G-1022 - 03/25/2014 - POLICE DEPARTMENT - Ordinances ORDINANCE 2014-PD-AUX-G-1022 AN ORDINANCE AMENDING CHAPTER 1 OF TITLE 3 OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK REGARDING AUXILIARY POLICE OFFICERS WHEREAS, the Village of Oak Brook, Illinois ("Village") is a body politic and corporate, organized and existing pursuant to the Illinois Municipal Code, 65 ILCS 5/1-1-1 et seq.; and WHEREAS, Section 5/3.1-30-20 of the Illinois Municipal Code, 65 ILCS 5/3.1-30-20, authorizes the Village to appoint auxiliary police officers to perform the following duties: (i) to aid or direct traffic within the Village; (ii) to aid in the control of natural or man-made disasters; (iii) to aid in case of civil disorder as directed by the chief of police; and (iv) normal and regular police duties, but only when it would be impractical for members of the regular police department to perform those duties and upon the assignment of the chief of police; and WHEREAS, Title 3, Chapter 1 of the Village Code of the Village of Oak Brook, Illinois ("Village Code"), establishes and regulates the operation of the Village Police Department ("Police Regulations"); and WHEREAS, the President and Board of Trustees desire to amend the Police Regulations to authorize the police chief to appoint up to 10 auxiliary police officers; and WHEREAS, the Village President and Board of Trustees have determined that it is in the best interest of the Village and its residents to amend the Police Regulations as set forth in this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part of, this Ordinance as the findings of the President and Board of Trustees of the Village of Oak Brook. Section 2: Amendment to Title 3, Chapter 1 of the Village Code. Chapter 1, titled "Police Department," of Title 3, titled "Public Safety," of the Village Code is hereby amended further by adding a new Section 9 that will hereafter read as follows: "3-1-9: AUXILIARY POLICE OFFICERS A. Appointmento The police chief may appoint not more than 10 auxiliary police officers to service in the police department under the direction and control of Auxiliary police officers shall not be members of, and shat not supplement members of. the regular police department of the Village. except as otherwise provided in this section. B. Qualifications: Prior to appointment as an auxiliary police officer, all persons must be fingerprinted. No person who has been convicted of a felony or other rime involving moral turpitude shall be appointed as an auxiliary police officer. C. Powers and Duties: 1. Conservators of the Peace: Auxiliary police officers shall be conservators of the peace, and shall have all of the powers thereof. upo ceiving a certificate attesting to their successful completion of Additions are bold and double-underlined; . Firearms: Auxiliary police officers shall not carry firearms without the specoflic permission of the chief of police, and then only while in uniform and during the performance of their duties. No auxiliary police officer all be permitted to carry a firearm unless the auxiliary police officer as first completed the course of training required of peace officers under Section 2 of the Peace Officer Firearm Trainina Act. 50 ILCS 7100. 3. Duties: The chief of police may assign auxiliary officers to perform only the following duties: a. To aid or direct traffic within the Village: b. To aid in control of natural or man-made disasters: c. To aid in case of civil disorder as directed by the chief of police: and d. When it is impractical for members of the regular police department to perform their normal and regular police duties, the chief of police may assign auxiliary police officers to perform those normal and regular police duties. D. Training: In addition to any other training required by this section and Sectio /3.1-30-20 of the Illinois Municipal Code, 65 ILCS 5/3.1-30-20, all auxiliary police officers must receive a course of training in the use of weapons an other police procedures appropriate for the exercise of the powers conferre upon them under the Illinois Municipal Code and this section. E. Identification: Identification symbols worn by auxiliary notice officers shall be different and distinct from those used by members of the regular on lice department." Section 3: Severability. If any provision of this Ordinance or part thereof is held invalid by a court of competent jurisdiction, the remaining provisions of this Ordinance shall remain in full force and effect, and shall be interpreted, applied, and enforced so as to achieve, as near as may be, the purpose and intent of this Ordinance to the greatest extent permitted by applicable law. Section 4: Effective Date. This Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
