Dear Mr. Carmignana:
This will serve to confirm our telephone conversation of July
12th regarding the above-entitled matter. During that conference
I indicated that it is our intention to obtain permission from
the County of DuPage to employ the above described property as
a heliport facility. You indicated, at that time, that the
property in question is outside the area of interest of the
Village of Oak Brook, and that it was unlikely that a represent-
ative of the Village will be present at the public hearing on
said petition. If you should find this not to be the case, and
that in fact the Village does desire to review the plans which
we have proposed, please notify me of such development .
If you have any questions regarding this matter, please do not

Dear Ken:
As you may recall , the heliport agreement dated October 26, 1976, between
the Village of Oak Brook and McDonald's provides that we may use the
Heliport until November 29, 1977. It further provides that sixty days prior
to this date the Village will begin an evaluation of the Heliport to
determine its impact on the Village.
To paraphrase the agreement, if this investigation reveals that the
use of the Heliport is reasonable and proper, the Village will undertake
whatever action it deems necessary to authorize and allow the Heliport
installation. I do not know what investigations you have made to date, but
I stand ready to provide you with whatever information you would like to
complete your investigation. I suggest that a meeting be arranged between
the appropriate Village Officials and our Chief Helicopter Pilot to review
our log and discuss any other pertinent matters.
We have found that the Heliport is an invaluable facility, and we are
very grateful to Oak Brook for allowing us to experiment with its use for
a year. As you know, we spent over $50,000 to develop the Heliport and
to meet all of the criteria established by the Village. We think that our
experience can contribute a great deal to the future use and development
of similar facilities, and we would like to be as cooperative as possible
in this regard.

Attached to this letter is a true and correct transcription of
our Heliport log. You have inspected the actual Heliport log and the
flight log for the Helicopter can be made available to you at any time
for your inspection.
You will note that the transcription indicates that the maximum
number of operations for any one month was 23 operations during March of
1977.. We have not exceeded the limit of 30 operations and we have
complied with all of the other use restrictions listed in Article 4 of
the Agreement dated October 26, 1976, between the Village of Oak Brook
and Franchise Realty Interstate Corporation and McDonald's Corporation.
We do not see any need to modify the present use restrictions, and
we would be happy to comply with your request that the McDonald's
Plaza Security Desk be notified by phone or radio prior to and after
each landing.
If you need any other information, please do not hesitate to contact
either the undersigned or Mike Sise in our Real Estate/Legal Department.
We have found the Heliport to be a very valuable and useful part of our
home office facility, and we hope that you can make a positive recommendation
to the Village Board with respect to the continued use of the Heliport.

In the 12 months since the McDonalds Corporation has
received permission to install and use a helicopter
pad at their corporate headquarters , this department
has EsXperienced no negative situations .
The only recommendation I would make , would be for
the corporation to notify both the Fire and Police
Departments as to their schedule of landing so that
we may be prepared in case of an emergency situation .

After a one year trial period as per the agreement_of Ordinance_S-367 _

I reviewed the McDonald' s Heliport with Mr. _Doug Harmond,_Manager of
Helicopter Operations. Mr. Mike Sise, Manager Real Estate/Legal Department
& John Cunnane of L.J. Sheridan, and also their written log sheet (Copy
attached) for takeoffs and landings. I find they are operating_within the
confines of the approved ordinance and as of this date, _there have been
no complaints filed with Chief Ceren, and they have _complied with all the

Attached please find is a letter from Michael J. Sise, McDonald's Corporation,
dealing with the heliport installation on the McDonald's building.
Also attached is a copy of the ordinance enacted by the Village of Oak Brook
and the Agreement.
Staff reports from Chiefs Ceren and Clark are also attached dealing with the
operation during the trial period pursuant to Ordinance S-367.
From all reports we can find no negative effect to the operation of the
heliport on the top of the McDonald's building.
The board's options at this point are:
(1) Terminate the operation of a heliport
(2) Extend the operation of a heliport on a permanent basis
(3) Grant the extension of a heliport on a temporary basis
The matter has been placed on the village board agenda for your review and
action.

