BROOK 1200 OAK BROOK ROAD OAK BROOK, ILLINOIS July 27 , 1979 654-2220 MEMO TO: Chief Ceren SUBJECT: Helicopter Landings On The Sports Core As you know the Village Board at its regular meeting; of July 24 , 1979 passed an ordinance which amends the Sports Core policies regarding the use of the Sports Core for helicopter landings . The effect of this ordinance is to nro- hibit helicopter landings on the Sports Core. In addition the Village! Board at that meeting authorized Staff to withdraw the Village ' s application for certification of the Sports Core site as a restricted landing area. At Wednesday' s Staff meeting we discussed what procedures would be necessary to deter poten- tial violators from using the area for unauthorized landings . Section 22 . 47 of the Aviation Act , Chapter 152 of the Illinois Revised Statutes provides that it is a violation for any person to operate any aircraft or restricted landing area for which a Certificate of Approval has not been issued by the Department of Aeronautics . This section can be utilized to cite violators who are observed landing aircraft anywhere on the Sports Core site. In addition the section could be utilized to cite violators landing at any other area within the Village that either has not been issued a permit by the Department of Aero nautics for such landing or which does not have a Certificate of Approval for the use of that property as a landing area. Section 22. 79 of the Aviation Act , Chapter 152 of the Illinois Revised Statutes provides that the penalty for violation of any pro- vision of the Act is a Class A misdemeanor which is punishable by a fine of up to $1,000 and imprisonment of up to one (1) year. I anticipate the procedure for handling such citations would be essentially the same as the procedure utilized for the handling of criminal complaints . As in criminal charges the States Attorney Office for the County would have the responsi- bility to prosecute the case. July 27 , 1979 page two Some thought was given to whether or not the criminal code provisions in regard to trespass could be utili- zed as an enforcement device. The problem inherent and the criminal trespass statute , Article 21 of Chapter 38 of the Illinois Revised Statutes is that one element of the offense is that the offender must have been -given notice from the owner that the entry onto the property was forbidden. In the present situation such notice would be virtually impossible to be given to a pilot in the air. It would appear then that the provisions of the Aviation Act provide the best available en- forcement tool for the potential problem. In addition to any citations and prosecutions that may ensue as a result of violation the Department of Aero- nautics of the State of Illinois does have authority in the enforcement area and has the general responsibility to over- see and. regulate aviation within the State of Illinois. If an incident occurred it would be appropriate,either in addi- tion to or in lieu of a citation being issued, that a incident report be made to the Illinois Department of Transportation Division of Aeronautics , Capital Airport/North Walnut Street Road, Springfield, Illinois 62706 reporting the particulars of the incident involved. Assuming we have obtained the number of the aircraft the State through its record search can identify the owner of the aircraft and usually the pilot at the time. The State can thereupon put the alleged offender on notice that the area utilized was not an authorized landing area. William Rieken at the same number and address who is additionally responsible for enforcement procedures . Hopefully the procedures outlined above will elim- inate any potential problems we may have. S- 437 AN ORDINANCE AMENDING ORDINANCE S-424 AND REVISING CERTAIN OPERATING POLICIES FOR THE OAK BROOK SPORTS CORE WHEREAS, the President and Board of Trustees of the Village of Oak Brook have heretofore , on March 27 , 1979 passed Ordinance 5-424 , "An Ordinance Adopting Policies And Establishing Rules And Regulations Governing The Use And Operation Of The Facilities Known As The Sports Core ; " and WHEREAS , said Ordinance provided for certain operating policies governing the use and operation of a heliport on the Sports Core site ; and WHEREAS , Chapter 152, Section 22 . 