AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF
THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK
RELATIVE TO FENCE REQUIREMENTS

WHEREAS, the owner of the property more particularly hereinafter described has petitioned the
corporate authorities of the Village of Oak Brook for a variation to Section 13 -3 -613 of the Zoning
Ordinance of the Village of Oak Brook, Illinois, as amended, with respect to fence height requirements;
and
WHEREAS, a public hearing on such application has been conducted by the Zoning Board of
Appeals of the Village of Oak Brook on October 1, 2002, pursuant to due and appropriate legal notice; and
WHEREAS, the said Zoning Board of Appeals made explicit findings in its report dated October
15, 2002 that the variation requested meets the applicable standards of Title 13, Section 13 -14 -6D of the
Oak Brook Zoning Ordinance; and
WHEREAS, the Village President and Board of Trustees concur with the recommendations made
by the Zoning Board of Appeals, and
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1 • That the provisions of the preamble hereinabove set forth are hereby adopted as
though fully set forth herein.
Section 2 That a variation from Section 13 -3 -313 of the Zoning Ordinance of the Village of Oak
Brook, Illinois, as amended, is hereby granted to permit installation of an open fence 72 inches in height of
green or black vinyl coated steel mesh along the perimeter of the property abutting the Fullersburg Woods
Forest Preserve District property
Section 3 The real estate effected hereby is legally described as, to -wit:
That part of Lot 4 of F. O Butler's Plat of part of Section 36, Township 39 North, Range
11, East along the Third Principal Meridian described by commencing at the Southeast
corner of said Lot 4 and running thence South 890 55' West along the South line of said
Lot 4, 746.2 feet; thence North 0 °5' West parallel with the East line of said Lot 4, 37 6 feet
for a place of beginning; thence continuing North 0 °5' West parallel with the East line of
Lot 4, 262 4 feet; thence North 890 55' East parallel with the South line of said Lot 4,
200 0 feet, thence South 0 °23' West 130 55 feet, thence South 47° 46' West 154.7 feet,
thence South 71' 55' West 89.0 feet to the place of beginning, reference being had to F.
O. Butler's plat recorded as Document No 151374, in DuPage County, IL Permanent
Index No 06 -36- 101 -007
This property is commonly known as 3423 Spring Road, Oak Brook, IL.
Section 4- That this ordinance shall be in full force and effect upon and after its passage,
approval and publication as required by law.
