SUBJECT: Consideration of a Resolution approving a Memorandum of Understanding
(MOU) between the Village of Oak Brook and DuPage Public Safety
Communications (DU-COMM)

RECOMMENDED MOTION: I move that the Village Board approve Resolution 2020-IT-
MOU-DUCOMM-R-1893 approving a Memorandum of Understanding(MOU)between the
Village of Oak Brook and DuPage Public Safety Communications(DU-COMM)related to the
operation and maintenance of communication equipment.
Background/History:
The Village of Oak Brook is one of 44 members of DU-COMM, a 24-hour public safety
communications center that provides police, fire, and EMS communications to our public safety
departments and the community. DU-COMM connects to and accesses its communication
capabilities at facilities owned by the Village of Oak Brook.
As part of the Village's transition to Du-COMM in July of 2012, certain equipment was installed
on Village facilities to enhance the joint public safety communication system(System). The
System includes both DU-COMM owned equipment, Village owned equipment and jointly owned
equipment. This agreement outlines the parties' responsibilities related to the operation and
maintenance of all the equipment. It also contains an inventory of all the equipment installed on
Village facilities.
Recently, DU-COMM technical services staff began to review, revise, and renew existing
memorandum of understandings and intergovernmental agreements between the agency and its
various members. Upon review Du-Comm staff realized that a site lease agreement between the
Village and DU-COMM has not been previously approved.
The proposed MOU document contains an inventory of communications equipment installed and
solely owned by DU-COMM or equipment that is owned jointly by DU-COMM and the Village

(Appendix A). The agreement also outlined responsibilities with regards to installation,
maintenance, repair, and access to the equipment owned by DU-COMM or jointly owned by both
parties.
Recommendation
Staff recommends the Village Board approve Resolution 2020-IT-MOU-DUCOMM-R-1893
approving a Memorandum of Understanding(MOU)between the Village of Oak Brook and
DuPage Public Safety Communications (DU-COMM)related to the operation and maintenance of
communication equipment.

A RESOLUTION APPROVING AND AUTHORIZING A MEMORANDUM OF UNDERSTANDING
BY AND BETWEEN THE VILLAGE OF OAK BROOK AND
THE DUPAGE PUBLIC SAFETY COMMUNICATION COOPERATIVE
REGARDING SORAGE OF ELECTRONIC COMMUNICATION EQUIPMENT
WHEREAS,the Village of Oak Brook("Village")is an Illinois municipal corporation;and
WHEREAS, the DuPage Public Safety Communication Cooperative("DU-COMM')is a unit of
intergovernmental cooperation made up of members including municipalities and fire protection districts;
and
WHEREAS,DU-COMM operates a twenty-four(24)hour public safety communications center that
provides police,fire,and EMS communications for forty-four(44)member agencies under a Joint Public
Safety Communications System Agreement;and
WHEREAS,Article VII,Section 10 of the 1970 Constitution of the State of Illinois authorizes units
of local government to contract or otherwise associate among themselves"to obtain or share services and
to exercise,combine,or transfer any power or function,in any manner not prohibited by law or ordinance,"
as well as to use their revenues,credit and other resources for intergovernmental activities;and
WHEREAS, VILLAGE OF OAK BROOK is a party to the Joint Public Safety Communications
System Agreement between and among several municipal authorities establishing the DuPage Public
Safety Communications as an Illinois municipal cooperative,and
WHEREAS,OU-COMM connects to and accesses the communication capabilities at several OAK
BROOK owned or leased facilities hereinafter Oak Brook Village Hall Tower,Butler Government Center
(BGC),and
WHEREAS,the President and Board of Trustees have determined that it is in the best interests of
the Village to enter into the MOU,in a final form as approved by the Village Attorney;
NOW THEREFORE,BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK,DU PAGE AND COOK COUNTIES,ILLINOIS as follows:
Section 1: Recitals. The foregoing recitals are hereby incorporated into,and made a part of,
this Resolution as the findings of the President and Board of Trustees of the Village of Oak Brook.
Section 2: Approval of the MOU. The President and Board of Trustees hereby approve the
MOU by and between the Village and DU-COMM in a form acceptable to the Village Manager and the
Village Attorney.
Section 3: Authorization and Execution of the MOU. The Village Manager and Village Clerk
shall be,and hereby are,authorized to execute the final MOU on behalf of the Village.
Section 4: Effective Date. This Resolution shall be in full force and effect upon passage and
approval in the manner provided by law.