47 of the Illinois Revised Statutes prohibits the use or operation of such a restricted landing area without a certificate of approval issued by the Department of Aeronautics of the State of Illinois ; and WHEREAS , an application for such certificate has been made by the Village of Oak Brook, but the Department of Aeronautics has not issued a final determination on said application; NOW, THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DUPAGE AND COOK COUNTIES , ILLINOIS , as follows: Section l : That Ordinance S-424 be and is hereby amended by deleting therefrom in its entirety paragraph I B of the Oak Brook Sports Core Operating Policies , Exhibit "A" of said Ordinance . Approximately .five or six people who were friends and acquaintances of Paul Butler used the land as an airstrip when Paul owned the property. It appears that it might be in the best interest of the residents of Oak Brook if the Village Board immediately discontinues use of the land as an airport , and considers that land as part of an overall integral plan to best benefit the needs of the people paying the approximately 10 million dollars cost of acquisition of the property. It is said that the continued use of the property for an airstrip impedes overall use planning. When the program to acquire the property was proposed, was there any indication that a large part of the property would be used for an airport? The continued use of the property for an airstrip creates certain dangers , expenses (insurance and upkeep) and potential municipal liability for accidents which the Village residents could be better without. It :is said that MacDonald' s Corporation will be using the airstrip to land planes. Other aircraft owners are interested in using the property for their planes. Did residents assume a large tax liability to operate a municipal airport? If use of the property as an airstrip is a concern, Home Owners Associa- tions may wish to take up the matter with members and advise the Village Board of the feelings of the residents. Also of concern: since MacDonald' s hamburger emporium is a fast growing corporate giant, perhaps the Associations might also want to give the Village Board its members ' views as to whether the residents want a growing corporate hamburger business in the heart of a residential area, adjacent to a 250 acre Sports Core purchased by the residents at a multi-million dollar cost and located adjacent to the Butler National Golf Club situated on land still owned by Paul Butler, which any large expanding corporation would look to acquire in the future to meet growing business needs. How many trainees will be processed through "Hamburger College" which will be a part of the project? What effect will business zoning of the Butler headquarters property, presently zoned residential, have on the zoning of surrounding properties? What zoning will the Butler National Golf Club acquire if Butler sells the: land and the present 70 members decide to dissolve the Golf Club? Do these potential problems which affect the health, safety and welfare of Oak Brock residents become more acute with the rezoning of the head- quarters land for business use? The Oak Brook residents took a great interest in the zoning and use of the Healy property in the southwest corner of the Village. Isn ' t the commercial rezoning of a large land tract in the geographic center of the Village of concern to its residents when there is a probability of substantial impact on patterns and intensity of traffic, the possibility of rezoning of adjacent lands for apartment projects as a buffer between commercial and residential, and the types of business which might attach to the commercially zoned area in the future? O'Connor SUBJECT: AIRCRAFT ACCIDENT Dear Jack: You will find enclosed the standard FAA ACCIDENT REPORT being filed by Mr. William L. Johnson. Subject accident occurred on June 4, 1978 while Mr. Johnson was attempting take off. His report will indicate some difficulty with the aircraft, but not to the point where he could stop such action. The plane was air-borne. He turned twice and hit the ground short of the runway, causing extensive damage to the aircraft. Our property was damaged, per Mr. Johnson, to the extent of torn up grass areas when the airplane struck the ground. Left ma OK. Carb heat applied and indicated proper operatign. Engine was run at 1400 RPM for a few minutes to raise temperature to 20 C indicated for takeoff. Mags rechecked and showed proper operation. Takeoff roll seemed longer than normal , and aircraft was reluctant to raise onto main gear. I considered aborting just as the aircraft began to fly. I attributed the poor takeoff performance to no wind and a high moisture air content. The aircraft appeared to climb, but not in a normal wanner. At -this point I:: made a 90 degree turn to the left over a grove of trees. An -area of homes is directly off the runway end, and my only choice was to avoid that area. At this point, I realized the aircraft was descending 13. even at full: throttle. I managed to keep the plane from stalag into the HISTORY :trees, and turned 45 degrees to my left in an attempt to set up an FLIGHT approach to the North end of the North-South runway. The aircraft never atalled,, but dropped about 20 feet short of the intended touchdown area hitting an incline. Saunders, Director Division of Aeronautics Dear Mr. Saunders, On December 