Minutes - 04/15/2013 - Plan Commission (2) MINUTES OF THE APRIL 15, 2013 REGULAR MEETING OF THE PLAN COMMISSION OF THE VILLAGE OF OAK BROOK APPROVED AS WRITTEN ON JUNE 17, 2013 1 CALL TO ORDER: CALL TO ORDER The Regular Meeting of the Plan Commission was called to order by Chairwoman Tropinski in the Samuel E. Dean Board Room of the Butler Government Center at 7:00 p.m. 2. ROLL CALL: ROLL CALL Gail Polanek called the roll with the following persons PRESENT: Chairwoman Marcia Tropinski, Members Thomas Doyle, Raju Iyer, Al Knuth and Simon Sheers ABSENT: Member Naveen Jain and Raj Lal IN ATTENDANCE: Trustee Gerald Wolin and Director of Community Development Robert Kallien Jr. 3. APPROVAL OF MINUTES: MINUTES REGULAR MEETING OF THE PLAN COMMISSION OF NOVEMBER 19, 2012 Motion by Member Doyle, seconded by Member Knuth to approve the minutes of the November 19, 2012 Regular Plan Commission meeting as written, VOICE VOTE: Motion Carried. 4. UNFINISHED BUSINESS UNFINISHED BUSINESS There was no unfinished business to discuss. 5. NEW BUSINESS NEW BUSINESS A. CANTERBERRY LANE SUBDIVISION — 204 CANTERBERRY LANE — CANTERBERRY I.N. SUBDIV. 204 FINAL PLAT—TWO-LOT SUBDIVISION CANTERBERRY LANE-TWO-LOT SUBI)IVISION Director of Community Development Kallien provided an overview of the request and noted that the subject property had two existing lots with a residence on one of the lots. The purpose of the request was to resubdivide the property so that a new house could be built. All codes and ordinances would be followed, including stormwater management, Chris Lavoie,Principal Engineer at C.M. Lavoie &Associates, 1050 W. Route 126, VILLAGE OF OAK BROOK Regular Plan Commission Minutes Page 1 of 3 April 15, 2013 Plainfield, IL, reviewed the request for the two-lot Resubdivision. Ile represented the owner Ed Greco and introduced Mr. Greco's business associate Ron DeRosa as his representative and explained that it was a very simple existing two-lot subdivision that would remain a two-lot subdivision in the ftiture. The original Douse was built across the existing property line between the parcels, the resubdivided portion with the existing home would be approximately 5.5 acres, and the remaining lot will be approximately 2.03 acres. He responded to the questions raised in the staff report relating to the neighbors comment regarding drainage, which would conform to all ordinances. The drainage from the property does not flow to the north; it flows to the southeast as shown on the topographic survey. If approved, there would be a permit submittal for the second home on the newly subdivided lot. As part of the process there would be an independent driveway constructed on Canterberry Lane. Member Doyle questioned why the parcels were being subdivided where one would be twice the size of the other. Mr. Lavoie responded that the existing owner wanted to preserve as much of the open space due to the orientation of the existing house and how the property was used and still meet the ordinance requirements. Hope Sabbagha, 203 Oak Brook Road, resident said that they live just north of the subject property. She said that in 2002, they subdivided two lots into three lots. At the time of construction,they were required to put in a 2-acre detention pond in their subdivision to retain the water. At that time, they were very upset because it took away many trees, but the detention area saved their. They are dry and have never had any water issues. Before the property was developed there was an area made to allow for detention. She questioned and expressed concern that if this property was being divided and a home would be built, then where would the water go since there is no plan for the water to be detained. They were only concerned about the water and did not object to anything else. Director of Community Development Kallien responded that the key difference between the two subdivisions was that this property is currently two lots and would remain two lots, but when her property was subdivided it started as two lots that were subdivided into three lots, so the Stormwater Management ordinance kicked in and a large formal basin was required. In the present case, they would follow the best management practices in the code and in the event the larger lot would ever be subdivided then they would need to create a formal detention pond. Mr. Lavoie said that they all follow a base code as the minimum in DuPage County that was updated in late 2012, so they are working with very stringent drainage requirements on stormwater related issues. The best management practices are identified in that ordinance and will be part of the package that is submitted to the Village for the actual house permit. A building permit would not be issued without providing that. They are in the process with existing ownership of the lot and VILLAGE OF OAK BROOK Regular Plan Commission Minutes Page 2 of 3 April 15,2013 actively involved with the new owner working on those particular plans. They were confident that they would meet all ordinance requirements and would handle all runoff so they did not affect neighboring properties. Director of Community Development Kallien offered to contact Mrs. Sabbagha to meet with one of the engineers after all drainage plans had been submitted and reviewed to show her where the water would go. Final Plat Motion by Member Doyle, seconded by Member Iyer to recommend approval of the Final Plat as submitted to resubdivide the property located at 204 Canterberry Lane into two lots, subject to the following condition: 1. All of the requirements of the Village's stormwater ordinance, Title 9 of the Village Code would be hilly met at time of any future development.
