A RESOLUTION APPROVING THE FINAL PLAT OF SUBDIVISION KNOWN AS
LEBBIN'S RESUBDIVISION
WHEREAS, the Plan Commission of the Village of Oak Brook on February 18,
1985 recommended the approval of the final plat of the proposed Lebbin's Resub-
division; and
WHEREAS, the Village President and Board of Trustees have considered the
recommendation of the Plan Commission and concur with same, subject to certain
conditions;
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as 176116ws:
Section 1: That the Final Plat of Subdivision known as Lebbin's Resub-
division prepared by John Nelson Surveyors dated October 31, 1984 he and i.s
hereby approved subject to the conditions enumerated in Section 2 of this
Resolution.
Section 2: That the approval of the Final Plat of Subdivision of the
Lebb.in s� Resubdivision as given in Section 1 hereof be and is hereby expressly
subject to the fdllowing conditions:
A. That, except as modified herein, the requirements of the
Subdivisidn Regulations for land improvements, including the
installation of sidewalksand street lights are waived;
B. That a storm sewer system be constructed in accordance with
the "Proposal for Storm Sewer Construction" dated FebruAry 18.
1985, and map dated April 2, 1985, copies of which are attached
hereto and incorporated herein by reference and further, that
no construction in the subdivision occur until funds for the
construction of the proposed storm sewer are placed in escrow
with a bank or title company. The owner shall also post a
completion bond or other security acceptable to the Village to
guarantee completion of all improvements set forth in the
improvement plan pursuant to Village Ordinance.
C. That pursuant to Article VII(2)(B)(9) 6f the Subdivision
Regulations, the Subdivider execute an agreement for grant of
R watercourse drainage, access and maintenance easement in a
form and substance acceptable to the Village as approved by
its Attorney.
Section 3: That all requirements, conditions and standards of the
Subdivision Regulations of the Village of Oak Brook except as waived or limited
by this Resolution shall be applicable to the subdivision and development of said
Lebbin's Resubdivision.
PASSED AND APPROVED this 9th day of April 1985 by the
President and Board of Trustees of the Village of Oak Brook, DuPage and Cook
Counties, Illinois according to a roll call vote as follows:

AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO ALLOW THE GRADING
OF LOTS IN A FLOODPLAIN PURSUANT TO SECTION 10-34 OF THE CODE OF ORDINANCES
OF THE VILLAGE OF OAK BROOK ILLINOIS
(LEBBIN'S RESUBDIVISION)
WHEREAS, the owner of certain property described herein has petitioned the
corporate authorities of the Village of Oak Brook, DuPage and Cook Counties,
Illinois, for a Special Use Permit under Section 10-34 of the Code of Ordinances
df the Village of Oak Brook, relating to flood plain and wetland regulations; and
WHEREAS, the public hearing on such petition has been conducted by the
Zoning Board of Appeals of the Village on March 5, 1985, pursuant to due and
appropriate legal notice; and
WHEREAS, on February 18, 1985, the Plan Commission of the Village of Oak
Brook submitted its recommendation to the President and Board of Trustees; and
WHEREAS, the proposed use is consistent with the'best use of the flood
plain; and
WHEREAS, the proposed use satisfies the requirements of and is consistent
with each of the factors set forth in Section 10-34(c) of the Code of Ordinances
of the Village of -Oak Brook; and
WHEREAS, the corporate authorities of the Village of Oak Brook deem the
passage of this Ordinance to be in the best interest and in futherance of the
general welfare of the Village of Oak Brook;
NOV, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are
hereby adopted as though fully set forth herein.
Section 2: Pursuant to Section 10-34 Of the Code of Ordinances of the
Village of Oak Brodk, Illinois, a Special Use Permit is hereby granted to allow
the grading of certain lots in the flood plain on property located in the
Lebbin's Resubdivision, Oak Brook, Illindis, which property is legally described
as:
Lots 1 though and including 3 of the Lebbin's Resubdivision,
a subdivision of that part of the Southwest Quarter of
Section 36, Township 39 Ndrth, Range 11 East of the Third
Principal Meridian, in DuPage County, Illinois.
Section 3: That the Special Use Permit herein granted in Section 2 of this
Ordinance is expressly subject to the following conditions:
1. That all grading on the Subject Property be done in
substantial conformity with the Final Grading Plan (Sheet 2 of
2) drawn by Lindley and Sons, Inc, as last revised April 2,
1985, a copy of which is attached hereto, labelled Exhibit A
and made a part hereof.
2. That compensatory storage shall be located in substantial
conformity with the locations shown on Exhibit A and shall be
provided in compliance with Ordinance G-217 of the Village of
Oak Brook, Sections 10-16 to 10-52 of the Code of Ordinances
of the Village of Oak Brook.

3. That citation to the provisions of this Ordinance shall be
included on each and every deed conveying any interest in the
property which is the subject of this Ordinance.
4. That the petitioner obtain the approval of the attached Final
Grading Plan by the Illindis Division of Water Resources, the
Army Corps of Engineers andtheHinsdale Sanitary District
prior to commencing any work pursuant to said plan.
5. That the petitioner shall disclose the condition of the
property to purchasers and prospective purchasers thereof by
delivery to them of a topographical map showing the property
in question giving the approximate elevation of the flood
plain for the subject property and notice shown thereon in a
form as approved by the Village.
Section 4: That this Ordinance shall be in force and effect from and after
its passage and approval as provided by law.
Section.5: All ordinances, rules and regulations of the Village of,Oak
Brook which are in conflict with the provisions of this Ordinance are hereby
repealed to the extent of such conflict but only as they apply to the property
hereinbefore described.
Section 6: If any section, subsection, sentence, clause or phrase of this
Ordinance is for any reason held to be invalid, such determination shall not
affect the validity of any remaining portion of this Ordinance.

AND THROUGH SAID INDICATED EASEMENTS, TOGETHER WITH RIGHT OF ACCESS ACROSS THE
PROPERTY, FOR NECESSARY MEN AND EQUIPMENT TO DO ANY OF THE ABOVE WORK AND THE
RIGHT IS ALSO GRANTED TO CUT DOWN, TRIM OR REMOVE ANY TREES, SHRUBS OR OTHER
PLANTS ON THE EASEMENT THAT INTERFERE WITH THE OPERATION OF THE SEWERS OR OTHER
UTILITIES. NO PERMANENT BUILDINGS OR TREES SHALL BE PACED ON SAID EASEMENTS,'
BUT SAME MAY BE USED FOR GARDENS, SHRUBS, LANDSCAPING AND OTHER PURPOSES THAT DO
NOT THEN OR LATER INTERFERE WITH THE AFORESAID USES OR RIGHTS. LOCATION OF UTILITY
INSTALLATIONS WITHIN THE EASEMENT SHALL BE SUBJECT TO THE APPROVAL OF THE VILLAGE
OF OAK BROOK, AS TO DESIGN AND LOCATION. ALL INSTALLATIONS ARE SUBJECT TO THE
