A RESOLUTION APPROVING AND AUTHORIZING THE AWARD AND EXECUTION OF A
ENGINEERING SERVICES AGREEMENT WITH CIVILTECH ENGINEERING, INC.
FOR A NOISE WALL DESIGN AND COST STUDY
WHEREAS, the Village is considering building a noise wall to shield Tuscan Woods from the
noise generated by the Tollway("Wall'J; and
WHEREAS, the Village received a design and cost estimate for the Wall in 2006 ("Initial
Study'; and
WHEREAS, since the Initial Study, several of the assumed conditions made in the Initial Study
have changed; and
WHEREAS, in order to better assess whether it is in the best interests of the Village and its
residents to build the Wall, the Village desires to retain an engineer to provide a new design and cost
study for the Wall ('New Study"); and
WHEREAS, pursuant to the Local Government Professional Services Selection Act ("Act'), 50
ILCS 510/0.01 et seq., and Section 1-7-6 of the Village Code, the Village is not required to follow the
notice, evaluation, and selection procedures set forth in the Act for engineering services provided by
engineers who have a satisfactory relationship with the Village; and
WHEREAS, Civiltech Engineering, Inc. ("Civiltech'� has previously provided satisfactory
engineering services to the Village in connection with engineering and infrastructure projects; and
WHEREAS, the Village desires to enter into and execute an agreement for Civiltech to provide
the New Study for an amount not to exceed $12,644 ("Agreement'); and
WHEREAS, the President and Board of Trustees have determined that it is in the best interest of
the Village to enter into the Agreement;
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part
of, this Resolution as the findings of the President and Board of Trustees of the Village of Oak Brook.
Section 2: Approval of the Agreement. The President and Board of Trustees hereby
approve the Agreement by and between the Village and Civiltech in an amount not to exceed $12,644
and in a final form approved by the Village Manager and Village Attorney.
Section 3: Authorization and Execution of the Agreement. The Village President and Village
Clerk shall be, and hereby are, authorized to execute the approved final Agreement on behalf of the
Village.
Section 4: Effective Date. This Resolution shall be in full force and effect upon passage and
approval in the manner provided by law.

Proposed Tuscan Woods Noise Barrier
Preliminary Cost Estimate
Dear Mr. Hullihan:
It is our understanding that the Village of Oak Brook desires a preliminary-level cost estimate for a noise
barrier that has been proposed along the Tollway frontage adjacent to the Tuscan Woods residential
development. We understand that through coordination with the Illinois Tollway,the Tollway has
verbally agreed to participate in the cost of the noise barrier in the amount of$286,000. This is equal to
$26,000 times the agreed-upon number of houses (11)that would be benefited by the noise barrier. The
remainder of the cost of the barrier would be covered by parties other than the Tollway.
It is our understanding that the currently-assumed estimate based on copies of 2005 to 2010
correspondence provided by the Village uses a$25 per square foot of wall unit cost, for a total estimate of
between$450,000 and$500,000. As noted in the correspondence,the$25 unit cost is used for the cost-
to-benefit calculations for planning purposes, and actual construction costs will likely be different. The
constructability, scope and size of overall project and current market conditions affect the cost.
The purpose of this Preliminary Cost Estimate is to update and refine the preliminary $25 per square foot
estimate. The estimate will be provided to the Village and Tuscan Woods association so that a decision
can be made regarding whether or not the construction of the noise barrier should be further pursued, and
if pursued,then to provide the information to the Tollway so that the cost sharing agreement can be
finalized.
It is our understanding that the estimate will be prepared for the noise wall location, length and height as
shown in the"Plans for Proposed Noise Abatement Wall—Tuscan Woods Development"plan set
provided by the Village dated February 15, 2008, except that an extension will be assumed. We assume
that the noise barrier design in that plan set is based upon the April 28, 2006 noise analysis memorandum
prepared by Edwards&Kelcey for the Tollway. The assumed noise wall will be extended approximately
280 feet to the southwest along the vacant property to west of Lot 1.
At this time, since topographic survey is not available and detailed computerized noise modeling will not
be performed, we can only estimate the necessary height and location of the extension based on the 2006
study,the 2008 plan set,topographic contours of the vacant parcel and surrounding area, and roadway
profiles from as-built Tollway plans. The noise wall extension would need to be verified and finalized
during future design engineering of the noise barrier.

Following is our anticipated scope of services, a schedule and a fee estimate.
I. Scope of Work
Task I—Data Collection and Early Coordination
a. Obtain GIS files from Village, including topography, aerial photography and other layers.
b. Obtain as-built plans from the Illinois Tollway for 1-88 and ramps adjacent to Tuscan Woods.
c. Obtain recent construction bid tabs from IDOT and the Tollway.
d. Perform a field visit and photo log.
Task 2—Conceptual Noise Barrier Design
a. Estimate the height of the extension of the noise barrier to the west of the location shown in the
2008 plan set based upon existing topographic contour information and adjacent roadway profile
information.
b. Using CAD and an image of sheet 5 of 5 in the 2008 plan set as a base layer, draw the
approximated extension of the noise barrier in plan and profile view to the west on top of the
sheet.
c. Investigate the constructability of the proposed noise barrier and extension, as this could have a
significant effect on the cost given its proposed location.
d. Investigate other wall-type options(to the extent possible without soil boring information)to
determine if options exist for a less-costly noise barrier than the standard Tollway design.
e. To the extent possible with the background information provided, identify other work items
which would be necessary for the construction of the noise barrier, e.g. utilities, landscaping
removal and replacement,temporary construction access paths, maintenance of traffic on the
Tollway ramp, additional noise wall easements, etc.
Task 3—Cost Estimate
a. Research recent construction bid tabs from IDOT and the Illinois Tollway.
b. Prepare a preliminary-level cost estimate for the construction of the noise barrier and submit for
Village review.
c. Revise the estimate based on Village comments and submit a final estimate.
Task 4—Meetings and Coordination
a. Project setup and administration.
b. Internal meetings.
c. One Village Staff meeting to review cost estimate.
11. Project Schedule
We propose to submit a draft exhibit and cost estimate for client review within six weeks of the date of
authorization to proceed and receipt of all items in Task 1. This estimate is based upon current workload
and staffing availability. Should authorization to proceed occur more than two weeks from the date of
this proposal/agreement,the proposed project schedule may need to be re-evaluated.

III. Compensation
We propose to perform the work on the basis of cost plus a fixed fee, with a not-to-exceed maximum. The
fee will include reimbursement of direct labor costs, overhead and indirect costs, fringe benefit and salary
burden costs,plus a net fee for profit. We will use a billing factor of 2.8. Direct expenses will be
reimbursed at their actual cost. The upper limit of compensation is based on the workhour estimates and
fee calculations shown below:

Additional Work
During the course of the first part of this project, it may become necessary to perform additional services
beyond the scope of this contract including but not limited to attendance at additional or extended-length
meetings, additional geometric analyses/plans, or additional plan,exhibit, and report revisions. Should
some of this work become necessary,the additional fee for extra work would be billed on a time-and-
material basis. Billing rates are as follows:
Principal-in-Charge-QC/QA $70/hour x 2.8 =$196/hour
Director $63/hour x 2.8 =$176.40/hour
Project Manager: $42/hour x 2.8 =$117.60/hour
Project Engineer: $35/hour x 2.8=$98/hour
