SUBJECT: Change Order—Bath&Tennis Club Pool Renovation Project

BUDGET SOURCE/BUDGET IMPACT: $71,115 is budgeted in Swimming Operations,
Structural Improvements#812-90400.
RECOMMENDED MOTION: I move that the Village Board waive bidding and award
a contract change order to Mid-America Pool Renovation, Inc., Grandview, MO in the
amount of$71,115, and approve Resolution R-1942.
Background/History: In May 2019, the Village Board approved a contract with Mid-
America Pool Renovation, Inc., Grandview, MO, in the amount of $1,048,975. The
contract was for repairing the leaks in the Bath and Tennis pools by replacing the gutter
system, filtration system and coating the pools with INTER-GLASS, a fiberglass coating
with a 25 year Limited Warranty.
This project started after the end of the 2019 swimming season and was scheduled to be
completed before the opening of the 2020 season. Unfortunately due to Covid-19 and the
Governors shelter in place order, the State Health Departments Plan Review Office shut
down which postponed their approval of the construction plans and issuing a permit.
Without the approved plans,everything was placed on hold,the site demo work,fabrication
shops for the Stainless Steel Gutters and the new filtration system were also shut down.
In June of 2020, the State Health Department approved the plans and issued a permit and
the fabrication of the gutters and filtration system resumed soon after that. The work at the
pool started back up in September and the pool filtration and pump installations continued
through the winter months. The concrete repairs in the pool and around the surge tank are
completed and the INTER-GLASS, fiberglass pool coating is scheduled for the week of
April 12th and the filling of the pools is scheduled to begin the first week of May.

Due to the width of the new gutter system the existing handrails for climbing in and out of
the pool will not work, they are short. The existing starting blocks must also be replaced,
they must be mounted behind the gutter which will require the post to be lengthened so that
the front edge of the platform extends beyond the front edge of the gutter.
When looking at the installation of the ladder hand rails on the pools and the mounting
plates for the swimming starting blocks, they must be replaced or rebuilt. If we were to
rebuild the existing hand rails and starter blocks, the village would take on the liability for
each.
New Manufactured Ladders and Starting Blocks;
Supply and install new Stainless Steel Ladders. $22,425.00
Four(4)two-step ladders in the Lap pool.
Four(4) three-step ladders in the Dive pool.
Eight numbered Starter Blocks. $48,690.00
Single post with removable platform anchors.
Total $71,115.00
Recommendation: Staff recommends that the Village Board waive bidding and award a
contract change order to Mid-America Pool Renovation, Inc., Grandview, MO in the
amount of$71,115, and approve Resolution R-1942.

A RESOLUTION
APPROVING A CHANGE ORDER
MID-AMERICA POOL RENOVATION,INC.
BATH&TENNIS CLUB POOL RENOVATION PROJECT
WHEREAS,the Village of Oak Brook is a municipal corporation with authority provided for
and granted pursuant to the Illinois Municipal Code to exercise certain powers and perform certain
functions pertaining to its local government and affairs;
WHEREAS,the Village of Oak Brook(hereinafter referred to as"Village")upon approval
of the corporate authorities may enter into an Agreement with another party pursuant to Illinois
Statute;
WHEREAS;the Village Board, in May 2019,approved a contract with Mid-America Pool
Renovation,Inc.(hereinafter referred to as the"Contractor")for the repair of the pools located at
the Bath and Tennis Club referred to as the Bath & Tennis Club Pool Renovation Project
(hereinafter referred to as the"Project");
WHEREAS,the project was scheduled to be completed before the opening of the 2020
season,unfortunately State wide closures due to COVID-19,the State Health Department's Plan
Review Office shut down which postponed their approval of the construction plans and the
issuance of the required permits;
WHEREAS,in June of 2020,the State Health Department approved the plans and issued
a permit,the Contractor resumed the work relating to the Project,Contractor discovered that as
a result of some of the improvements additional work would need to be performed which included
the installation of ladders, and removable platform anchors resulting in an additional cost as
described herein;and
WHEREAS,the Village of Oak Brook Corporate Authorities are of the opinion that it is in
the best interests of the Village of Oak Brook to approve the change order for Mid-America Pool
Renovation,Inc.,for the purposes referenced herein.
NOW,THEREFORE,BE IT RESOLVED by the Village President and Board of Trustees
of the Village of Oak Brook,DuPage and Cook Counties,Illinois as follows:
Section One—Recitals
The Corporate Authorities hereby find that all of the recitals hereinbefore stated as
contained in the preamble to this resolution are full,true and correct and do hereby,by reference,
incorporate and make them part of this resolution as legislative findings.
Section Two—Approval of Change Order
The Village hereby approves the Change Order in an amount not to exceed$71,115.00
(seventy-one thousand one hundred fifteen dollars and no cents).

Section Three-Authorization and Direction
The Village Manager is hereby authorized to execute the required documentation with
such changes that shall be approved by the Village Attorney.
Section Four-Other Actions Authorized
The officers, employees and/or agents of the Village shall take all actions necessary or
reasonably required to carry out and give effect to the intent of this resolution and otherwise to
consummate the transactions contemplated herein, and shall take all actions necessary in
conformity therewith including, without limitation, the execution and delivery of all documents
required to be delivered in connection with the transaction contemplated herein.
Section Five-Authorization of Expenditures
The Corporate Authorities hereby authorize and direct the expenditure of all costs related
to the approval of the change order,additionally,the Village is authorized and directed to allocate
and spend all necessary funds to fulfill the requirements of the Agreement and of this Resolution.
Section Six-Waiver of Bidding Process
To the extent that any requirement of bidding would be applicable to the transactions
contemplated hereunder,the same is hereby waived.
Section Seven-Acts of Village Officials
That all past,present and future acts and doings of the officials of the Village that are in
conformity with the purpose and intent of this resolution are hereby, in all respects, ratified,
approved,authorized and confirmed.
Section Eight-Effective Date
This resolution shall be in full force and effect from and after its passage, approval and
publication as provided by law.
Section Nine-Publication
This resolution shall be published in book or pamphlet form as provided by the Illinois
Municipal Code.
Section Ten-Conflict Clause
All resolutions,parts of resolutions or board actions in conflict herewith are hereby repealed
to the extent of such conflict.
Section Eleven-Saving Clause
If any section,paragraph,clause or provision of this resolution is declared by a court of
law to be invalid or unconstitutional,the invalidity or unconstitutionality thereof shall not affect the
validity of any other provisions of this resolution,which are hereby declared to be separable.

Section Twelve- Recording
This resolution shall be entered into the minutes and upon the journals of the Board of
Trustees of the Village of Oak Brook.
