The Meeting of the Plan Commission was called to order by Chairwoman Tropinski
in the Samuel E. Dean Board Room of the Butler Government Center at 7:00 p.m.

Motion by Member Iyer, seconded by Member Hasan to waive the reading of the
minutes and to approve the minutes of the July 15, 2019 Regular Plan Commission
meeting as written. VOICE VOTE: Motion Carried.

Chairwoman Tropinski announced the petition request for a map amendment to
rezone the subject property from ORA -1 to the CR District.

Bob Johnson, Director of Parks and Planning, Oak Brook Park District, 1450 Forest
Gate Road, Oak Brook, IL, provided the background and description of the request to
rezone the 34 -acre property at 1315 and 1425 Kensington Road located just north of
the Central Park. In November of 2018, the Oak Brook residents voted 68 percent in
favor of a referendum to pursue the purchase of the property from McDonald's. The
referendum passed and the Park District finalized the sale of the property in February
of 2019. The property is zoned ORA -1 and the Park District has requested a change
to the CR Conservation/Recreation District, which is consistent with the properties
owned by the Park District. CR zoning is consistent with parks and open space as the
land use designation for this property that was part of the 2019 Commercial Areas
Revitalization Plan adopted by the Village on May 28, 2019. The required
amendment standards were addressed in writing and were included in the case file.
Member Hasan questioned the difference in the allowable building height between
the two districts and questioned if they would need to seek relief.
Mr. Johnson responded that at this point in time they do not have an intent to do that.
Member DiBernardo noted that he lives in Briarwood Lakes and the neighbors asked
if the Park District was planning any musical venues for this site and questioned if it
was a permitted use.
Director Budzikowski responded that they would need a special event license.
Mr. Johnson added that concerts were held at Central Park in the band shell on
Thursday's in the summer and there was not a plan to deviate from that at this time.
When the Park District purchased the property there was a lot of community
engagement through focus groups, surveys, open houses to gather ideas and
providing music on this property was not at the forefront.
There was no public comment from the audience.
Chairwoman Tropinski questioned whether any calls were received from the public.
Director Budzikowski responded that no calls were received regarding this petition.
Motion by Member Hasan, seconded by Member Iyer that the request was consistent
with the official plan, the zoning ordinance and with the adjacent land uses in the
immediate area to recommend approval of the request for a map amendment to
rezone the subject properties located at 1315 and 1425 Kensington Road from the
ORA -1 to the CR District. ROLL CALL VOTE:

5. B. OAK BROOK COMMONS SUBDIVISION— 1120 22ND STREET AND 2111
MCDONALD'S DRIVE — FINAL PLAT — FIFTEEN LOT SUBDIVISION
Chairwoman Tropinski announced the petition request for a 15 -lot final plat of
subdivision for the subject property.
Development Services Director Tony Budzikowski provided a brief overview of the
history for the subject property. The Oak Brook Commons Plan Development was
approved as a mixed-use project on May 28, 2019. A planned development site plan
was also approved at that time as part of the approved Planned Development
ordinance for the Oak Brook Commons project. One of the conditions was for the
applicant to come back for final plat approval. The final plat 15 -lot subdivision is
consistent with the approved Planned Development site plan and subdivides
individual lots for each building on the site plan. The final plat also creates common
area lots for parking lots, driveways, stonnwater management and a park open space
area. The Declaration of Covenants is subject to Village Attorney review and there
are requirements much more specific in that document related to easements and other
provisions related to the planned development. The Village Board must approve the
covenants and final plat.
Benjamin Schuster, Holland and Knight, 150 N. Riverside PI., Suite 2700, Chicago,
IL 60606 attorney for the applicant gave a brief description of the request. He noted
that they were required as part of the planned development for the final plat approval.
They were unable to submit the final plat until after the planned development was
approved so that they knew exactly what the Village wanted as far as common
spaces, drive aisles, etc. This is the final piece of the planned development. The
design of the plat is broken into multiple lots primarily for tax purposes and
ownership issues. If it were designed with one or two lots, they would be back to the
Village as development occurs on the sites. The proposed subdivision is 100%
consistent with the planned development site plan and ordinance that was approved
by the Village Board.
The applicant is seeking two variations from the subdivision regulations that relate to
interior lots and the right-angle requirements, which are technical issues that need to
be addressed with the regulations. Because there are multiple building's interior to
the plan variation relief is needed. The regulations also require that all lots have 90 -
degree angles and the current existing lot does not have four corners that are all 90 -
degrees. They are working within the restraints of the property.
Greg McHenry, Director at Hines, 444 W. Lake Street, Suite 2400, Chicago, IL
60606, provided an overview of Hines and several of their local projects in Chicago.
They have over 60 years' experience in project development. They also development
700 Commerce in the early 2000's. Currently, the property contains the old
McDonald's office building. He reviewed the approved site plan for Oak Brook
Commons. They would like to begin construction Fall of 2019.

