RECOMMENDED MOTION: I move to approve Resolution R-1937, which
approves a final plat for a 9-lot subdivision and subdivision regulation variations for
The Overlook at Oak Brook planned development, subject to final engineering
approval prior to recordation of the plat.
Backaround/History:
At the March 9, 2021 meeting, the Village Attorney/Staff were directed to prepare the
necessary resolution granting approval of final plat of subdivision for a 9-lot subdivision
for GW Oak Brook Owner, LLC. The planned development(PD) site plan was approved
on September 8, 2020 as part of the approved PD ordinance for The Overlook at Oak
Brook project. The submitted final subdivision plat is consistent with the approved PD
site plan and subdivides (or creates) individual lots for each building within the
subdivision and these lots are identified as Lots 1 through 9 on the plat. Common area
lots are also being created for parking lots and driveways, stormwater management and
open space areas.
The accompanying resolution includes conditions requiring that the final plat and
engineering approvals be provided by the Village Engineer prior to recording.

WHEREAS,The Subject Property is legally described as follows:
BEING A RESUBDIVION OF LOT 2 IN EASTMAN KODAK SUBDIVISION IN PART OF SECTION 27,
TOWNSHIP 39 NORTH,RANGE 11,EAST OF THE THRID PRINCIPAL MERIDIAN,ACCORDING TO
THE PLAT THERE RECORDED JUNE 22,1995 AS DOCUMENT NUMBER R95-076627,IN DUPAGE
COUNTY,ILLINOIS.
WHEREAS, the Village of Oak Brook (hereinafter referred to as the"Village") is a municipal
corporation with authority provided for and granted pursuant to the Illinois Municipal Code to exercise
certain powers and perform certain functions pertaining to its local government and affairs,
WHEREAS,the Village has in full force and effect a codified set of ordinances which are of a
general and permanent nature,which said codified set is known and designated as the Village Code of
the Village of Oak Brook,as amended;
WHEREAS,GW Oak Brook Owner,LLC(hereinafter referred to as the"Petitioner")is the owner
of the 9.433 acre parcel located at 1717 22nd Street, Oak Brook, IL (hereinafter referred to as the
"Subject Property") existing in the B-3 General Business District subject to additional requirements
provided by The Overlook at Oak Brook planned development project(hereinafter referred to as the
"Planned Development');
WHEREAS,the Village Board previously approved the Planned Development on September 8,
2020 pursuant to Ordinance 2020-ZO-PUD-EX-S-1607;
WHEREAS, one of the requirements of the Planned Development was approval of a final
subdivision plat to identify buildable lots, common areas, and other necessary easements located
throughout the development site;
WHEREAS, at its meeting on February 17, 2021, the Plan Commission completed its review
and deliberations on the Petitioner's application for the final nine(9)lot subdivision plat,
WHEREAS,the Plan Commission by a vote of 5 to 0 recommended approval of the request for
a final plat of Subdivision for the Subject Property to the Village Board,and
WHEREAS,the Village President and Board of Trustees have reviewed the recommendations
of the Plan Commission and deem the final plat of Subdivision for the Subject Property, as set forth
below,to be in the best interests of the Village.

NOW,THEREFORE,BE IT RESOLVED by the Village President and Board of Trustees of the
Village of Oak Brook,DuPage and Cook Counties,Illinois as follows:
Section 1. Recitals
The Corporate Authorities hereby find that all of the recitals hereinbefore stated as contained in
the preamble to this resolution are full,true and correct and do hereby,by reference,incorporate and
make them part of this resolution as legislative findings.
Section 2. Approval of Final Plat of Subdivision.
A. Approval of Final Plat. Subject to and contingent upon the conditions set forth in Section 3
of this Resolution, the final plat of subdivision prepared by Manhard Consulting dated
February 3, 2021, as attached to this Resolution as Exhibit A ("Final Plat'), is hereby
approved.
B. Authorization and Execution. The Village President, Clerk, and other appropriate Village
officials are hereby authorized and directed to execute and seal,on behalf of the Village,the
Final Plat of Subdivision and the customary certifications indicating such approval.
C. Recordation. Upon the execution of the Final Plat of Subdivision by all required parties,the
Village Clerk is hereby directed to record the Final Plat of Subdivision with the Recorder of
Deeds of DuPage County,Illinois,and the Village Clerk will then be authorized and directed
to assess against and collect from the Petitioner any costs in connection with those actions
and this Resolution.
Section 3. Approval of Variations. Pursuant to Section 14-7-4.A of the Village Code and
subject to and contingent upon the condition set forth in Section 4 of this Resolution, the
following Requested Relief for the Subject Property is granted.
A. Lot Design Standards. A variation is granted from Section 14-6-2.B.1 of the Village Code to
allow Lots 7,8 and 9 to be interior lots that do not front on a publicly dedicated street right-
of-way.
B. Lot Design Standards. A variation is granted from Section 14-6.2.6.2 of the Village Code to
allow lots to that are not configured at right angles to straight streets.
Section 4. Conditions
The approvals granted in Section 2 of this Resolution are hereby expressly subject to and
contingent upon each of the following conditions:
A. Final engineering review and approval by the Village Engineer;and
B. The Petitioner and all subsequent Petitioners of the Subject Property shall comply with all
applicable requirements of law, including without limitation,federal, state, and local laws,
ordinances,resolutions,and regulations,relating to the Subject Property.

Section 5. Severability
If any section,paragraph,clause or provision of this resolution shall be held invalid,the invalidity
thereof shall not affect any of the other provisions of this resolution.
Section 6. Effective Date
This resolution shall be in full force and effect from and after its passage, approval, and
publication in the manner provided by law.
Section 7. Recording
This resolution shall be entered into the minutes and upon the journals of the Board of Trustees
of the Village of Oak Brook.
