SUBJECT: Creation of an Auxiliary Police Unit

BUDGET SOURCE/BUDGET IMPACT: Auxiliary Police 622 / $46,360
RECOMMENDED MOTION: Move to approve Oridinance 2014-PD-AUX-G-1022,
creating a police auxiliary unit.
Background/History:
Over the past two years, the Police Department has undergone an organizational structure
change, reduction in ranks, and change in the patrol operations schedule. As I have analyzed the
affects of these changes and the increase in requests for police services, especially as it pertains
to both Village sponsored and outside special events, it have become evident that our current
staffing does not adequately address those needs. I do firmly commit that our current
compliment of forty sworn, and four part time non-sworn officers does effectively handle our
normal day to day work load, however in times of specific needs, we are undermanned.
The success of the current staffing of the Police Department is incumbent with actually having
all forty officers present and available. Prior to the reduction in headcount after the economic
downturn, we did have three to four additional sworn staff members to make up the shortage.
Police work by its nature consistently experiences injuries and loss time. We will also see
natural attrition take its course in the next decade as our work force ages forecasting that this
constant struggle to stay at our authorized strength will continue.
The summer season also is when we see an increase in requests for additional services as well as
significant Village sponsored or sanctioned events happening. Because the need fluctuates, and
the need for us to be more fiscally sound in our methods, I would recommend that the Village
pass the Auxiliary Police Officer ordinance and authorize the Police Chief to appoint up to ten

Auxiliary Police Officers. Pursuant to 65 ILCS 5/3.1-30-20 the Village may appoint Auxiliary
Police Officers, however they cannot perform the duties or replace full time police officers by
state law. Their duties would be limited to special events, paid outside details, and to assist
regular full time police officers.
There is a significant economic advantage to adding auxiliary police officers to our staff. They
are not entitled to any benefits or pension, they would work for a recommended rate of$25 per
hour, and they would only be used when needed rather than as a fixed cost. There would also be
the cost of uniforms and some equipment upon start-up. I have placed an amount of$46,360 in
the budget request to reflect an amount of approximately $2000 per officer for uniforms, training
and equipment, and 500 hours of work.
Over the past several months the Police Department Administration has worked collaboratively
with the FOP Labor Council to work out any collective bargaining issues which in turn led to the
memorandum of understanding that was placed earlier on this agenda.
One of the concerns voiced by members of the Board is the selection and training of the
Auxiliary Unit, The Police Department intends on placing the candidates through the same
psychological screening and background review process we place our full time officer candidates
through. We are also intending on requiring any applicant already be a state certified police
officer through the Illinois Law Enforcement Training and Standards Board. They will then be
considered conservators of the peace and full arrest powers. These officers will also be required
to attend the same firearms qualifications and use of force training our full time staff is required
to attend.
Recommendation:
The Village Board approve the ordinance creating a Police Auxiliary Unit and authorize the
Chief of Police to appoint up to ten auxiliary officers.

ORDINANCE 2014-PD-AUX-G-1022
AN ORDINANCE AMENDING CHAPTER 1 OF TITLE 3 OF THE VILLAGE CODE
OF THE VILLAGE OF OAK BROOK REGARDING AUXILIARY POLICE OFFICERS
WHEREAS, the Village of Oak Brook, Illinois ("Village") is a body politic and corporate,
organized and existing pursuant to the Illinois Municipal Code, 65 ILCS 5/1-1-1 et seq.; and
WHEREAS, Section 5/3.1-30-20 of the Illinois Municipal Code, 65 ILCS 5/3.1-30-20, authorizes
the Village to appoint auxiliary police officers to perform the following duties: (i) to aid or direct traffic
within the Village; (ii) to aid in the control of natural or man-made disasters; (iii) to aid in case of civil
disorder as directed by the chief of police; and (iv) normal and regular police duties, but only when it
would be impractical for members of the regular police department to perform those duties and upon the
assignment of the chief of police; and
WHEREAS, Title 3, Chapter 1 of the Village Code of the Village of Oak Brook, Illinois ("Village
Code"), establishes and regulates the operation of the Village Police Department ("Police
Regulations"); and
WHEREAS, the President and Board of Trustees desire to amend the Police Regulations to
authorize the police chief to appoint up to 10 auxiliary police officers; and
WHEREAS, the Village President and Board of Trustees have determined that it is in the best
interest of the Village and its residents to amend the Police Regulations as set forth in this Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part
of, this Ordinance as the findings of the President and Board of Trustees of the Village of Oak Brook.
Section 2: Amendment to Title 3, Chapter 1 of the Village Code. Chapter 1, titled "Police
Department," of Title 3, titled "Public Safety," of the Village Code is hereby amended further by adding a
new Section 9 that will hereafter read as follows:
"3-1-9: AUXILIARY POLICE OFFICERS
A. Appointment: The police chief may appoint not more than 10 auxiliary police
officers to service in the police department under the direction and control of
e police chief. Auxiliary police officers shall not be members of, and shat
not supplement ers of. the regular police department of the Village.
except as otherwise provided in this section.
B. Qualifications: Prior to appointment as an auxiliary police officer, all persons
must be fingerprinted. No person who has been convicted of a felony or other
rime involving moral turpitude shall be appointed as an auxiliary police
officer.
C. Powers and Duties:
1. Conservators of the Peace: Auxiliary police officers shall be
conservators of the peace, and shall have all of the powers thereof, upon

training course administered by the Illinois Law Enforcement Training
Standards Board.
2. Firearms: Auxiliary police officers shall not carry firearms without the
specific permission of the chief of on lice, and then only while in uniform
and during the performance of their duties. No auxiliary police officer
shall be perm"fted to carry a firearm unless the auxiliary police officer
as first completed the course of training required of peace officers
under Section 2 of the Peace Officer Firearm Training Art, 50 ILCS 710/2.
3 Duties: The chief of police may assign auxiliary officers to perform only
the following duties:
a. To aid or direct traffic within the Village:
b. To aid in control of natural or man-made disasters:
c. To aid in case of civil disorder as directed by the chief of on lice:

d. When it is impractical for members of the reaular police
department to perform their normal and regular police duties, the
chief of police may assian auxiliary police officers_to _perform

D. Training: In addition to any other training required by this section and Section
5/3.1-30-20 of the Illinois Municipal Code, 65 ILCS 5/3.1-30-20, all auxiliary
police officers must receive a course of training in the use of weapons an

different and distinct from those used by members of the regular Dolice

Section 3: Severability. If any provision of this Ordinance or part thereof is held invalid by a
court of competent jurisdiction, the remaining provisions of this Ordinance shall remain in full force and
effect, and shall be interpreted, applied, and enforced so as to achieve, as near as may be, the purpose
and intent of this Ordinance to the greatest extent permitted by applicable law.
Section 4: Effective Date. This Ordinance shall be in full force and effect from and after its
passage, approval, and publication in the manner provided by law.