Trustee Brown reviewed Ordinance S-387, approved October 26, 1976, and the
request from McDonald's to evaluate the operation of the Heliport to de-
termine :its impact on the Village during the trial period. Attorney Michael J.
Sise stated that they were interested in a Heliport at only the location
where the corporate headquarters is located. Trustee Glaves voiced oppo-
sition to a Heliport on the roof of a building in a congested area.

operation is under review. He met with the Golf Club Architect.
Preliminary work on the Village budget has begun.

Trustee Glaves reported that the following persons were commended for

Donald Craft, and Marcus DeLise; Sgt. Glen Mandel; Clerk Shirley Karwoski.
Fire Department: Firemen Raymond Arling, James Bodony, Francis Pine.
Public Works:
Trustee Rush reported that the 22nd Street widening is completed;
Water Reservoirs will be completed in June; York Road Water Main is
completed and sections of Hinsdale Sanitary District Water Main are
operational; Well #7 is pumping; Traffic Signal on York Road at
Forest Glen/Woodside Estates entrance is operational.

AN ORDINANCE AUTHORIZING THE EXECUTION OF AN AMENDMENT
AGREEMENT BETWEEN FRANCHISE REALTY INTERSTATE CORPORATION,
MCDONALD'S CORPORATION, AND THE VILLAGE OF OAK BROOK, DU PAGE
AND COOK COUNTIES, ILLINOIS
WHEREAS, a certain Amendment Agreement between the Village of
Oak Brook, Du Page and Cook Counties, Illinois, and Franchise Realty Interstate
Corporation, an Illinois corporation, and McDonald's Corporation, a Delaware
corporation, has been presented to, read, and considered by the Corporate
Authorities of the Village of Oak Brook; and
WHEREAS, said Corporate Authorities agree to permit the continued
use of a heliport subject to all the terms and conditions of said Amended
Agreement; and
WHEREAS, the Corporate Authorities of the Village of Oak Brook deem
the passage of this Ordinance to be in the best interest and in furtherance of the
general welfare of the Village of Oak Brook.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Oak Brook, Du Page and Cook Counties, Illinois, that:
SECTION 1: The provisions of the preamble hereinabove set forth are hereby
restated herein as though herein fully set forth.
SECTION 2: The President of the Village of Oak Brook is hereby authorized,
empowered, and directed for and on behalf of the Village of Oak Brook to execute
that certain Amendment Agreement between the Village of Oak Brook, Du Page
and Cook: Counties, Illinois; Franchise Realty Interstate Corporation, an Illinois
corporation; and McDonald's Corporation, a Delaware corporation, in the form
presented to, read, and considered by the Corporate Authorities of the Village of
Oak Brook, a copy of which Amendment Agreement is attached to this Ordinance,
as Exhibit A hereof, and by this reference is incorporated herein as though herein
fully set forth.
SECTION 3: The Village Clerk is hereby authorized and directed to attest to the
execution of said Amendment Agreement, affix the Village Seal thereto, and to
certify the passage of this Ordinance, all as otherwise provided by the Ordinances
of the Village of Oak Brook and the laws of the State of Illinois.
SECTION 4: All ordinances, rules, and regulations of the Village of Oak Brook
which are in conflict with the provisions of this Ordinance are hereby repealed
solely to the extent of the conflict.
SECTION 5: If any section, subsection, sentence, clause, or phrase of this
Ordinance is for any reason held to be invalid, such determination shall not affect
the validity of any remaining portion of this Ordinance.
SECTION 6: This Ordinance shall be in full force and effect from and after its
passage and approval as provided by law. This Ordinance shall be published in
pamphlet form.

