RECOMMENDED MOTION: I move to approve passage of Ordinance G-1180"An
Ordinance Amending Chapter 1 of Title 4 of the Village code of the Village of Oak Brook,
Illinois Regarding Liquor License Regulations".
Backeround/History:
Senior Lifestyle have requested that the Village consider the creation of a new
classification that would allow the retail sale of alcoholic liquor, for consumption on the
premises of retirement communities for residents and invited guests.
In the review of our current Village's Liquor License Ordinance, and in consultation with
the Village Attorney, we recommend that Title 4, of Chapter 1, Section 7 ("Liquor
Regulations") of the Village Code be amended to permit retirement communities in the
Village to serve liquor.
The amendments to Section 4-1-7, and 4-1-8, of the Liquor Regulations would create a
new classification specifically permitting retirement communities to sell liquor to its
residents and guests.
The explanation for the amendments are as follows:

Section 4-1-7
The amendment proposed to Section 4-1-7 would add a new classification (Class O)
specifically permitting retail sale of alcoholic liquor for consumption when the primary
business conducted on the premises is that of a retirement community.
Section 4-1-8
The amendments to Section 4-1-8 create an application fee and annual license fee for the
new Class O liquor license. The proposed application fee is $2,000.00 and the proposed
annual license fee is $2,750.00. These fees are consistent with the fees charged by the
Village for other types of liquor licenses.
The amendments to Section 4-1-8 would also permit the Village to issue only one
retirement communities license at this time.
Recommendation:
The recommendation is for the passage of Ordinance G-1180, "An Ordinance Amending
Chapter 1 of Title 4 of the Village code of the Village of Oak Brook, Illinois Regarding
Liquor License Regulations".

AN ORDINANCE AMENDING CHAPTER 1 OF TITLE 4
OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK,ILLINOIS
REGARDING RETIREMENT COMMUNITIES LIQUOR LICENSES
WHEREAS,the Village of Oak Brook,Illinois("Village")is a body politic and corporate,organized
and existing pursuant to the Illinois Municipal Code,65 ILCS 5/1-1-1 at seq.;and
WHEREAS,Section 1142-10.1 of the Illinois Municipal Code,65 ILCS 5/11-42-10.1,and Section
4-1 of the Illinois Liquor Control Act,235 ILCS 5/4-1, provide the Village the authority to determine the
number,kind,and classification of licenses for retail sales of alcoholic liquor;and
WHEREAS,pursuant to Chapter 1 of Title 4 of the Village Code of the Village of Oak Brook,Illinois,
the Village regulates the number, kind, and classification of licenses for retail sales of alcoholic liquor
("Liquor Regulations");and
WHEREAS,the Liquor Regulations do not currently contain a liquor classification that specifically
permits retirement communities to sell liquor to its residents and invited guests or that specifically govern
the manner in which retirement communities may sell liquor to its residents and guests;and
WHEREAS,the Village President and Board of Trustees have determined that it is in the best
interest of the Village and its residents to amend the Liquor Regulations to provide for Liquor Regulations
that specifically govern the sale of liquor at retirement communities in the Village;
NOW,THEREFORE,BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK,DU PAGE AND COOK COUNTIES,ILLINOIS as follows:
Section 1: Recitals.
The foregoing recitals are hereby incorporated into,and made a part of,this Ordinance as the
findings of the President and Board of Trustees of the Village of Oak Brook.
Section 2: Amendment to Title 4 Chapter 1 Section 7 of the Village Code.
Section 7,entitled"License Classifications"of Chapter 1,entitled"Liquor Control,"of Title 4,entitled
"Business and License Regulations,"of the Village Code shall be amended further, to provide for the
addition of the following liquor classification:
4-1-7:LICENSE CLASSIFICATIONS:
CLASS 0• Retail sale of alcoholic liquor for consumption on the premises where sold when the
primary business conducted on the premises is that of a retirement community for resident%
invited guests at meals,social eygnts.marketing events and civic or community gatherings.
These licenses are authorized for issuance only to retirement developments defined as housing
developed planned_desioned licensed and operated to provide a full range of accommodations
and services for older adults including independent living assisted living sheltered care and
nursing home care Residents may move from one level to another as needs change.This term
shall include but not he limited to conttn e retirement
communities.

Section 3: Amendment to Title 4 Chapter 1, Section 8 of the Village Code.
Section 8, entitled "License Fees and Numbers," of Chapter 1, entitled "Liquor Control," of Title 4,
Section 4-1-8(A)entitled"Business and License Regulations,"of the Village Code shall be amended further,
and shall read as follows:

Section 4 - Codification
The title, chapter(s) and section(s) adopted by this Ordinance shall be numbered and placed in an
appropriate title, chapter(s), and sections(s) sections when and during the codification of the Village of Oak
Brook Municipal Code.
Section 5— Effective Date
That this ordinance become effective as of January 1, 2020 to the extent that any funds have been
collected from the hotels and motels referenced herein.
Section 6 -Conflict Clause
That all ordinances, parts of ordinances or board actions in conflict with the terms of this ordinance
shall be repealed to the extent of said conflict.

Section 7-Passage Clause
That this ordinance shall take full force and effect from and after its passage, approval and
publication as provided by law.
Section 8-Constitutionality Clause
Any part or parts of this ordinance declared by a court of law to be invalid or unconstitutional shall
not affect the validity of the remaining provisions of this ordinance or the Oak Brook Municipal Code.
Section 9-Publication
This ordinance shall be published in book or pamphlet form as provided by the Illinois Municipal
Code.
Section 10-Recording
This ordinance shall be entered into the minutes and upon the joumals of the Board of Trustees of the
Village of Oak Brook.