19, 1978, the Village of Oak Brook was made aware by newspaper reporters that a Certificate of Approval for a restricted landing area- heliport was issued to the Basic Youth Conflicts, Inc. We received a copy of a notice which was distributed to individuals within our community. The Village of Oak Brook, to the best of my knowledge, was never contacted or made aware that an application had been applied for or that a Hearing on this matter was being conducted. As you well know, the Village of Oak Brook is responsible for the public health, safety and welfare of its citizens, and it would seem to me that the State of Illinois, Department of Transportation, would seek out comments by the local communities. This area may be in Oak Brook or it may be in the Village of Hinsdale depending upon the exact location of the landing area. It would seem that both communities should have been notified and asked, for their comments. The VillaFYe of Oak Brook has specific standards for heliports, and they are permitted in certain zoning districts. This area is totally residential, surrounded by residential land uses, and it is a serious question whether it is prudent to permit the landing and taking off of helicopters in this area. I am asking that you re-evaluate this item, and I will await hearing from you so that the Village of Oak Brook can make it's position clear on this matter . Subsequently, the Division's Safety Representative from our Schaumburg Office, Mr. Roy Cleveland, contacted a representative of the Village of Oak Brook, Mr. Edward Glatselter, to advise him that the transfer of ownership of the property would require an application for transfer of the certificate of approval for the restricted landing area; at which time he was informed it was thE� village's intent to discontinue the use of the landing strip but intended to establish a heliport on the subject property. On November 29, 1978, Mr. Cleveland made an inspection of the proposed heliport site and furnished Mr. Glatselter with an application for a certificate of approval for a heliport and asked that the Village request the Division in writing to rescind the certificate of approval for the former restricted landing area. To date, neither the application nor the requested letter have been received. On November 1, 1977, the Village acquired the property from the Butler Company and entered into a management agreement with the Butler Company to manage the operation of the property. The management agreement expired on October 31, 1978. Also, the Village has decided to expand its golf course onto portions of the airfield runways. There- fore, we request that the Certificate issued on April 18, 1947, to the Butler Company be rescinded. The Village has applied for a Certificate to operate a Restricted Landing Area - Heliport on the remaining area of the airfield. A copy of the application is attached. This property, formerly owned by Mr. Paul Butler, had been issued a certificate for a restricted landing area by the Illinois DepartTent of Aeronautics for the operation of an airfield. This airfield was being operated by Mr. Butler at the time of the Sports Core purchase. The Village of Oak Brook, at the time of the purchase, entered into a management agreement with the Butler Company to operate and manage the Sports Core property for the Village, under policies adopted by the Village Board. Those policies called for the continued operation of the airfield, which did occur in 1978. The managimnent agreement expired on October 31, 1978, since the Village decided to operate and manage the Sports Core property directly. Also, the Villages decision to construct the expanded Oak Brook Golf Course onto portions of the airfield runways forced the closure of the airfield to all fixed wing aircraft in November of 1978. The policies adopted by the Village Board for 1979 Sports Core operations include the continued operation of the airfield facility for helicopters. The changes in ownership, management, and airfield configuration necessi- tated an application to the State of Illinois, Division. of Aeronautics, for certification of a portion of the old airfield as a restricted landing area-heliport. It was this application which caused notices to be sent to some of you recently regarding heliport certification. Policies regarding the routine management and operation of this facility are now being prepared by Village Staff for review and adoption by the Village Board. It is anticipated at this point, that no significant changes will be made to previous operating practices. This could lead to instruction, schooling, rides, and other non-commercial activities. Persons were bold enough to attempt this activity in the past. Proper authorities stopped a glider "club" activity in the past. 5. "Restricted Use" is too open and undefined a term giving too