Member Doyle noted that the plat has very specific lot sizes and he questioned if a
potential owner would like the lots smaller or larger, how that would be managed,
once the final plat was approved.
Mr. Schuster responded that they have studied the site extensively with market
studies and research on what they believe is the best product and right size for
success. They have also committed to the village a certain zoning plan that was
approved as part of the approved planned development ordinance. Any changes to
the approved plan would require that that they would have to come back through the
Village's public hearing process. They are going to pursue the project and in the
event that something needs to be changed, it is governed and must be approved by
the village process.
Director Budzikowski added that the approved Planned Development site plan must
be followed. They cannot exceed the building footprints for any of the building pads
and could only go smaller. It is all part and parcel with the required parking as well.
Member DiBemardo asked if a future tenant could add a drive-through.
Director Budzikowski replied that the approved site plan does not allow for a drive-
through and if a future tenant wanted to add one they would need to amend the
planned development.
Member Iyer mentioned that a drive-thru would be a special use.
Director Budzikowski noted that originally, the Planned Development Commission
reviewed the planned development and it may need to go back through the process,
rather than the Plan Commission and Zoning Board of Appeals.
Member DiBernardo asked if there would be an issue if a site designated for a
restaurant became three retail stores.
Director Budzikowski responded they could not since each lot has a designated
square footage and use that cannot be changed. The pads have specific designated
uses due to shared parking and traffic patterns generated by the uses throughout the
site. The approved planned development would allow staff, should any issues arrive
to require an analysis of the parking.
Member Wilczak questioned if the residential buildings shared the same school
district and would have the option to request a change.
Director Budzikowski responded that it was his belief that a very small portion of one
building Site L might be in the Hinsdale school district that was in a different district
than the other buildings. He believed there was ongoing discussion regarding
changing the district so that those in the small portion were changed to be within the
same school district.

Member Iyer recalled similar discussions during the Planned Development
Commission meeting and did not believe any of the residential is in the Hinsdale
Central district.
Member Wilczak said there is a portion of the site that is in the Hinsdale Central
district.
Member Doyle asked how far along the development was in the construction
schedule.
Mr. McHenry replied that they have begun abatement on the existing building and
have submitted a permit for the land designs (horizontal improvements). They have
also been in discussion with local contractors. The goal is to begin construction mid-
September.
Director Budzikowski added that the demolition permit is nearly complete. The final
plat must be approved prior to the commencement of the horizontal improvements.
There are no individual permits for individual pads; however, there is a lot of interest
for the pads.
Member Wilczak questioned the variation for interior lots and asked there were
similar variations in the village.
Director Budzikowski responded that the project was unique; however, it could be
compared to the variation to the large number of flag -lots that have been approved
throughout the village. Oakbrook Center has many lots within it that may be similar.
Motion by Member Hasan, seconded by Member Iyer to recommend approval of the
request for a final plat for the 15 -lot subdivision, including the requested variations
subject to final Engineering approval. ROLL CALL VOTE:
