for leaks and start remodeling the gutter and pool filtration systems. VILLAGE OF OAK BROOK MINUTES Page 6 of 7 REGULAR MEETING OF SEPTEMBER 10,2019 Golf Manager/Superintendent Creed stated that Golf had a really good August and that September started strong. He invited everyone to the last patio party of the year on Thursday, September 261h Head Librarian Post reminded everyone to head to the Library to check out a good book. Finance Director Paprocki gave an update on the sales tax numbers stating that compared to last year,the September numbers are .3% less and that year-to-date we are 2.1%higher and $235,000 over budget. Chief Liss reminded everyone to attended the 9/11 Ceremony tomorrow at 9:00 am. 11.
