SUBJECT: Fifth Generation Wireless Network Technology(5G)

RECOMMENDED MOTION:
• I move to approve Resolution R-1971 that Calls on Congress to Ensure
Appropriate Study of RF Emissions in the Implementation of 5G
Technology.
• I move to approve Ordinance G-1199 Amending Title 8 Chapter 6
Construction of Facilities in the Right-of-Way of the Village of Oak Brook
Code of Ordinances.
Backy-round/History:
Fifth Generation Wireless Technology (5G) has been a periodic discussion during
Public Comment at past Village Board meetings. While acknowledging the public
concern, the Village has limited local authority to enforce and administer its ordinances
in a manner that prevents the technology from being installed as long as the equipment
complies with FCC regulations.
In spite of these limitations and because safety is a concern, the Village Attorney has
been directed to prepare a Resolution and an Ordinance identifying the village's concern
about public safety but also acknowledging that the village has limited local authority on
the radio frequency monitoring issue. The first document prepared for the Board's
review is a resolution for the Board's action requesting assistance from Federal and State
elected officials; in addition to the FCC for more detailed studies into the short-and-long-
term impacts of RF and electromagnetic emissions.

The second document is an Ordinance with a strategic amendment to Title 8, Chapter 6 of
the Village Code as it relates to the construction of facilities in the right-of-way. More
specifically, the village's submittal requirements will now require that a wireless provider
submit the applicable Certification of compliance issued by the FCC detailing that the
specific wireless equipment being installed meets the regulated limits for ionizing
radiation.
Both of these documents are included for Board review and reference purposes and the
Village Attorney will be available at the meeting to answer any questions. I hope that

Recommendation:
Approve Resolution R-1971 and Ordinance G-1199.
