ORDINANCE AMENDING SECTION XII(B)(8)(c)
OF THE ZONING ORDINANCE OF THE VILLAGE OF OAR BROOK,
ORDINANCE NO. G-60, AS AMENDED
WHEREAS, Section XII(B)(8)(c) of the Zoning Ordinance of the
Village of Oak Brook pertains to the amortization of nonconforming business
and commercial uses located in a Residence District; and
AREAS, an application has been filed requesting an amendment to
Section XII(B)(8)(c) which would extend by ten years the date for
discontinuance of non -conforming business and commercial uses -in a Residence
District; and
WHEREAS, at its meeting of November 20, 1995, the Plan Commission
recommended that Subsection (c) of section XII (B)(8) of the Zoning Ordinance,
which Section is entitled "Nonconforming use of Conforming Buildings or
Structures", be amended by changing the discontinuance: date for nonconforming
business and commercial uses in a Residence District from July 8, 1996 to July
8, 2006; and
WHEREAS, the Zoning Board of Appeals pursuant to due and
appropriate legal notice conducted a public hearing thereon and on January 2,
1996 recommended that the discontinuance date in Section XII(B)(8)(c) be
amended to July 8, 2006; and
WHEREAS, it is in the best interests of the Village of Oak Brook
that the amendment set forth below be made;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as
follows:
Section 1: That the provisions of the preamble hereinabove set
forth are hereby adopted as though fully set forth herein.
Section 2: That Section XII(B)(8)(c) of the Zoning Ordinance of
the Village of Oak Brook, Illinois, Ordinance G-60, as amended, be and the
same is hereby amended to read as follows:
"(c) Any lawful nonconforming use in a conforming building or
structure existing in a Residence District on the effective date
of this Ordinance or any amendments thereto, but is herein allowed
as a permitted or special use only in a Business or ORA District,
shall be entirely discontinued on or before July 8, 2006."

Section 3: That this Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet form as
provided by law.
Section 4: If any section, subsection, sentence, clause or phrase
of this Ordinance: is for any reason held to be invalid, such determination
shall not affect the validity of any remaining portion of this Ordinance.
