AN ORDINANCE AMENDING ORDINANCE S-791
RELATIVE TO A SPECIAL USE FOR A SPLASH PARK/PAD
AND PLAYGROUND EQUIPMENT
OAK BROOK PARK DISTRICT
(1450 Forest Gate Road — P.I.N. # #06-26-303-001;
06-26-303-002; 06-26-303-003; 06-26-303-004)
WHEREAS, on December 19, 1994, the Board of Trustees of the Village of Oak Brook passed
Ordinance S-791, which granted a special use permitting construction of a Family
Recreation/Administration Center in Central Park; and
WHEREAS, the Oak Brook Park District has filed an application requesting an amendment to the
foregoing special use to allow for the construction of a 4,800 square foot splash park/pad and playground
equipment; and
WHEREAS, at its meeting of May 17, 2004, the Plan Commission unanimously recommended
that the requested amendment to the special use be granted with certain conditions; and
WHEREAS, the Zoning Board of Appeals, at its meeting of June 1, 2004, unanimously
recommended to the Village Board that the requested amendment to the special use be granted with
certain conditions;
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DUPAGE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as
though fully set forth herein.
Section 2: That the special use granted pursuant to Ordinance S-791 is hereby further
amended by allowing construction of a 4,800 square foot splash park/pad and additional playground
equipment on the south side of the Family Recreation Center subject to the following conditions:
a) the development shall be in substantial conformance with the plans submitted for
consideration prepared by the Oakbrook Park District dated March 15, 2004 and the
plans prepared by Hobbs Architectural Fountains dated March 8, 2004; and
b) all other provisions of Ordinance S-791 remain in full force and effect; and
C) the source of light is properly shielded from the adjacent residential property; and
d) if a speaker system is used for music or announcements, the volume will be such that the
decibel level falls within parameters defined in the Village Code.
Section 3: That this ordinance is limited to property located at 1450 Forest Gate Road, Oak
Brook, Illinois, which property is legally described in Exhibit "A", attached hereto and made a part hereof.
Section 4: All ordinances or parts of ordinances in conflict with this ordinance are hereby
repealed of the extent of the conflict.

and publication as required by law.
