AN ORDINANCE GRANTING VARIATIONS FOR A
DRIVEWAY AT 12 HEATHER LANE
IN THE VILLAGE OF OAK BROOK

WHEREAS, an application has been filed by Santefort Properties on behalf of Rich Schopp and
Christine Schopp (the "Petitioner"), requesting variations to Section 13-12-1D and 13-12-3E4 of the
Zoning Ordinance to accommodate an existing driveway at 12 Heather Lane, Oak Brook, Illinois; and
WHEREAS, on January 6, 2009, the Zoning Board of Appeals concluded the public hearing on
the request for variations, pursuant to due and appropriate legal notice, and recommended approval of
the variations subject to certain conditions; and
WHEREAS, the Zoning Board of Appeals found that the Petitioner satisfactorily addressed the
factors required for approval of the requested variations and made specific findings, including that the
variation will not endanger the public health, safety and welfare, and that there will be no substantial injury
to other property in the neighborhood; and
WHEREAS, the Village President and Board of Trustees have reviewed the recommendation of
the Zoning Board of Appeals and deem the variations, as set forth below, to be in the best interests of the
Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows:
Section 1: The foregoing preambles are restated and incorporated herein by reference as though
fully set forth herein.
Section 2: The Petitioner is hereby forgiven the violation to Section 13-12-1 D.
Section 3: The Petitioner is hereby granted a variation to Section 13-12-3E4 to allow the spacing
of two driveways to be reduced to twenty percent (20%) of the lot width instead of forty percent (40%) of
the lot width as required by the Zoning Ordinance to allow the existing driveways at 12 Heather Lane,
Oak Brook, Illinois, subject to the following conditions:
That the applicant will widen the east driveway by ten feet (10) and install a two foot (2')
radius past that as depicted on the attached drawing and subject to the approval of the
Village Engineer.
Section 4: The variations and the scope of this ordinance are limited and restricted 'to the
property located at 12 Heather Lane, which is legally described as follows:
LOT 55 IN BROOK FOREST UNIT THREE, BEING A SUBDIVISION OF PART OF
SECTION 27, TOWNSHIP 39 NORTH, RANGE 11, EAST OF THE THIRD PRINICPAL
MERIDIAN, ACCORDING TO THE PLAT THEREOF RECORDED MAY 26, 1967 AS
DOCUMENT R67-16879, IN DUPAGE COUNTY, ILLINOIS.

Section 5: If any section, paragraph, clause or provision of this ordinance shall be held invalid,
the invalidity thereof shall not affect any of the other provisions of this ordinance.

Section 6: Al[ ordinances or parts thereof in conflict with the provisions of this ordinance are
hereby repealed to the extent of such conflict.
Section 7: This ordinance shall be in full force and effect from and after its passage, approval
and publication as required by law.
