AWARD OF CONTRACTS: Friends of the Oak Brook Library President Nancy Hayden addressed the Village Board of the landscape plan for the facility. She recommended to the Board that deciduous shade trees be installed around the Library rather than the ornamental trees that are recommended in the Library landscape plan surrounding the patio. She recommended postponing the patio until it could be made more esthetically pleasing with pavers or blue stone, slate, etc. The Friends garden is handicap accessible and she believes that the sprinkler system is critical and that the soil be addressed as most of the soil was removed. She stated that she is willing to work with the Library Director in addressing these issues. Library Commission Chairman Melissa Salazar addressed the Village Board that the Commission believes that the landscape plans should proceed as first proposed. They believe that the professional plan has been through a year-long process and they would like to proceed with this. Trustee Aktipis commented that the parties had a useful meeting of plans that would be more acceptable. The issue of a consensus that has not been developed is the patio. The concern is that adding more concrete is not the most appropriate solution for the front of the Library. Many drafting revisions need to be made. 2. The plat currently depicts the legal description of this parcel going to the centerline of Canterberry Lane and York Road. Regarding Canterberry Lane, which is a Village street, I recommend that this plat dedicate 33 feet, which is in keeping with the Christman's Assessment Plat dedication immediately adjacent to the east. The Assessment Plat has been drawn with this in mind; all that is needed are the words "Hereby Dedicated". Regarding York Road, I have inquired of DuPage County to see if they have an old Dedication Plat of York Road which provides either 33 feet or 50 feet of dedication at this location. I am awaiting their reply. In the event that DuPage does not have a Dedication Plat, I recommend that this Plat dedicate 50 feet for York Road. I base this on the attached spreadsheet and map depicting recorded plats along the east side of York Road. The earliest plat (Chas. Sedas Division) was accomplished in 1949, prior to the Village incorporation. The next three plats were accomplished in the 1980's and required 33 feet of dedication with 17 additional feet of bike trail easement (except the Gateway Subdivision which, instead of granting 33 feet of dedication, granted 33 feet of roadway easement). Today, I spoke with the applicant and arranged a review meeting with him and his surveyor on Monday. He said he asked for Monday in order to be on the Village Board agenda of Tuesday. I informed him that he would not be on the agenda on such short notice and also due to the Plat not being in any form to be forwarded to the Board. I have had a couple of conversations with the applicant over the past couple of weeks informing him of the requirements within the Subdivision Regulations. I understand that your staff has also had several conversations with him on the requirements over the past few weeks. The legal description includes to the centerline of York Road. I seem to remember that DuPage County has an old Dedication Plat of York Road which provides either 33 feet or 50 feet of dedication at this location. Since my memory fails me sometimes, would you please advise me if I am correct. If there is no previous dedication, the Village Board will then conclude if one should be dedicated and its size (33' or 50'). Purpose: The purpose of this section is to provide a method and procedures for the platting of property into lots not involving a "subdivision", as defined in section 14-2-2 of this title. B. Jurisdiction: The provisions of this section shall not be utilized to evade the intent and purpose of the subdivision regulations of this title, but are applicable only to the platting of single lots legally created prior to November 9, 1971, or the consolidation of such lots. Nothing contained herein shall otherwise permit the subdivision of property under the jurisdiction of this title from being so subdivided except in accordance with the terms of this title. No assessment plat shall be recorded in the office of the recorder of deeds for DuPage County, Illinois, until such assessment plat has been properly reviewed and officially approved by the village president and board of trustees. C. Definitions: ASSESSMENT PLAT: A plat of property prepared in accordance with the plat actl, which describes property as a single lot other than by a metes and bounds description and as referred to in 35 Illinois Compiled Statutes 205/35, which plat does not involve a "subdivision" as defined in section 14-2-2 of this title. LEGALLY CREATED LOT: A lot created pursuant to the provisions of the Illinois plat act or created pursuant to an exception thereto. D. Procedures: 1. The owner shall file an application for approval of the assessment plat with the village clerk. Such application shall be accompanied by the original ink tracing on linen or Mylar, eighteen (18) prints of the assessment plat, or such other number as the village clerk may designate by administrative order, and four (4) copies of all required supporting data, drawings and documents. 2. Within sixty (60) days from the date the application for approval of the assessment plat and all supporting documents were filed with the village clerk, the village president and board of trustees shall approve such plat provided that it complies with all applicable requirements of the village. Upon approval of an assessment plat, the village clerk shall certify such approval and affix the corporate seal of the village on the assessment plat. 3. Upon approval by the village president and board of trustees, the village clerk shall have the plat as approved by the village president and board of trustees recorded and on its return to the village have one Mylar or equal transparency made and deliver a copy of the assessment plat or transparency to the owner. The cost of recording and the transparency shall be paid by the owner. 4. On recording, one copy of the recorded plat and one set of supporting data shall be retained in the village clerk's files, two (2) sets retained by the village engineer and one approved set returned to the owner. E. Assessment Plat Requirements: The requirements for an assessment plat shall be the same as those established for a final plat of subdivision as detailed in subsections 14-4-2A through D, inclusive, of this title.