AMENDMENT AGREEMENT
THIS IS AN AGREEMENT dated 1977, between
the VILLAGE OF OAK BROOK, an Illinois municipal corporation (hereinafter
referred to as "Oak Brook"), FRANCHISE REALTY INTERSTATE CORPORATION,
an Illinois corporation (hereinafter referred to as "Franchise"), and McDONALD'S
CORPORATION, a Delaware corporation (hereinafter referred to as "McDonald's").
WITNESSETH:
WHEREAS, by Instrument dated October 26, 1976, the parties entered
into an Agreement covering the construction and operation of a heliport on the roof
of a eight-story building owned by Franchise situated on property commonly known
as 2111 McDonald's Plaza, Oak Brook, Illinois, such property being more
particularly described in the preamble of the aforementioned Agreement; and
WHEREAS, the operational term of the aforementioned Agreement was
expressly .limited under Paragraph 6 thereof to a one-year period of time
commencing on November 29, 1976, and ending on November 29, 1977; and
WHEREAS, Franchise and McDonald's are desirous of extending the
operational term of the aforementioned Agreement under Paragraph 6 thereof; and
WHEREAS, in connection with such extension of the operational term,
Oak Brook is desirous of incorporating within the aforementioned Agreement
certain additional terms and conditions.
NOW, THEREFORE, in consideration of the foregoing and the mutual
promises and conditions hereinafter set forth, the parties hereby amend the
aforementioned Agreement, effective on the date first herein specified, as follows:
1. Paragraph 6 is deleted in its entirety and the following language is
substituted in its stead:
6. Duration:
The rights hereunder accruing to Franchise and McDonald's with
respect to its or their construction and operation of the heliport facility
shall be effective for so long as Franchise and McDonald's diligently and
faithfully comply with all of the terms and conditions of this
Agreement. It is further expressly agreed that those rights apply
exclusively to the land and building described in the preamble to this
Agreement and for only so long as McDonald's continues, without
interruption, to occupy said building as its principal executive and
administrative headquarters.
2. Paragraphs 8 and 9 are added as follows:
8. Personal Nature of the Agreement:
This Agreement shall be construed as personal between the parties
and neither this Agreement nor any part thereof shall be construed as
running with the land.
9. Prohibition Against Assignment:
Neither this Agreement nor any part thereof shall be assigned or
otherwise transferred. Any assignment or other transfer of rights in
contravention of this provision shall be void.
THE AFOREMENTIONED AGREEMENT, as hereby amended, is
confirmed and continued.
IN WITNESS WHEREOF, the parties have hereto set their hands and

The Secretary noted for the record that the legal notice for the hearing of
this matter was published in the Oak Brook DOINGS on February 12, 1981 and
the Suburban Life GRAPHIC on February 14, 1981. Surrounding property owners
were also notified of this hearing on February 12, 1981.
Mr. John Lavery, Attorney for the petitioner, proceeded to describe to the
Board the scope of the Special Use and Variations which are being requested
by his client. These being:
1. A Special Use to construct a Heliport pad on top of the building at
3003, West Butterfield Road.
2. A Variation from the requirement that this pad be 100 feet. in
diameter, such that the pad may be constructed 60 foot square in
dimension.
3. A Variation from the requirement of installing a fence around the
Heliport pad.
4. A Variation in building structure height which would allow them to
construct the pad on top of the building, this beinga Variation
of approximately 3 1/2 feet above the allowable structure height in
the ORA--1 district, which is 35 feet.
Mr. Lavery further stated that the owner of the 3003 Butterfield building is
Butterfield Office Venture with the sole tenant being Waste Management, Inc.
Other representatives for the petitioner present at the meeting were.. Rodney.
Jacobs, Bert Fowler, Bruno Contarato and John Worley.
The following exhibits were presented by the petitioner:
1. An aerial photo of the building in question as well as the surrounding
properties.
2. An elevation plan of the building which indicates a line of sight from
Route 56 (Butterfield Road) showing that the Heliport pad as constructed
would not be visible from that hio-hway.
3. A site plan showing the location of the Heliport pad on the roof.
4. A roof plan which indicates the exact location of the pad as well as
the pedestrian walkway and other appurtenances including netting
which would be installed around the Heliport as a safety factor for
pedestrians on the pad.
5. A letter from Police Chief Ceren stating that there had been no specific
complaints of noise received by his office from helicopter landings or
take--offs during the period of 1979 and 1980.
