SUBJECT: Award of Contract;Fire Station 93 HVAC Project

BUDGET SOURCE/BUDGET IMPACT: - $180,000 is included in Program #421, Public Buildings
Capital Improvements(421-90400),for this item.
RECOMMENDED MOTION: I move that a contract with Grosse Mechanical Contractors of
Illinois,INC., be awarded in an amount not to exceed $178,900 for the Fire Station 93 HVAC
Project.
Backeround/History: The Heating Ventilation and Air Conditioning(HVAC)system in Fire Station 93
was originally installed when the structure was constructed in 1972. Major system components including
the furnace,circulation fans, and condensers require replacement. A request for bids was prepared and
advertised and bids were received and opened on February 19, 2014. A bid tabulation is attached. Three
bids were received ranging from$212,700 to $178,900. The low bid was submitted by Grosse
Mechanical Contractors. $180,000 is programmed for the project.
Recommendation: That a contract with Grosse Mechanical Contractors of Illinois, INC., be awarded in
an amount not to exceed$178,900 for the Fire Station 93 HVAC Project.

On February 19, 2014, bids were publicly opened and read aloud for the above referenced project.
An overall bid tabulation is enclosed for your review.
The low bid was by Grosse Mechanical Contractors of Illinois, Inc. with a bid amount of
$178,900.00. The next low bid received was by Mechanical Concepts of Illinois, Inc with a bid
arnount of $181,000.00
We conducted a Bid Qualification and Scope Review over the telephone on February 24, 2014 with
Cliff Grosse of Grosse Mechanical. At that lime, he stated that their bid as reviewed includes all
specified work and equipment for the Project.
If you have any questions regarding the Information presented, please do not hesitate to contact me.

RESOLUTION 2014-FD-HVAC-CNTRCT-R-1340
A RESOLUTION APPROVING THE AWARD OF A CONTRACT FOR
THE REPLACEMENT OF THE HVAC SYSTEM AT FIRE STATION 93
WHEREAS, Fire Station 93 was constructed in 1972; and
WHEREAS, the heating, ventilation, and air conditioning system in Fire Station 93 ("HVAC
System")was installed when Fire Station 93 was built, and is now in need of replacement; and
WHEREAS, the Village sought bids for the replacement of the HVAC System; and
WHEREAS, the Village received three bids to replace the HVAC System; and
WHEREAS, Grosse Mechanical Contractors of Illinois, Inc. ("Grosse") was the lowest
responsive and responsible bidder to provide the HVAC System; and
WHEREAS, the President and Board of Trustees, being fully advised in the premises, have
determined that it is in the best interests of the Village and its residents to enter into a Contract with
Grosse;
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part
of, this Resolution as the findings of the President and Board of Trustees of the Village of Oak Brook.
Section 2: Approval of the Agreement. The President and Board of Trustees hereby
approve an agreement by and between the Village and Grosse for Grosse to replace the HVAC System
in an amount not to exceed $178,900.00 ("Agreement") in a final form approved by the Village Manager.
Section 3: Execution of Agreement. The Village President and the Village Clerk shall be,
and are hereby, authorized to execute and attest, on behalf of the Village, the Agreement authorized
pursuant to Section 2 of this Resolution.
Section 4: Effective Date. This Resolution shall be in full force and effect from and after its
passage and approval in the manner provided by law.

RELEASE AND WAIVER
FOR ACCESS TO PROPERTY
The undersigned Village of Oak Brook(the"Village")has requested that its Fire Department(the"Fire Department") be
provided with access to 1818 Swift Drive, Oak Brook, Illinois (referred to herein as the "Property") for the Fire
Department to conduct training exercises on the parking lot of the Property. All references herein to the Village shall be
deemed to include the Fire Department.
For and in consideration of access to the Property for the sole purposes of such training and for other good and valuable
consideration,the receipt and sufficiency of which are hereby acknowledged,the Village agrees as follows:
1. Duchossois Real Estate,LLC,(the "Owner")hereby grants unto the Village the privilege to enter onto the parking lot
of the Property and to use the same for training purposes at times approved by Owner,but only while the Property is
vacant and prior to the commencement of Owner's redevelopment thereof. The Village agrees that the Fire
Department will not enter into or onto the Property without the prior approval of William Huffman or another
authorized representative of Owner each time the Fire Department wishes to access the Property.
2. The Village shall, and does hereby, assume the full risk of all injuries that it may suffer from use of the Property,
including death, damage to its personal property and equipment, whether or not caused in whole or in part by the
negligence or wrongful acts of Owner.
3. The Village accepts the Property in its "AS-IS WITH ALL FAULTS" condition. The Village acknowledges and
agrees that Owner has made no representations or warranties as to the suitability of the Property for any purpose
whatsoever.
4. The Village, its heirs, successors, and assigns hereby agree to waive any and all claims against Owner, its officers,
agents and employees arising out of the Village's use of the Property.
5. If any damage to the Property results from any act or neglect Of the Village,then the undersigned shall upon demand
by Owner pay to Owner the reasonable cost of such repair and damage to the Property.
6. The Village shall procure and maintain in full force and effect,a commercially reasonable liability insurance policy
covering its obligations set forth in this Release and Waiver. The Village shall deliver an insurance certificate in a
form reasonably acceptable to Owner evidencing the existing of the aforementioned policy, naming Owner as an
additional insured.
7. The undersigned represents and warrants to Owner that he/she has proper and valid authority to execute and bind the
Village and that all information below is accurate.
8. If any clause, phrase, provision or portion of this Release and Waiver or the application,thereof to any person or
circumstance shall be invalid, or unenforceable under applicable law, such event shall not affect, impair or render
invalid or unenforceable the remainder of this Release and Waiver nor any other clause,phrase,provision or portion
hereof to other persons or circumstances.
9. The undersigned has read this Release and Waiver and acknowledges and understands that he/she has given up
substantial rights.
