CALL TO ORDER The Special Meeting of the Village Board of Trustees was called to order by President Gopal Lalmalani in the Upper Level Conference Room of the Butler Government Center at 6:00 pm 2. ROLL CALL Village Clerk Charlotte Pruss called the roll with the following persons: PRESENT: Trustee Asif Yusuf, and President Gopal Lalmalani PRESENT VIA TELECONFERENCE: Trustees John Baar, Philip Cuevas, Michael Manzo, Moin Saiyed, Edward Tiesenga, Village Attorney Michael Castaldo, Jr. ABSENT: None IN ATTENDANCE: Village Manager Rick Ginex 3. PRESIDENT’S OPENING COMMENTS President Lalmalani announced that as of March 25th, 2020 there were 134 confirmed cases of COVID-19 in DuPage County including 1 death. He stated that the number of confirmed cases in Oak Brook stands at 4 but the numbers will continue to rise partly because of the increase in testing by commercial and hospital labs. Additionally, he asked Trustee Tiesenga about most recently diagnosed patient at the Club. Trustee Tiesenga answered by stating that the patient is in intensive care at Elmhurst Hospital and provided further detail on the patient’s condition. Furthermore, President Lalmalani stated that the Village is committed to serving its residents and reminded everyone that although the Village Hall building is closed to the public to help mitigate the spread of COVID-19, all municipal employees are working and services are continuing. Moreover, he thanked Manager Ginex for his unfaltering leadership during this unprecedented challenge and all Village employees for working hard behind the scenes and providing much needed services. Lastly, he forewarned, that due to the COVID-19 pandemic there will be financial devastation and asked Manager Ginex to prepare documentation to discuss the economic impact to the 2020 budget at the next meeting. President Lalmalani asked Village Clerk Pruss to read visitor comments that were sent in through email. 4. RESIDENT/VISITOR COMMENTS Resident Dr. Samuel Yunez III, stated that we are currently living in an unprecedented moment in history and voiced his concerns with the Governor’s allowance of having the golf courses open. He also urged the Board to take further measures to ensure health and safety of the Village’s residents by temporarily closing the golf courses. Resident William Lindeman, voiced his concerns regarding the assessment by Manager Ginex of the businesses within the Village due to the COVID-19 pandemic while focusing on hotels and motels in the area. He also asked about the Oak Brook Chamber of Commerce and other small entities within the Village. 5. CONSENT AGENDA All items on the Consent Agenda are considered to be routine in nature and will be enacted in one motion. There will be no separate discussion of these items unless a Board member so requests, in which event, the item will be removed from the Consent Agenda and considered as the first item after approval of the Consent Agenda. RESOLUTION 2020-ENG-AG-EX-R-1868, A Resolution Authorizing And Approving The execution of an Agreement by and Between Village of Oak Brook and Civiltech Engineering, Inc. 2. RESOLUTION 2020-DCL-EM-VOB-COVID-19-R-1867, Declaration of Emergency, COVID -19 3. ORDINANCE 2020-FI-HM-TX-G-l 162, An Ordinance Pertaining to Title 5 Chapter 5 of The Village of Oak Brook Code of Ordinances Trustee Tiesenga asked to extract item 5.C.3 from the Consent Agenda. Motion by Trustee Baar, seconded by Trustee Cuevas to approve the Consent Agenda, with the exception of Item 5.C.3., and authorize expenditures as presented or amended. ROLL CALL VOTE: Ayes: 6 – Trustees Baar, Cuevas, Manzo, Saiyed, Tiesenga, and Yusuf Nays: 0 – None Abstain: 0 – None Absent: 0 – None Motion carried 6. ITEMS REMOVED FROM THE CONSENT AGENDA 5.C.3, ORDINANCE 2020-FI-HM-TX-G-1162, An Ordinance Pertaining to Title 5 Chapter 5 of The Village of Oak Brook Code of Ordinances President Lalmalani asked Trustee Tiesenga to provide an explanation for extracting item 5.C.3. He also asked about the available federal funds. Trustee Tiesenga stated that he is agreement with Trustee Yusuf’s recommendation to reduce the percentage of the Hotel Motel Tax Fund to 1%. In light of the current situation, he agreed with the idea to postpone the 2020 pedestrian access project. He also asked about the originally proposed ending date. Trustee Yusuf spoke in support of reduction of the rebate to 1% at this time and allowing the other 1% for marketing in preparation of a very long summer. Furthermore, he addressed Trustee Manzo’s concerns by stating that the Ordinance can be revisited in the future especially since the availability of federal funding was not previously discussed. In addition, he reminded everyone that the amounts discussed are speculative and a possibility of the upcoming federal fund protecting employees and helping with payroll makes it prudent to go with the smaller percentage. VILLAGE OF OAK BROOK MINUTES Page 4 of 4 SPECIAL MEETING OF MARCH 26, 2020 Manger Ginex clarified that Trustee Yusuf is in favor of the 1% opposed to the 2%. Additionally, he explained the specific amounts and which hotels/motels were included in the calculation. He further clarified the federal funding and which entity is providing the funds. Manager Ginex stated that as of the date of this meeting the Village has not received any information regarding earlier mentioned funding covering easement of payroll. In conclusion, he asked Village Attorney Castaldo Jr. for clarification on the changes in the verbiage that need to take place. Also, he summarized the main points addressed for the modification and gained approval of the change in the ending date. Trustee Manzo spoke in favor of the modification of the Ordinance to 1%. He also clarified that the Ordinance is specifically referring to the Hotel Motel Tax and not any other businesses. Additionally, he asked if the subject can be revisited in the future should a need arise to do so. Village Attorney Castaldo Jr., informed Manager Ginex that the firm will adjust the language accordingly and clarified the percentages in monetary terms. All the Board Members confirmed the agreement of the change in the proposed ending date. Motion by Trustee Yusuf, seconded by Trustee Manzo to Approve Ordinance 2020-FI- HM-TX-G-1162, An Ordinance Pertaining to Title 5 Chapter 5 of the Village of Oak Brook Code of Ordinances as Amended ROLL CALL VOTE: Ayes: 6 – Trustees Baar, Cuevas, Manzo, Saiyed, Tiesenga and Yusuf Nays: 0 – None Abstain: 0 – None Absent: 0 – None Motion carried 7.
