AND GRANTING CERTAIN WAIVERS AND VARIATIONS FROM THE PROVISIONS OF
SECTION 14 -6 -3 OF TITLE 14 ( "SUBDIVISION REGULATIONS ") OF THE
VILLAGE CODE OF THE VILLAGE OF OAK BROOK RELATIVE TO LOCATION OF
WATER SERVICE LINES AND SANITARY HOUSE SERVICE,SEWER STUBS,
AND RELATIVE TO SIDEWALKS AND STREET LIGHTING

WHEREAS, the Plan Commission of the Village of Oak Brook, on May 15, 2006, recommended
the approval of the proposed Beard's Resubdivision No. 2 (3711 Madison, 403 Glendale and Vacant
Land); and
follows: WHEREAS, the property at 3711 Madison, 403 Glendale and Vacant Land is legally described as
LOTS ONE AND TWO IN BEARD'S PLAT OF RESUBDIVISION, BEING A
SUBDIVISION OF PART OF THE SOUTHWEST QUARTER OF SECTION 36,
ACCORDING TO THE PLAT THEREOF RECORDED APRIL 6, 2005, AS DOCUMENT
NO. R2005- 070415; AND LOTS 2 AND 3 IN MIZEN'S SUBDIVISION, BEING A
SUBDIVISION OF PART OF THE WEST HALF OF SAID SOUTHWEST QUARTER OF
SECTION 36, ACCORDING TO THE PLAT THEREOF RECORDED FEBRUARY 28,
1991, AS DOCUMENT NO. R91- 021449; ALL IN TOWNSHIP 39 NORTH, RANGE 11
EAST OF THE THIRD PRINCIPAL MERIDIAN, IN THE VILLAGE OF OAK BROOK,
DUPAGE COUNTY, ILLINOIS.
WHEREAS, the Village of Oak Brook has heretofore adopted an ordinance setting forth the
Subdivision Regulations for the Village of Oak Brook in Title 14 of the Village Code; and
WHEREAS, Section 14 -7 -4 of the Village Code sets forth the authority and standards for granting
variations to the Subdivision Regulations; and
WHEREAS, the owners of the property at 3711 Madison, 403 Glendale and Vacant Land,
Kenneth Beard and Jonathan Lanphier, have submitted a petition for variations to Section 14 -6 -3'B and C
of the Subdivision Regulations relative to the requirements for water service lines to property line for each
lot and house service sewer stubs to the property line for each lot; and
WHEREAS, in making its recommendation, the Plan Commission found that the applicant had
addressed the applicable standards required for a variation to the subdivision regulations; and
WHEREAS, the Plan Commission made the following specific findings with respect to the
variations:
1. The proposed land resubdivision reconfigures four (4) existing lots;
2. The proposed lots conform to the underlying zoning district of R -2;

3. The proposed subdivision will satisfy all requirements for a final plat of subdivision %as contained in
the Village of Oak Brook Subdivision Regulations;
4. The design of the proposed subdivision is in keeping with the surrounding neighborhood and
does not negatively impact any adjacent property;
5. Approval of the following requested variations is appropriate: allow the installation of water
service lines to the property line for each lot to be accomplished if and when home construction
takes place on vacant lots 2 and 3, and allow the installation of house service sewer stubs to the
property line for each lot if and when home construction takes place on vacant lots 2 and 3.
WHEREAS, the owners of the property at 3711 Madison, 403 Glendale and Vacant Land,
Kenneth Beard and Jonathan Lanphier, have submitted a petition for waivers of the requirements of
Section 14 -6 -3E and F of the Subdivision Regulations relative to the requirement to install sidewalks and
the requirement to install a street lighting system meeting Village standards; and
WHEREAS, Section 14 -6 -3E and F sets forth the authority to waive sidewalk and street lightinginstallation; and
WHEREAS, in making its recommendation, the Plan Commission found that the applicant had
shown good cause for the requested waivers; and
WHEREAS, the Plan Commission made the following specific finding with respect to the waivers:
the only street in the subdivision is the existing Madison Street and a waiver of sidewalks and street lights
on the existing street is appropriate; and
WHEREAS, the Village President and Board of Trustees have considered the recommendations
and findings of the Plan Commission and concur with same; and
WHEREAS, the Village President and Board of Trustees hereby determine that the land in
question cannot be reasonably developed other than with flag or interior lots and that the lot design with
such flag or interior lots should be permitted.
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the Final Plat of Resubdivision known as Beard's Resubdivision No. 2, prepared
by Bollinger, Lach & Associates, Inc., last revised April 28, 2006, be and is hereby approved.
Section 2: All requirements, conditions and standards of the Subdivision Regulations of the
Village of Oak Brook shall be applicable to the subdivision and development of said Beard's
Resubdivision No. 2, except as waived or varied by this Resolution.
Section 3: Variations to Section 14 -6 -313 and C of the Subdivision Regulations are hereby
granted to allow the installations of water service lines to the property line for each lot to be accomplished
if and when home construction takes place on vacant lots 2 and 3, and allow the installation of house
service sewer stubs to the property line for each lot if and when home construction takes place on vacant
Lots 2 and 3.
Section 4: Waivers to Section 14 -6 -3E and F of the Subdivision Regulations are hereby granted
waiving the requirement to install sidewalks and the requirement to install a street lighting system. meetingVillagestandards.

Section 5: This resolution shall be in full force and effect from and after its passage, approval
and publication as required by law.
Section 6: All resolutions or parts thereof in conflict with the provisions of this resolution be and
the same are hereby repealed to the extent of such conflict.