much"permission latitude." This 'permission latitude" could be easily misused. On all grounds we definitely oppose any issuin or renewing of a permit for a heliport. ,ie have heard and seen the airplane traffic here for over 2C years. This property, formerly owned by Mr. Paul Butler, had been issued a certificate for a restricted landing area by the Illinois Department of Aeronautics in 1947 for the operation of an airfield. This airfield was being operated by Mr. Butler at the time of the Sports Core purchase. The Village of Oak Brook, at the time of the purchase, entered into a management agreement with the Butler Company to operate and manage the Sports Core property for the Village, under policies adopted by the Village Board. Those policies called for the continued operation of the airfield, which did occur in 1978 with several fixed wing aircraft and one helicopter based at the field and an average of about two landings per month by other aircraft. The management agreement expired on October 31, 1978, when the Village decided to operate and manage the Sports Core property directly. Also, the,Village's decision to construct the expanded Oak Brook Golf Course onto portions of the airfield run- ways forced the closure of the airfield to all fixed wing aircraft in November of 1978. The policies adopted by the Village Board for 1979 Sports Core operations included the continued operation of the airfield facility for helicopters only. The changes in ownership, management, and airfield configuration necessitated an application to the State of Illinois, Division of Aeronautics, for re-certification of a portion of the old airfield as a restricted landing area-heliport. In May, 1979 the Division of Aeronautics entered an order that such a certificate would be issued. Issuance of the certificate was delayed due to a request for a public hearing. This public hearing was held by the Division of Aeronautics on July 18, 1979 with a final decision anticipated in four to six weeks. Heliport activities have been suspended until the issuance. of the certificate is resolved. 00 o G O FC U VILLAGE OF OAK BROOK 1200 OAK BROOK ROAD OAK BROOK, ILLINOIS 654-2220 July 24, 1979 MEMO TO: President and Board of Trustees SUBJECT: Proposed Heliport Policies and Proceedures The following is a draft of proposed policies and proceedures to cover the operations of the Oak Brook Sports Core Heliport. Policies: 1. The Oak. Brook Sports Core Heliport will be operated as a private use heliport restricted to use by the owner and those pilots who have obtained the owner's permission. 2. No requests shall be made to place the Oak Brook Sports Core Heliport on aeronautical charts. 3. Helicopter takeoffs, landings and engine operations shall take place only during daylight hours. 4. No fueling or maintenance facilities shall be provided and no fueling or main- tenance shall occur except in emergencies. 5. There shall be no: -carrying of passengers for hire(this shall not preclude the use of the heliport by chartered helicopters) . -student or flight training -proficiency training -rental of aircraft -air meets or exhibitions -advertising -sale of mechanical equipment or parts 6. All aircraft shall utilize the designated approach and departure paths as authorized by the State of Illinois Division of Aeronautics. 7. There shall be a maximum of tie down spaces. Tie down locations shall be available on a permanent basis to Oak Brook Residents or Oak Brook Businesses; upon application, on a first come first serve basis. Helicopters over pounds in weight shall not utilize the Sports Core Heliport. 9. There shall not be more than landings of non-based aircraft in any month. 10. No helicopter shall lard without the expressed permission of the Sports Core Manager. Helicopters with a pexmanent tie down shall be understood to have such permission. Proceedures: 1. Helicopter pilots seeking permission to land shall supply the following information: -Aircraft Identification Number - Weight of Aircraft -Estimated date and time of arrival -Estimated date and time of departure -Aircraft Owner's name -Insurance Company and Policy Number -Purpose of Trip 2. Helicopter pilots shall be informed of the rules and regulations governing the operations of the heliport, particularly the approach and departure paths. 3. Permission may be granted by the Sports Core Manager only after receipt and review of the information required and a finding that the proposed operation complies with all operating rules and proceedures. 4. The Police Department shall be informed of any authorized landings on a timely basis. Such information shall include all items from 1 above. 5. The. Sports Core Manager shall be informed of any unauthorized use of the facility, including date, time and aircraft number, and steps shall be taken to ;prosecute under State Aviation Laws.
